Baxley Rd. #40 Benton, AR RE: AFIN: Permit No.: 4814-WG-CW Dear Mr. and Mrs. Lyons: On February 6, 2009, I performed a routine compliance inspection of the waste treatment and disposal facility in accordance with the provisions of the Arkansas Water and Air Pollution Control Act and the regulations promulgated thereunder. This inspection revealed the following violation: The septic tank appears to be leaking. The storage facility s liners and structures shall be maintained to prevent leaking or seepage. Any leaks or seeps shall be reported to the Department and appropriately corrected. Any discharge from the waste storage system such as an overflow, a broken pipe, etc., shall be immediately reported to the Department. This was not done as required. The above item requires your immediate attention. Please submit a written response to this finding to Cindy Garner, Technical Assistance Manager of the Water Division Enforcement Branch of this Department. This response should contain detailed documentation describing the course of action taken to correct the item noted. Baxley Rd. #40 Benton, AR RE: AFIN ; State Permit No WG-CW; Response to Inspection Dear Mr. and Ms. Lyons: The Department has received your response to the February 6, 2009 inspection of your facility by our District Field Inspector, Jill Glenn. Your letter appears to have adequately addressed the discrepancies identified during the visit at the time it was sent. However, the Department needs updated information on corrections that have been accomplished. Your response stated that a plumber would be on site by April 11, 2009 to investigate the unauthorized discharge from the facility. Please submit a written update on corrections accomplished at the site by May 4, The Department assumes the corrective actions taken will be maintained to ensure consistent compliance with the requirements of the permit. Acceptance of this response by the Department does not preclude any future enforcement action deemed necessary at this site or any other site. The Department will keep the inspection and response on file. If future violations occur that require enforcement action, the Department will consider the inspection and response as required by the Pollution Control and Ecology Commission Regulation No. 7, Civil Penalties. This regulation requires the Department to consider the past history of your company and how expeditiously the violations were addressed in determining any civil penalty that may be necessary for any future violations.
