Powerful new features and functionality help you target the information you need from the most comprehensive collection of sources available. With the new Quicklaw, your research is easier, more flexible, more efficient, and more precise. 8 Signing In To sign in, visit You also can visit the LexisNexis Canada web site at and select New Quicklaw from the Current Subscribers drop down list. Signing in accesses Quicklaw and other products you are authorized to use. 1. Choose the language in which you wish to view Quicklaw. 2. Enter your user ID and Password. Note: If you require assistance with your user ID or password, please contact Customer Support at or service@lexisnexis.ca. 3. Select Remember My Sign In Information to bypass the sign in page on subsequent research sessions. This is not recommended for security reasons if your computer is used by anyone other than yourself. 4. Click the Use a Secure Connection (SSL) for Entire Session link to choose a secure connection throughout your research session. This option will take effect the next time you sign in. Note: Using a secure connection for the entire session is not normally required and will slow down your session. 5. Click the Forgot Your Password? link to request an reminder of your password. 6. Click the Sign In button to begin your research session. Note: If you are an IP authenticated user such as a law school or other academic user or a large law firm user, but would like to use certain features such as preferences and saved searches, you may go to a form to register your personalized ID and password from the sign in page Customer Support: service@lexisnexis.ca

9 General Search Form The General Search form is divided into four main sections. 1. Find a Document find a case by name or citation, note up a case, or find legislation and journal articles. 2. General Search search across your entire subscription, multiple content types, or a selected source. 3. Quick Sources search or browse a subscribed source. Customize your source list. 4. 10 Find a Document The Find a Document section provides a variety of task oriented options, such as find a case by name or citation, note up a case, or find legislation and journal articles. Using Find a Document is often the quickest way to retrieve a specific document. 1. Select one of the tasks from the drop down list. 2. Enter your search terms. Once you choose an option, the search field displays an example or explanation of the search terms required. 3. Click Go Note: For more information on how to format a citation, click the Citation Help link. 11 General Search The General Search section allows you to search across your entire subscription, multiple content types, or a selected source. Use this form when you have a general query or are searching in an unfamiliar area of law Entering Search Terms 1. Enter your search terms in the text box provided. Include connectors and other special characters to link terms and phrases, and to search for word variations. 2. Click the View Connectors link for more information on how to format your search. 3. Click the Index Term Lookup link to focus your search on a specific topic or broaden your search to span an entire subject. 4. Select Singular and Plural to find regular and irregular plural forms. Select Masculine and Feminine to find both masculine and feminine forms of your words (French only). Canadian spellings will find the American equivalents (e.g., labour will also find labor). Selecting a Source 5. Select a source from the drop down list, or 6. Click the Find More Sources link to select other sources, or 7. Select Cases, Legislation, or Commentary to search all sources in the content type. 8. Click the View Combined Sources link to view the contents of a source you have combined. 13 Quick Sources The Quick Sources section contains frequently consulted sources for different content types like case law, legislation, commentary, and tribunal cases. These sources can be customized to meet your needs Choosing a Source 1. Choose a Quick Source of the content type you wish to search, or 2. Click the More link under a particular content type to find additional sources quickly. Once you have selected a source from the Source Directory, you will be taken to the appropriate search form. Note: Click the icon to view information about a source. Customizing Your Quick Sources 3. Click the Customize link in the Quick Sources section on the General Search form. 4. Select a category from the drop down list. Choose from Case Law, Legislation, Commentary, and Tribunal Cases. 5. Highlight a source and click the up or down arrows to change the display order. 6. Click the Remove Selected Item link to remove a highlighted source. 7. Click the Add More Sources link to browse the Source Directory for more sources of your selected category type. 8. Click Done. 14 Related Links The Related Links section enables you to access different pages within the service that contain task related information. Content listed under the Related Links section varies depending on the form you re using. 1. Related Searches click one of the Related Searches links to access additional search forms with related content types. 2. History & Alerts click these links to go to your existing Saved Searches, Recent Searches, Recent Documents Viewed, Scheduled Searches (Alerts), or Legal Updates. 3. Links click one of these links to access additional information about LexisNexis and other services from the LexisNexis Canada web site. 4. How do I? click one of the How do I? links for form related information on how to perform specific tasks on Quicklaw. Clicking one of these links opens the help window. 5. View Tutorials choose one of the online tutorials to guide you through accomplishing specific tasks on Quicklaw. 