Purpose of system The Objective of this project is to equip the Office of the Registrar General (ORG) with an electronic mortgage registration system which will enable improved efficiencies in the registration process, increased security in transactions, critical system integrations and decentralization of mortgage registrations; In particular, the project is expected to: Design a system that facilitates electronic registration of mortgages, including amendments of particulars in accordance with the Mortgage law; Ensure electronic management of the procedures of lease, sale, use or acquisition of mortgages in case of default in accordance with the mortgage law and the instructions of the Registrar General; Facilitate system integration and data exchange between the ORG, Rwanda National Recourses Authority (RNRA), National ID project, National Institute of Statistics of Rwanda, financial institutions and the Credit Reference Bureau Purpose of document This document is designed for users of Mortgage Registration System new system that facilitates electronic registration of mortgages, including amendments of particulars in accordance with the Mortgage law. This document is for users that perform a role of applicant. Registering user (Applicant) can: Submit data. Require for registration of a new notice (mortgage or amendment). Search, edit, review, delete and print entered data. If the dropdown list is active, the user can select one value from the list. A radio button will allow the user to choose only one value of a predefined set of options. Radio buttons will be arranged in groups of two or more circulars. Those circulars will be displayed as a list of circular holes. If the circular is selected, in the middle will be shown dot. If the circular is unselected, it will contain white space. When the user selects a radio button, any previously selected radio button in the same group becomes white spaces. Selecting a radio button can be done by clicking the mouse on the button, or the caption, or by using a keyboard shortcut. A check box will allow the user to select one or more values from the number of options. The check boxes will be shown on the screen as a square box that can contain white space (for false) or a tick mark or X (for true). The angle brackets [] will be used to mark window buttons and links, the name of button or link will be written between angle brackets Requirements for browser and its parameters The front-end of the emrs is developed considering the XHTML-1.0-Transitional Document type definition requirements to keep it as much compatible as possible with the most popular web browsers. 10 2. SYSTEM OVERVIEW 2.1. Short description of the system The system is based on the thin client and web enabled architecture. A modern technical platform is implemented as a backbone for the system operation. The system is an official and public register which enables the registration of the information required by law and makes the information available to the third parties. The conceptual design diagram briefly overviews the emrs. Figure 1 Conceptual design diagram The emrs will support only one way of submitting the application for mortgage registration. Registration through the on-line services An applicant logs in to the emrs. The system will check the logged on user identity if he (she) has all required rights to submit the application. The on-line registration starts by entering the UPI of the property to be mortgaged, which is straightaway cross checked with LAIS. If the UPI is correct, the applicant enters all required data for the abstract of mortgage agreement (AoMA). The registration number of the notary must be entered as well (A.1). Additionally the attachments if any are scanned as images and attached. The emrs performs verification of the entered data, cross checks the entered data with cooperating institutions and reports inconsistencies if any. Then AoMA is generated, printed (A.2), and signed by the creditor(s), debtor and owner of the property (in some cases). The emrs prepares and prints the payment information for the applicant: the amount of fee and possible ways to pay (A.3). Signed AoMA must be approved and signed by the notary, scanned and attached to the provided data. When registration fee is paid, the applicant enters transaction number of the JSC NRD Page 10 of 66

