2 Stuart Jet Center, LLC, entered into an asset purchase of Stuart Jet Center, Ltd. on January 4, As a result of the sale, Stuart Jet Center, LLC assumed the Fixed Base Operators Lease (Stuart Jet Center FBO Lease) with Martin County dated January 31, Section IX Paragraph F (1) of that lease grants to Stuart Jet Center the right to sublease subject to the approval of the Martin County Board of County Commissioners, which approval shall not be unreasonably withheld. Stuart Jet Center is now presenting for Board approval a new Hangar Office Sublease Agreement with Sports Aviation, LLC for hanger office space. The sublease is in standard form for Stuart Jet Center subleases; said form was reviewed by the Legal Department and approved by the Board of County Commissioners (BCC) on November 27, The sublease rent is contained in a separate Lease Memorandum which, per prior agreement with the BCC, is not included herein. The Airport Director has confirmed that the use stated in this Hanger Office Lease Agreement is in compliance with the Minimum Standards for Aeronautical Activities of the Martin County Airport Witham Field. ISSUES: The Lease is for a term to commence on January 1, 2013 and end on December 31, There is a single one year renewal term in the Lease. The office space will be used for light sport training qualifications. Sport Pilots are restricted to one passenger, daytime flight only and contain limitations on weight as well as a 10,000 foot height limitation. Additional information and aircraft photos are attached. RECOMMENDED ACTION: RECOMMENDATION Approve the new Hangar Office Lease Agreement between Stuart Jet Center, LLC and Sports Aviation, LLC.