15 Index Term Lookup What Are Index Terms? When information is added to Quicklaw, it is indexed. This means that we automatically pick out the subjects, industries, companies, and geographic regions that have a strong relevance to the article. This is achieved by using complex algorithms and searches looking for keywords and phrases. Your search can then be run looking for the terms to be mentioned in the indexing rather than the free text in the document alone. Index terms help you improve your search results. You may use them to either focus your search on a specific topic or broaden your search to span an entire subject. You may add up to 150 index terms. When searching for news about a company or other subject, you must decide whether the indexing will help you, or whether it might exclude articles you need. Note: The general Index Term Lookup is not available for all search forms and operates differently from the Index Term Lookup for Companies searching. When to Use Index Terms When searching for a company that is frequently mentioned in non company related articles (e.g., Disney) When searching for a term that would be too general (e.g., police or trial) When Not to Use Index Terms When looking up your own company or client, as you likely want to find every mention of it, not just documents that are indexed by it When looking up someone or something that rarely gets mentioned When searching for news about an obscure company Customer Support: service@lexisnexis.ca 9

16 Searching with Index Terms Finding Index Terms Use this form to find index terms and add them to your search. To search for index terms, click the Index Term Lookup link underneath the Enter Search Terms box on the search form. A pop up window will appear Select the Find radio button to search for specific index terms. 2. Select to find index terms containing, starting with, or exactly matching your search terms from the Find Terms drop down list. 3. Enter a word or phrase to find the appropriate term to add to your search. Use connectors (AND, OR, AND NOT) to show relation of terms (e.g., aboriginal OR native). 4. Click the Find button. The results will be displayed below. 5. Use the icons to navigate results lists with multiple pages. 6. Click the icon to find term information for a particular index term, and then click the Go Back button to return to the Index Terms list. 7. Click the checkbox next to an index term to select terms that match your research topic. 8. Click the View Selected button at any time to review a list of selected index terms. Here you can click the connector link before each term (AND, OR, AND NOT) to cycle between connectors, or click to remove an index term from the list. 9. Click OK Add to Search in either the Find list or the Selected Index Terms list to return to the search form. 17 Browsing Index Terms by Hierarchy Use this form to browse a hierarchy of index terms and add them to your search. Click the Index Term Lookup link underneath the Enter Search Terms box on the search form. A pop up window will open Select the Hierarchy radio button to browse a hierarchy of index terms. 2. Click to expand or to contract listed index terms to browse the hierarchy. 3. Click the icon to find term information for a particular index term, and then click the Go Back button to return to the Index Terms list. 4. Click the checkbox next to an index term to select terms that match your research topic. 5. Click the View Selected button at any time to review a list of selected index terms, then click the connector link before each term (AND, OR, AND NOT) to cycle between connectors, or click to remove an index term from the list. 6. Click OK Add to Search in either the Hierarchy list or the Selected Index Terms list to return to the search form. The index terms you have selected are added to your search. 18 Browsing Index Terms Alphabetically Use this form to browse index terms alphabetically and add them to your search. Click the Index Term Lookup link underneath the Enter Search Terms box on the search form. A pop up window will open Select the Alphabet radio button to browse index terms in alphabetical order. 2. Click a letter of the alphabet to view index terms beginning with that letter. 3. Use the icons to navigate term lists with multiple pages. 4. Click the icon to find term information for a particular index term, and then click the Go Back button to return to the Index Terms list. 5. Click the checkbox next to an index term to select terms that match your research topic. 6. Click the View Selected button at any time to review a list of selected index terms, then click the connector link before each term (AND, OR, AND NOT) to cycle between connectors, or click to remove an index term from the list. 7. Click OK Add to Search in either the Alphabet list or the Selected Index Terms list to return to the search form. The index terms you have selected are added to your search. Index Terms Search Results Results are automatically sorted according to relevancy. Once you have run your search using index terms, you can see these index terms and relevancy rankings (i.e., percentages indicating how strongly relevant or not an article is to a particular index term) in the Search Terms in Context view format. These rankings appear at the bottom of each result. A relevancy ranking of 80% or above indicates a strongly relevant article to the index term you have searched with. 12 Customer Support: service@lexisnexis.ca