11 payment (A.4) and submits data for registration. If there are no inconsistencies, submitted data is registered to the on-line database. The emrs periodically checks data about done payments on payment information provider s systems through the emrs integration services (A.5). Submitted by the applicant document appears on a verifier s worksheet for the further processing. When the emrs confirms the payment is done, the verifier performs factual and legal verification (A.6) and either a) enters the recommended decision and transfers the application to the Registrar for the final decision, or b) notifies the applicant to correct the discrepancies. The Registrar decides whether a) to approve the registration, b) to notify the applicant to correct the discrepancies or c) to reject the registration (A.7). a) The Registrar approves the registration if the AoMA is found to be in accordance with the applicable legislation. The confirmation of registration is generated by the emrs and involved parties are informed. Letters about the registration will be generated if it is needed to inform cooperating institutions about the mortgage. b) The Registrar notifies the applicant to correct the discrepancies. A notification is generated by the emrs and delivered to the applicant. c) The Registrar rejects registration if the AoMA is not found to be in accordance with the applicable legislation. The rationale for the decision is noticeed into the emrs. A rejection letter is generated by the emrs and the applicant is informed. In case of major internet failure or some other similar crisis, there will be a possibility to obtain the registration and information services by the clerk at the ORG, who can submit an application for registration on behalf of the registering party. Third parties can request information from the emrs by using the information services and may also request for a verified printout, signed and sealed by the Registrar Roles of users Table 4 Roles of users Role Verifier Registrar General Receivership Officer An employee of ORG who is registered in the emrs as a verifier can: verify data provided against other registries and the law; review, search and print notices; generate and print reports on statistics; process an order for information service and print request results. An employee of ORG who is registered in the emrs as a Registrar General can: decide on the registration application and issue corresponding document (certificate, rejection letter, etc.); search, review, print the information from the register; generate and print reports on statistics; process an order for information service and print request results. An employee of ORG who is registered in the emrs as a receivership officer can: verify and manage receivership amendments; control legal timelines of the receivership process; print documents of the receivership process ("Permit to lease the property", "Notice of appointment of receiver", Permit to sale the property, Notification of approval of the selling terms and conditions, "Request for corrections of selling terms and conditions", Notification of approval of auction report, "Request for corrections of auction report", "Rejection of auction report", Certificate of ownership of the mortgage, "Permit to take possession of the property"). 12 Accountant Role An employee of the ORG who is registered in the emrs as accountant, can: receive, import and verify bank transcripts with the fee payment data stored in the emrs; generate and print reports on statistics. Administrator An employee of the ORG who is registered in the emrs as an administrator can: change his personal data; maintain predefined data lists; view all search windows of mortgages or notices, except agendas dedicated to specific users; view out journal; view messages; view reports; manage users; use single sign-on; edit help text. Registering party (applicant) Information services user (third party) Registering party (user) can be the creditor (secured party), the debtor or the owner of the immovable property. Registering party can access registration services online, specifically: - Submit data, required for registration of a new (mortgage) or an amendment to a previously registered mortgage. Any person interested in the information stored in the emrs can: register himself as information services user by signing an agreement with ORG; search for registered information; request for information on-line; receive requested information on-line; place an order for the verified information printout. 13 3. HOW TO START? 3.1. How to start work with system? If you want to start work with system, follow these actions: 1. Open you internet browser. 2. Enter the system address in the address bar and click the button [Go] in the internet browser, or button [Enter] in the keyboard. System login window appears on the screen. 3. Enter your username in the field {Username} and password in the field {Password}. 4. Click the button [Log in]. 5. Choose emrs logo and click it. Main system window appears on the screen. For more details read chapter 4.2 Login and log out. If you don`t have user login data read next chapter How to get user login data? If you don`t have user login data, follow these actions: 1. Open system login window (Figure 10). 2. Click button [Request login]. 3. Enter your data. 4. Attach file with your person identification card. 5. Click link Terms and Conditions and read it. 6. Click mark behind link Terms and Conditions. 7. Enter verification code. 8. Click button [Save]. Your request is registered in the system. When administrator will confirm your request, you will receive with your login data. For more details read chapter 4.1 Request user name and password How to register new mortgage? If you want to create new mortgage registration, follow these actions: 1. Login into system. 2. Click menu My agenda. 3. Click button [New] at the end of list. 4. Enter all data of notice, attach files. Read chapter View and edit notice for more details. 5. Print AoMA and Payment information. 6. Sign AoMA. 7. Pay for registration. 8. Enter payment transaction number. 9. Upload signed AoMA. 10. Click button [Submit]. Your registration will be registered in the system and will be processed. JSC NRD Page 13 of 66

