17 Noise Impact Study Noise resulting from rail operations is a key issue with regards to liveability of residential developments. It is recommended that proponents consult Section 2.4 of the Canadian Transportation Agency (CTA) report, Railway Noise Measurement and Reporting Methodology (2011) for guidance on the recommended content and format of a noise impact study. 17

21 Ontario Provincial Policy Statement The Provincial Policy Statement (PPS) is the statement of the government s policies on land use planning. It applies province-wide and provides clear policy direction on land use planning to promote strong communities, a strong economy, and a clean and healthy environment. The final version of the Ontario Provincial Policy Statement came into effect on April 30, 2014 and replaces the Provincial Policy Statement, Members of the FCM/RAC Proximity Guidelines Committee, attended workshops, public consultations, gave a presentation on the new Guidelines and made two submissions during 2012/2013.These actions did result in some major improvements/ changes that are supportive of our guidelines. 21

22 CTA Decisions The Canadian Transportation Agency is an independent, quasi-judicial tribunal and economic regulator. It makes decisions and determinations on a wide range of matters involving air, rail and marine modes of transportation under the authority of Parliament, as set out in the Canada Transportation Act and other legislation. The CTA cited the Guidelines and Best Practices (2004) in Decision No. 69-R-2014 last February. The noise and vibration complaint was from a resident of Vaudreuil-Dorion, Quebec. The complaint was dismissed. 22

23 Montreal Adopts New Guidelines News Release Montreal adopts new guidelines for residential developments near railway operations OTTAWA, February 4, 2015 The City of Montreal has become the first major urban area in Canada to adopt the Guidelines for New Development in Proximity to Railway Operations into its long-term development plan. The guidelines developed by the Federation of Canadian Municipalities (FCM) and Railway Association of Canada (RAC) as part of their joint Proximity Initiative address railwaycommunity issues concerning noise, vibration, and safety. 23