19 Content Specific Search Forms Quicklaw offers several ways for you to search by offering content specific search forms, which are available via the Search tab. Content specific search forms are intended for searching within a specific content type. For example, the Court Cases search form searches within common law, civil law, and international court cases only. These content specific search forms have been tailored to searching a certain content type. You will find more document segments displayed on these search forms. Note: You can choose to make any of the search forms your start page. When you sign in, you will automatically go to the page you have selected as your start page. See page 73 for instructions on how to select your start page. Content Specific Search Forms Court Cases Use this form to search within common law, civil law, and international cases. Tribunal Cases Use this form to search within available federal and provincial boards and tribunals. Legislation Use this form to search within current Canadian legislation, historical Canadian legislation, bills, and international legislation. Journals Use this form to search within local and international journals sources. News & Companies Use this form to search within business- and newsrelated sources such as Factiva, Dun & Bradstreet Reports, Hoover s Company Records, and Current News. Commentary Use this form to search within local and international commentary sources such as law journals, NetLetters, and legal treatises. Customer Support: service@lexisnexis.ca 13

20 Court Cases Use the Court Cases search tab to search within common law, civil law, and international cases. Click the links to the right of the form to switch between the cases search forms Entering Search Terms 1. Enter your search terms in the text box provided. Include connectors and other special characters to link terms and phrases, and to search for word variations. 2. Click the View Connectors link for more information on search string construction. 3. Click the Index Term Lookup link to focus your search on a specific topic or broaden your search to span an entire subject. 4. Select Singular and Plural to find irregular plural forms. 21 7. Click the View Combined Sources link to view the contents of a source you have combined. Refining Your Search 8. Click the [+] Show link to search within document segments. Choose a connector, a segment to search from the drop down list, and enter terms. Click Add to Search. 9. Locate a case by words in the case name (e.g., to find City of Winnipeg Condominium Corporation v. Metro Toronto Transit Authority, enter Winnipeg AND Toronto). This is best used when you are uncertain of the complete style of cause. If you know the complete style of cause, it is more efficient to use the Find a Document feature on the General Search form. 10. Enter a citation or partial citation. Click Citation Help for instructions on how to format citations. This box is most useful if you only have a partial citation. If you have a complete citation, it is more efficient to use the Find a Document feature on the General Search form. 11. Limit your search by date, or select a predefined timeframe. Select a date parameter from the drop down list provided and enter your date restrictions. 12. Search for words that appear within the summary of the case only. Enter your terms in the text box provided (e.g., age /5 discriminat!). Note: Only cases that contain summaries will be searched when using this segment. 13. Limit your search to documents from a jurisdiction or court. Selecting a jurisdiction will automatically reveal the courts available for selection in that jurisdiction. 14. Find cases heard by a particular Judge, Panel, or Arbitrator (e.g., Kirby). 15. Click the Search button. Customer Support: service@lexisnexis.ca 15

22 Browse (International Reporters Only) Use the Browse form to view a source in more detail. To access the Browse form, choose one of the International Cases search forms (Common Law or Civil Law) from the Court Cases Search Forms list, and then click the Browse sub tab Note: Some single sources cannot be browsed, and some combined sources may contain single sources that cannot be browsed. 1. Click the icon to view information about the service including when it was last updated. 2. Click the icon to open the publication tree for a particular source. 3. Click the checkbox next to a source to select all documents within it, or 4. Click the checkbox next to the documents you wish to view, and then click the View Tagged button. 5. Click the,, or icons to print, download, or have selected documents ed to you. 6. Use the Quick Search form to find results quickly within the source you are browsing. 16 Customer Support: service@lexisnexis.ca

23 QuickCITE Use this form to search within the QuickCITE collection to find QuickCITE records for cases on Quicklaw. This form searches words contained in QuickCITE records only, not in the full text of the decisions cited. The QuickCITE case citator source allows you to validate the authority of your cases and provides the comprehensive case history and treatment coverage necessary to assess the strength of cases. The QuickCITE case citator contains case information such as parallel citations, case history, lists of subsequent citing cases, and the judicial treatments in those citing cases. QuickCITE permits you to: 1. Determine the prior and subsequent history of a particular case, if the courts have provided this information in an unequivocal manner. 2. Find all instances where a case has been cited by other cases. 3. Determine what sort of judicial treatment the cited case receives from the citing cases. 4. Determine the parallel (or alternate) citations for other law reports that published the case. QuickCITE contains records for: 1. All Supreme Court of Canada cases since All Canadian cases appealed from Canada to the Judicial Committee of the Privy Council (U.K.) from 1867 to 1959, when such appeals ceased. 3. All full text Canadian court cases published in printed law reports since All decisions reported on Quicklaw in Canadian Judgments (source CJ) since 1993, plus 89,000 decisions that pre date 1993 (work in progress). 