4 The FAST Act Fixing America s Surface Transportation (FAST) Act Continues focus on rulemaking to strengthen public transportation safety FAST requires the following: Review of public transportation safety standards and, importantly An NPRM (Notice of Proposed Rulemaking) on transit driver safety & risk of assault 4

5 Revisiting Transit Security After 9/11 FTA received a one-time supplemental security allocation and created a portfolio of transit security initiatives Transportation Research Board J-10D Program In an Memorandum of Agreement (MOA) between DHS and DOT, TSA designated to issue regulations that will require public transportation agencies to develop and carry out security plans 1% safety and security capital expense set-aside MOU with APTA, AASHTO and CTAA to create Bus Transit Safety and Security Program 5

10 Public Transportation Agency Safety Plan The proposed rule would require an operator to develop and implement an Agency Safety Plan based on SMS principles and require: Approval of the plan by the board of directors or equivalent entity Methods for identifying and evaluating safety risks throughout the system Strategies to minimize the exposure of the public, personnel and property to consequences from hazards An annual review and update of the plan Performance targets An adequately trained Safety Officer who reports directly to the general manager, president, or equivalent officer A comprehensive training program for personnel directly responsible for safety 10

11 Resources to help you implement an SMS and develop an Agency Safety Plan SMS Implementation Pilot Program FTA is working hand-in-hand with a few transit agencies across the country, including: a large multi-modal agency; a mid-size bus agency; and small bus agencies; to develop and test guidance materials and technical assistance tools for the entire transit industry. Practical guidance and tools to help you transition your agency to an SMS and develop an Agency Safety Plan 11