There are two list of notices: My agenda in this list you can find notices, you are preparing at this moment. Full view in this list you can find all notices you ever prepared (notices in the process and ended notices.) State of notice shows in what step of processing it is (Figure 3). 15 If you want to find notice, follow these actions: 1. Login into system. 1. Click menu My agenda or Full view. The list of notices will be opened. 2. Use the filter to find necessary notice. More about search in the list read in chapter Search list How to find mortgage information? If you want to find mortgage of creditor you represent, follow these actions: 1. Login into system. 2. Click menu My mortgages. The list of mortgages will be opened. 3. Use the filter to find necessary mortgage. More about search in the list read in chapter Search list. Mortgage can be in these states: Registered means mortgage is active. In receivership - means mortgage is active and receivership process is in progress. Deregistered - means mortgage is ended. Figure 4 States of mortgage 3.6. How to register mortgage change registration? If mortgage is in state Registered an amendment of change can be registered on it. 16 If you want to register the changes of mortgage, follow these actions: 1. Login into system. 2. Click menu My mortgages. The list of mortgages will be opened. 3. Use the filter to find necessary mortgage. 4. Click button [View] in the line of mortgage you chose. The window with mortgage information will be opened. 5. Click button [Create amendment]. 6. Select amendment type from drop-down list. For more information about this read chapter Create new amendment. 7. Click button [Create amendment]. Window of change notice will be opened. 8. Enter all data of notice, attach files. Read chapter View and edit notice for more details. 9. Print AoMA and Payment information. 10. Sign AoMA. 11. Pay for registration. 12. Receivership process starts from approving of the notice on loan default. If you want to start receivership process, follow these actions: 1. Login into system. 2. Click menu My mortgages. 17 4. Click button [View] in the line of mortgage you chose. The window with mortgage information will be opened. 5. Click button [Start receivership]. 6. Enter data in the tab Receivership, attach files. Read chapter View and edit notice for more details. 7. Click button [Submit]. Your registration will be registered in the system and will be processed. The second way how to create amendment is described in chapter 4.7 Menu item Create amendment How to create receivership amendment? There are four types of receivership procedures: Sale of the property by auction. Creditor manages (uses) the property. Creditor leases the property. Creditor takes over the property. You can create receivership amendments of these types: Lease: Application for permit to lease manage the property. The mortgage lease agreement. Restitution of a mortgage. Sale Application for permit to sale the property. Take over Application for permit to take over the property. Manage Application for permit to manage the property. Amendment of the management plan. Management Report. Cancellation of receivership process. If you want to register receivership amendment, follow these actions: 1. Login into system. 2. Click menu My mortgages. The list of mortgages will be opened. 3. Use the filter to find necessary mortgage. 4. Click button [View] in the line of mortgage you chose. The window with mortgage information will be opened. 5. Click button [Create receivership amendment]. 6. Select amendment type from drop-down list. For more information about this read chapter Create new amendment. 7. Click button [Create amendment]. If you want to deregister the mortgage, follow these actions: 1. Login into system. 2. Click menu My mortgages. The list of mortgages will be opened. 3. Use the filter to find necessary mortgage. 4. Click button [View] in the line of mortgage you chose. The window with mortgage information will be opened. 5. Click button [Create amendment]. 6. Select amendment type from drop-down list. 20 4. WORKING WITH SYSTEM 4.1. Request user name and password If you don`t have user login data, follow these actions: 1. Open system login window (Figure 10). 2. Click button [Request login]. 3. Enter your data. 4. Attach file with your person identification card. 5. Click link Terms and Conditions and read it. 6. Click mark behind link Terms and Conditions. 7. Enter verification code. 8. Click [Save]. Your request is registered in the system. When administrator will confirm your request, you will receive with your login data. JSC NRD Page 20 of 66

Click this button to close this window and go back to login window Login and log out Write the system address in the address bar and click the button [Go] in the internet browser, or button [Enter] in the keyboard. Enter your username in the field {Username} and password in the field {Password}. JSC NRD Page 22 of 66

23 2. Click the button [Log in]. 3. If data you entered is not valid, information message appears: Incorrect username and/or password. 4. If data you entered is valid, you are logged in. Window with multiple related functions will be opened (Figure 11). Choose and click the system you want to work (this document is designed for users of Mortgage Registration System, so click on this system logo). Figure 11 Window of the systems you can choose 5. Main system window appears on the screen (Figure 12). Figure 12 System main window 6. When actions in the system are finished, click the button [Log Out] in the right corner of the system window. Enter your password in this field. Data is encoded in this field, so you will see circle symbol instead of each symbol of your password. Click this button to log in the system after username and password are entered. Click this button if you don t have your username and password User menu On the right corner of the window user information is presented (Figure 12). Next to the user first and last name, username that was used to log in the system is shown. Click the logo (flag) of language you need to turn on and system s window view will be converted into selected language. There are these menu items in a main menu: My agenda; JSC NRD Page 23 of 66

24 My full view; My mortgages; My out journal; Create amendment; Messages; Personal data; Single sign-on. You can view navigation menu (Figure 13) in main system window (Figure 12). It shows the address and location of the opened active window. The names of the system object shown in blue can be used as an active links Search list Figure 13 Navigation menu You can see the list in each window of menu item (except menu items where user can change his data, write a message, etc.). Window is composed of two data blocks: Filter and List : In Filter data block searching parameters are presented. You can search for a record in this data block. In List data block user can view a list of records. If you want to search for a record, follow these actions: 1.