5. 24 Accessing QuickCITE To access the QuickCITE form, click the Court Cases search tab, and then click the QuickCITE link listed under Court Cases Search Forms. Construct your search by entering information such as search terms, case name, citations, jurisdiction, and court Construct a search string using connectors to show the relationship between terms. Click View Connectors for more information on search string construction. 2. Limit your search to any segment of a document within the selected source group. Click Show. Use the Segment list to choose the part of the document you wish to search, enter the search terms in the Terms box, and then click Add to Search to create the search string. 3. Enter text to search for QuickCITE records containing these terms in the case name segment of the document (e.g., to find Smith v. Jones, enter Smith AND Jones). 4. Enter the case citation exactly as it would appear on the decision. If you have only a partial citation, use terms and connectors between the parts of the citation (e.g., if your citation is [1993] S.C.R. 159 and you are missing the volume number 2, you may search 1993 PRE/2 S.C.R. PRE/1 159). 5. Click the [+] Show link to search within document segments. Choose a connector, a segment to search from the drop down list, and enter terms. Click Add to Search. 6. 25 QuickCITE Results The QuickCITE case citator contains information about a case such as parallel citations, case history, lists of subsequent citing cases, and the judicial treatments in those citing cases Click the History of Case link to view previous or subsequent proceedings related to the primary case. The annotation before the case name listed indicates whether the case affirmed, carried, reversed, etc., the case before it. 2. Click the Summary of Judicial Considerations link to view how many times this case has been judicially considered in other cases. Beside the type of treatment, you will see how many times the treatment has been applied to this case. 3. Click the Citing Cases link to view the decisions that have considered the primary case. 4. Choose a Filter By option such as Jurisdiction, Treatment, and Court Level. 5. Choose a Sort By option from the drop down list. Customer Support: service@lexisnexis.ca 19

26 Case Treatment Indicators Citator Information Icon click this link to view more information about a citation. Positive Treatment Icon the case has positive history (affirmed, judicial review denied, or leave to appeal refused by a higher court) or positive treatments (followed or followed in a minority opinion of a subsequent court). Cautionary Treatment Icon the case has been distinguished by a subsequent court. Negative Treatment Icon the case has negative history (judicial review allowed, reconsideration allowed, reversed, quashed, or varied by a higher court) or negative treatments (not followed or questioned by a subsequent court). Neutral Treatment Icon/History Treatment Icon the case has neutral treatments (mentioned, explained, or cited in a dissenting opinion); or the case has history (abandoned, abated, leave to appeal granted reconsideration denied, related proceeding, same case, or supplementary reasons by a subsequent court), but the citing court does not comment on the cases. Definitions of Case Histories Abandoned appeal is withdrawn by one or both parties, or by the court for failure to actively pursue the appeal. Abated issue has become moot, for example, when one of the parties dies. Affirmed appeal is dismissed, whether or not the decision of the court below is expressly affirmed. If the court of the citing case is evenly divided, the appeal is treated as dismissed. Judicial Review Allowed court grants an application for relief from an administrative decision. Judicial Review Denied court refuses an application for relief from an administrative decision. Leave to Appeal Granted citing decision allows leave to appeal. Leave to Appeal Refused citing decision refuses leave to appeal. Reconsideration Allowed court or board grants a request to amend or reverse its original decision. Reconsideration Denied court or board refuses a request to amend or reverse its original decision. Related Proceeding citing decision refers to an earlier proceeding arising out of the same facts and involving the same parties. Reversed appeal is allowed and the decision of the court below reversed, whether or not the matter is sent back for further adjudication. 20 Customer Support: service@lexisnexis.ca

27 Supplementary Reasons citing decision arises from issues raised in the initial decision, such as costs, sentencing, damages, or further liability. They will often be contained in a corrigendum or an addendum. Varied some alteration is made in the decision of the court below without completely rejecting it. The lower court decision is affirmed or reversed in part only. Same Case As a history relationship exists with a subsequent case. Quashed reviewing court sets aside a decision of a lower court on the basis that the lower court had no jurisdiction to decide the matter before it (also used where a warrant for committal in a criminal case is quashed or vacated). Definitions of Case Treatments Distinguished cited case is held to be inapplicable due to a difference in fact or law. Explained citing case adds to, expands upon, or interprets cited case. The cited case is not decisive, but is given some kind of consideration. Followed citing case in a majority or plurality opinion applies a principle of law from the cited case. The judge expressly relies on the cited case as a precedent on which to base a decision. Followed in Minority Opinion citing case, in an opinion other than a majority, plurality, or dissent, applies a principle of law from the cited case. Cited in Dissenting Opinion case is cited in a dissenting opinion. Mentioned citing case provides no more information about the cited case than what is available in the cited case itself. Not Followed citing case overrules or refuses to apply the cited case for some reason other than it was distinguishable. 