1 Administrative Order No 50/2014 of 3 September 2014 (Official Gazette No 16/2014) Numbering plan for directory enquiry numbers and numbers for call connect services 1. Legal basis Directory enquiry (DQ) numbers and call connect service numbers are numbers as defined in section 3 para 13 of the Telecommunications Act (TKG) as published on 22 June 2004 (Federal Law Gazette I No 29 of 25 June 2004, pages 1190ff). This Administrative Order sets out, as required by section 66(1) second sentence TKG and section 1 of the Telecommunications Numbering Ordinance (TNV; Federal Law Gazette I No 5 of 14 February 2008, pages 141ff), how the numbering range for DQ numbers and call connect service numbers is to be structured and configured. A separate Official Gazette Communication (see Communication No 420/2009 of 12 August 2009) sets out the application procedure. 2. Number format and subdivision of the numbering range 2.1 Subscriber numbers in the numbering space for public telecommunications The German numbering space for public telecommunications is defined by Recommendation E.164 of the International Telecommunication Union (ITU). Found here are the subranges defined by area codes and the numbering range for national numbers beginning (0)32, from which the individual numbers for access to the public telephone network are assigned to subscribers. Within these limits, subranges beginning 118 are provided for DQ numbers and call connect service numbers. These subranges form the numbering range 118 for DQ numbers and call connect service numbers. The numbers generally have five digits (DQ numbers); numbers beginning with 1180 have six digits. Thus the numbers are structured as follows: Number (5 or 6 digits) Sequence 118 Provider identifier xy where x = 1,..., 9 and y = 0,..., 9 Provider identifier 0xy where x, y = 0,..., 9 The numbers to are available solely for the operation of a call connect service. The remaining numbers structured 1180xy constitute reserves and will be available only after publication to this effect. Note 1: Regarding the provision of short code numbers in mobile networks beginning with 118, the Bundesnetzagentur reserves the right to make arrangements in a separate numbering plan.

2 Note 2: Order No 52/2008 of 8 October 2008 published in Bundesnetzagentur Official Gazette No 19/2008 stipulated that the subrange (0)1989 in the national numbering space can be used to route numbers structured 118xy. 2.2 National numbers for call connect services in the numbering space for public telecommunications In the German numbering space for public telecommunications the subrange 118 is provided for the implementation of call connect services. The national numbers for call connect services have five or six digits; the last two or three digits are the service provider identifier. When dialling a national call connect service number, the number must be preceded by the prefix "0". Thus national numbers for call connect services are structured as follows: National call connect service number (5 or 6 digits) Prefix 0 Sequence 118 Provider identifier xy where x = 1,..., 9 and y = 0,..., 9 Provider identifier 0xy where x, y = 0,..., 9 3. Purpose of use 3.1 Purpose of use of subscriber numbers Basic definition DQ numbers may be used solely for the operation of a DQ service as defined in section 3 para 2a TKG and additionally for the operation of a call connect service on the basis of section 95(2) first sentence TKG. DQ services are services that are available by telephone, across the country, at all times, used solely to pass on, in an impartial manner, telephone number, name, address and additional information on telecommunications users. Call connection to the requested subscriber or service may be part of the DQ service. Additional information is occupation, branch, type of line and co-users. Numbers for call connect services may be used solely for the operation of a call connect service on the basis of section 95(2) first sentence TKG. A call connect service on the basis of section 95(2) first sentence TKG may not be used in particular to offer premium rate or mass calling services. Subscribers may not receive any direct or indirect payments. The service may not lead to circumvention of other, in particular consumer protection, provisions National and international directory enquiries A DQ number can be assigned for a national or an international DQ service.