28 Noting Up Cases Outside the Scope of QuickCITE Sometimes a case you wish to note up or the citing cases you wish to find are outside the scope of QuickCITE (e.g., decisions from outside Canada; decisions prior to 1993 reported only by LexisNexis on Quicklaw; certain administrative tribunal decisions). To note up a case outside the scope of QuickCITE, select the appropriate case law source using words from the case name as your search terms. Do not search within the QuickCITE source. We suggest you select a broad source such as All Canadian Judgments. Example: To find Canadian cases that have cited the United States Supreme Court case Miranda v. Arizona, (384 U.S. 436): 1. Select Current Version (all jurisdictions), All Versions (Point in Time sources only), or In Effect (Point in Time sources only) to find the version of the act or legislation in force at a specific time. The Editor s Table appears after the changed section (in the Ontario statutes sources, the Editor s Table may appear after a subsection). The example below is taken from Canada Statutes, Criminal Code, SECTION 4. You may see variations in the appearance or wording in other statutes sources Editor s Table does not contain all information respecting changes to this section since the last official revision. See the historical note for references to changes that took place prior to the commencement of the Editor s Table. 2. Traditional Historical Note lists all changes to the section since the last official revision follows the Editor s Table in federal and British Columbia statutes. Note: In Ontario statutes, a historical note may appear following the Editor s Table, or may appear at the end of the section. For Ontario statutes that do not have historical notes, check the Amended by line that appears at the top of the statute. If there is no Amended by line, the statute has not been amended. 3. Changed by used to indicate any type of change (e.g., amendment, repeal, enactment, repeal/substitution, or re enactment). 4. Authority refers to the legislative means that brought the change into force. Changes to the statutes may be brought into force in any of the following ways: By Royal Assent (abbreviated to R.A.) 35 Viewing and Printing an Entire Act 1. Perform a search for the particular act you wish to view (e.g., National Capital Act). 2. Click the name of any section for the particular act you wish to view. That section is displayed (e.g., National Capital Act, SECTION 1). 3. Select the name of the entire act from the View drop down list (e.g., National Capital Act). 4. Click the print icon. The Print Documents window will appear. 5. Select Full from the Document View drop down list to print the entire act. 6. Click the Print button. To return to your original results: 1. From the Results page, select Back to Original Results from the Next Steps dropdown list. 2. Click the Go button. Finding Statutes Judicially Considered 1. Select a case law source that is likely to contain cases that consider the statute (e.g., to search for cases that judicially consider an Ontario statute, select source Ontario Judgments). To search for cases that judicially consider a federal statute, select a national coverage source such as All Canadian Judgments. 2. Type the title of the act. You may wish to include acronyms (e.g., Canada Business Corporations Act OR CBCA). 3. If you use a section number as one of your search terms, use a proximity connector of at least /20 between the title of the act and the section number (e.g., Canada Business Corporations Act OR CBCA /20 143). Enter Search Terms enter a search term or phrase in the first text box. You may use truncation and wildcard characters. Enter up to five rows of search terms, document sections, and connectors. Specify where the term should appear using the first drop down list. Choose from options such as Anywhere, In the headline, At the start, and more. Select a connector from the second drop down list to define how the term in this row will be linked to the term in the second row. Choose from options such as And, Or, Same sentence, and more. Repeat these steps until you have finished entering your terms. If you need more than three rows, click the More link to display two additional rows. Note: If you click the More link, add search terms in the two additional rows, and then click the Less link, the search terms you entered in the two hidden rows will not be used in your search. 2. Add Index Terms select any combination of Index Terms to add to your search from the Industry, Subject, or Region lists to make your searching more precise. Select up to ten items from any or all checkbox lists. Click the Exclude from Search checkbox beneath a list to exclude any results that match the Index Terms you selected in the list. The window that opens provides coverage type, language, content summary, file name, and a complete file list. 4. Incorporate a date restriction command in the Search Terms field and select All available dates in the first Specify Date drop down list, or Select a custom date restriction from the drop down list such as All available dates, Today, Date is, and more, and then select the appropriate dates. 5. You may browse the structure to view parent and subsidiary companies, select the companies that you would like to add to your search, view a company s corporate structure, and view basic information about each company Select a Change Index option such as All Terms, Company, Industry, Subject, and Geography from the drop down list. 2. Select to find index terms containing, starting with, or exactly matching your search terms from the Find Terms drop down list. 3. Enter a word or phrase to find the appropriate term to add to your search. Use connectors (AND, OR, AND NOT) to show the relationship between terms. 4. Click the Find button. 5. When the results are displayed, click the View Corporate Structure link. You can also click the icon to view basic information about a company. 6. Click the and icons to browse the corporate hierarchy. 7. Click Go Back to return to the results of your company name search. 8. Click the checkbox in front of a company name to select the companies that you would like to add to your search. 9. Click the View Selected button at any time to review a list of selected index terms. Here you can click the connector link before each term (AND, OR, AND NOT) to cycle between connectors, or click to remove an index term from the list. 10. Click the OK Add to Search button. 46 Terms and Connectors How Does Quicklaw Search for Information? Quicklaw: Matches the words in your search with the words contained in the source. Searches for exact matches only. It does not automatically search for synonyms. Is not case sensitive. It searches for either upper case or lower case letters. Does not require you to use accented characters in foreign language words (e.g., you can type e instead of é). Research Preparation Follow these steps to construct your search: 1. Identify the issue or subject to be researched. 2. Decide which source(s) you would like to search. 3. Choose words that might appear in the documents you wish to retrieve. 4. Identify synonyms and alternate spellings of the words. 5. Use connectors to link your words together in a logical order. Terms Terms are the basic units of a search. A term is a single character or group of characters, alphabetic or numeric, with a space on either side. A hyphen is treated as a space, so a hyphenated term is seen as two terms. A period is treated like a space except when: 1. The period is preceded and followed by a number (e.g., 99.9 is one term). 2. The period is preceded by a space and followed by a number (e.g.,.999 is one term). 3. The period is preceded by only one alphabetic character and followed (with no spaces in sequence) by any number of single letters, each of which is followed by a period (e.g., C.R.A. is one term; C. R. A. is three terms because of the spaces after the periods). Phrases Consecutive words are considered a phrase. You do not normally need to enclose them in quotation marks. 49 Connector Order and Priority Connectors operate in the following order of priority: 1. OR 2. /n, PRE/n (+n), NOT /n 3. /s 4. /p 5. /seg 6. NOT /seg 7. AND (&) 8. AND NOT If you use two or more of the same connector, they operate left to right. If the n (number) connectors have different numbers, the smallest number is operated on first. You cannot use the /p and /s connectors with a proximity connector like /5. Note: To change the connector priority, use brackets. Connectors inside brackets have priority over, or operate before, connectors outside brackets. Truncation and Wildcard Searches Truncation The truncation symbol! replaces any number of characters at the end of the word. Examples: neglig! finds negligent, negligence, negligible, etc. defam! finds defame, defamed, defaming, defamatory, defamation, etc. Wildcard The wildcard symbol * replaces a single character at any point in a word. It is particularly useful if you are unsure of the spelling of a particular word or name. You can also use multiple wildcards in a single word. Examples: advi*e finds both advise and advice F**st**n finds Feinstein, Fienstien, etc. Use multiple wildcards at the end of a word to find multiple endings. 50 Precision Search Commands In addition to connectors, there are several commands or sections you can use to add precision to your searching. Capitalization To specify that all search terms have capital letters (allcaps), no capital letters (nocaps), or one or more capital letters (caps), type the command followed by your search terms enclosed in brackets. Examples: To search for documents that mention acquired immune deficiency syndrome or AIDS, enter: acquired immun! OR allcaps (aids) To search for mentions of an aid, enter: nocaps (aid) To search for Aid as a title with the first letter capitalized, enter: caps (aid) Pluralization By default, the Singular and Plural box on the search form is checked, meaning that singular and plural forms of your terms are automatically searched. There may be times when you want only the plural or singular form of a term. Examples: To find documents that mention the name Steven Jobs, enter: steven /3 plural (job) To limit your search to the singular form and to search for an additional item such as job discrimination, enter: singular (job) /5 discriminat! Atleast To locate documents that contain an in depth discussion on a topic rather than just a mention, you can specify that a term or certain terms must appear at least a certain number of times in a document. Example: To find documents containing an in depth discussion of VAT (Value Added Tax), enter: atleast10 (vat) This search requires VAT to appear in every result at least 10 times. 51 Date Restrictions You may narrow your search to documents published on a specific day or within the date range you specify. The options are as follows: All available dates allows you to remove all date restrictions from your search. Today restricts your search to only results from the current day. Date is searches a specific day. Date is before searches all documents published on or before a specific date. Date is after searches all documents published on or after a specific date. Date is between specifies a date range. Select the date from which you wish to search in the first field and the date to which you wish to search in the second field. Select a pre defined date restriction Previous week, Previous month, Previous 3 months, Previous 6 months, Previous year, Previous 2 years, Previous 5 years, Previous 10 years, and Previous 20 years. Previous specifies all documents published in the previous n days, weeks, months, or years. Select the value and units of time (days, weeks, months, or years) across which you wish to search. 