3 On a national DQ number subject to the restrictions of sections 104 and 105 TKG information is given on all subscriber data. A subscriber, under section 3 para 20 TKG, is a natural person or a legal entity who or which is party to a contract with a provider of telecommunications services for the supply of such services. In the case of international DQ, it must be possible to supply information on the relevant data of all foreign subscribers, provided these data are available at reasonable charge. If a provider has more than one DQ number for national or international DQ, the process of providing information may not be identical. Examples are a separate DQ service in a particular foreign language, or a computer-generated DQ service Impartial provision of information and reliable call connection in DQ services DQ services must be impartial when they provide information and connect calls to the required number. They may not give preference, when enquiries are formulated in general terms, to particular market players in the interest of non-discrimination. DQ services must focus on the task description in Further information, by contrast, constitutes a value added service. Call connection is permitted only when the destination can also be dialled direct from the public telephone network, on a separate number. Connecting calls to destinations for which the caller cannot be given a separate number is not permitted. Call connection is permitted only when other DQ services can also connect calls to the particular destination Announcement of the number before call connection The wanted number must be announced before the call is connected by a DQ service. However, the announcement is not necessary if the caller explicitly states or implies that this is the case. 3.2 Purpose of use of national numbers for call connect services National numbers for call connect services may be used when providing call connect services solely to display the number to the called party and to enable the called party to call back. Calls to a national call connect service number must be free of charge for the caller. 4. Type of assignment and assignment conditions Numbers are assigned by way of application in the form of direct assignments within the meaning of section 4(2) para 1 TNV. Applicants should show the use they intend to make of the number in an implementation plan (for details, see the application procedure for DQ numbers and numbers for call connect services, Communication No 420/2009 of 12 August 2009).

4 Number assignment gives the assignee the right to use the subscriber numbers as described in 2.1 and the corresponding national call connect service number (the same "xy" digits) as described in Maximum numbers assignable Each applicant/company can be assigned a maximum of five DQ numbers and a maximum of one call connect service number, provided the applicant/company does not already have a DQ number. A group of companies can be assigned a maximum of seven DQ numbers and a maximum of one call connect service number, provided the group does not already have a DQ number. Under section 3 para 29 TKG a group of companies includes affiliated undertakings within the meaning of the German Restraints of Competition Act. 6. Other conditions of use 6.1 Pre-use period Numbers as described in 2.1 must be put into use not later than 90 days after receipt of the assignment. There is no deadline for the beginning of use of numbers as described in 2.2. It is incumbent on the assignee to put the number as described in 2.1 into use within the specified time. The assignee is responsible for timely use. Technical, contractual or economic hindrances or fault on the part of the assignee play no part. The assignee must notify the Bundesnetzagentur, in writing, of the date on which use begins. Notification must be made not later than 14 days after the number is first used. The assignee should also state the networks in which the number is activated. 6.2 Return of numbers If a number as described in 2.1 is not used within a period of 90 days as required in 6.1 or if there are no plans to use it for 90 days beginning at the time of assignment or the last time it was used, the number must be returned to the Bundesnetzagentur without delay, by written declaration, as provided for by section 9(1) in conjunction with subsection (4) first sentence TNV. The same applies to the corresponding number as described in 2.2. Any company obtaining more than five or any group of companies obtaining more than seven DQ numbers must return the surplus to the Bundesnetzagentur, without delay, by written declaration (cf section 4(6) second sentence TNV). This applies accordingly where a company or a group of companies obtains more than one call connect service number. The same applies to surplus numbers as described in Notification of changes of name or address Assignees must inform the Bundesnetzagentur in writing, on their own initiative, of any change in their name or address. The address given must always be one in Germany at which summons can be served. If any changes are made to an entry in the commercial register or equivalent of another country, up-to-date extracts must be submitted to the Bundesnetzagentur immediately.

5 6.4 Notification of number activation changes Assignees must inform the Bundesnetzagentur in writing, on their own initiative, of any change in the activation of their number. The assignee should state the networks in which the number is currently activated. 7. Effective date This Administrative Order replaces Administrative Order No 53/2011 of 3 August 2011 (Official Gazette No 15/2011) and takes effect upon its publication in the Official Gazette on 3 September Rights of appeal An appeal against this Administrative Order may be lodged within one month of its issue. The appeal must be filed in writing with the Bundesnetzagentur, Tulpenfeld 4, Bonn or any other Bundesnetzagentur office, or placed on record. The requirement of written form is met if electronic media are used. In this case, the electronic document must be signed with a qualified electronic signature as defined in the Electronic Signatures Act (SigG). An appeal does not have suspensory effect. Filing an appeal does not change the effect or enforceability of the Administrative Order in any way.