52 Source Directory A source is a collection of related documents (e.g., they may all be from a specific jurisdiction, court, tribunal, report series, or newsletter). Use the Source Directory to locate any of the sources available to you by selecting Quicklaw categories and sources in a similar way to navigating a file structure within Microsoft Windows Explorer. Accessing the Source Directory Here are the two main ways to access the Source Directory: 1. You may select only one group source or multiple single sources. 8. Click the View link to view all the sources you have selected before you continue (optional). 9. Combine selected sources by typing a name in the Name Selected Sources text box. This name will appear in the Select Sources list on the relevant search form. 56 Modifying Recent and Favourite Sources Recent and favourite sources appear in the Select Sources drop down list located on each search form. Remove or retain up to 50 recent sources or up to 100 favourite sources at a time. Click the Modify this list option at the bottom of the Select Sources list on any search form to access the Modify Recent Sources page. Favourite sources appear in red Click the checkbox next to a specific source to retain it as a favourite source; uncheck it to allow the source to be replaced by more recently used sources. 2. Click the Delete link next to a recent source, and then click the OK button to delete it from the list. The Delete link is disabled for favourite sources. Uncheck the box next to a favourite source to enable the Delete link. Not all sources can be deleted. 3. Combined sources appear with a plus sign. Click the Edit/Rename link to go to the Source Directory to rename or edit the contents of a combined source. Not all combined sources can be modified. 4. 57 Finding Specific Sources Use the Search for a Source sub tab when you know the specific source in which you want to search. Select to find sources by Keyword or Alphabet. Click the More Options button to view options such as Regions of Coverage, Publication Languages, and Frequency of Update. 3. 58 Results The Results page displays your search results and includes features that allow you to select viewing options, sort, filter, and narrow your search. View Formats You may change the results display by selecting one of the view formats from the View drop down list. Choose from List, List with keywords (available when searching cases only), and Search Terms in Context. List provides minimal information about your document (e.g., case name, citation, court level, and judgment date). This view is ideal for printing out a list of cases. List with keywords provides the same information as above, but with the addition of the keywords from the head note of the case (if available) Search Terms in Context displays your search terms with approximately 10 words on either side of you search terms. 59 Sorting Search Results You may wish to change the order in which your results are displayed. Sort options vary according to the type of documents in your results, but may include Publication Date and Relevance, amongst others. To change the order of the displayed documents, select a sort format from the Sort drop down list on the Results page. Jurisdiction results are grouped together by jurisdiction with the federal courts first (most recent judgment first), followed by the provinces in alphabetical order (with most recent judgment first in each group). Court results are grouped in order of court level, with the Supreme Court first, followed by the courts of appeal, and then the lower courts. Within each group the results are ordered by most recent first. Relevance documents are displayed in order of relevance. The case with the highest frequency of your search terms is displayed first. Newest First results are ordered in reverse chronological order with the newest document first. Oldest First results are ordered in chronological order with the oldest document first. Source Order results are ordered by the Quicklaw source searched, with the Supreme Court first, followed by the Federal Court and other federal courts, and then the provincial sources in alphabetical order. 60 Navigating Search Results There are two ways to navigate through your results list: 1. At the top of the page, click the buttons to go to the previous and next pages of your results. Click to view the previous document/page results Click to view the next document/page of results 2. At the bottom of the page, click the buttons to skip through larger sets of results at one time. Click to view the first page of your results Click to view the previous page of your results Click to view the next page of your results Click to view the last page of your results. To see the full text of a document, click the document name in either List or Search Terms in Context view. Once in the full text view of a document, use the Hits navigation feature located at the bottom right of the screen to find quickly occurrences of your search terms in a document. 62 Result Groups The Result Groups form displays specific groups of documents within your search results. For example, you can view a list of results from a specific source type only (e.g., Newspapers) or from a particular source. The available Result Groups vary depending on the content of your search results. Court includes categories by court, such as Court of Appeal, Supreme Court of Canada. Source Type includes categories such as cases, tribunal decisions, journals, commentary, forms and precedents, and services. Jurisdiction includes categories by jurisdiction such as provincial or federal. Legislation Type includes categories such as statutes, regulations, and bills. Source (then TOC) includes categories by source first, such as Copyright Law, then further structured by that sourceʹs table of contents. Close this Pane selecting this option from the Result Groups drop down list closes the Result Groups pane. When you search in a combined source, you can use result groups to display just the results from a specific source. Result groups are particularly helpful when your search retrieves a large number of documents. 1. To view your results grouped by a category, select a Result Groups option from the drop down list. 2. Click a category name to view that list of results in the results page (right pane). Each category or sub category provides a filtered view of the original results list so that only those results within that category or sub category are displayed in the results page. Note: To return to the original results list, click All Results at the top of the Result Groups form. To change the width of the Result Groups form, click and drag the border between the form and the results list. 56 Customer Support: service@lexisnexis.ca

63 Narrowing Search Results Use the Narrow Search feature to search for a more specific word or words within your original search results. The results of a narrowed search are a subset of your original results. When viewing your results, the Narrow Search feature appears in the top right of the results form. Enter your search terms into the Narrow Search field and then click Go. This will search through your results for the additional search terms and will only return results containing these terms. Note: In your Preferences, you may choose whether you would like all terms highlighted or just new terms highlighted in documents when you are narrowing your search. You can use connectors in the Narrow Search feature; however, you cannot begin a narrow search with connectors. Note: If you are viewing a specific result group, the narrow search will run on the full results list, not just the group you are currently viewing. Customer Support: service@lexisnexis.ca 57

64 Next Steps Select an option from the Next Steps drop down list and then click Go to continue working with your results. The options that appear are dependent on the way you arrived at your results and the content you are viewing. Choose from the following Next Steps options: Modify Search click to modify your original search. New Search click to enter a new search. Youʹll return to the same search form you used to enter this search. Save Search click to save this search (including search terms, date range, and source) under the History & Alerts tab. Create Alert click to set up this search to run on a schedule that you specify and deliver results to you automatically. Case Digests (case law only) to see a summary of a full text decision; select this option from the Next Steps menu. 65 Tagging Documents You can select or tag specific documents in your results for print, ing, or downloading To tag a single document, select the box to the left of the document s title. 2. To tag all documents on a particular page of a results list, select the box on the far left of the grey bar above the results. 3. On the delivery form that appears, you will see the document numbers you have tagged displayed in the Document Range box. 4. 66 History & Alerts The History & Alerts tab provides a single location in which to manage all of your past research activities, including recent searches, recently viewed documents, saved searches, alerts, and a usage log. History & Alerts Sub Tabs History displays your recent searches and recently viewed documents. Each search you have run over the past seven days is listed (up to a limit of 100 searches). You may Run, Modify, Delete Selection, or schedule a recent search as an Alert. Each document you view is automatically archived in the history for 48 hours so you may retrieve it again. 2. Saved Searches displays a list of your previously saved searches. You can save a search by clicking the Save This Search link on any search form or by selecting Save Search from the Next Steps drop down list on the Results page. You may Run, Modify, Delete Selection, or schedule a saved search as an Alert. 3. Alerts displays a list of your legal updates and scheduled searches. To set up a legal update, click Create New Update on the Legal Updates form and follow the step by step process. To set up a scheduled search, click the Save This Search link on any search form and select the Save as an Alert option. 67 History The History feature automatically archives recent searches and recently viewed documents. Recent Searches Each search is automatically archived for seven days. From the History tab, click the Recent Searches sub tab to perform the following: 1. Delete a Recent Search click the checkbox next to a recent search, then click the Delete Selection(s) link. A confirmation screen appears. Click OK. 2. Re run a Recent Search click the Run link next to the appropriate search. The search will run and display the results. 3. Modify a Recent Search click the Modify link next to the appropriate search. The original search form is displayed, allowing you to modify the search parameters. 4. Schedule as Alert click the Alert link next to a search to save a recent search as an alert Recent Documents Viewed Each of your recently viewed documents is automatically archived for 48 hours. From the History tab, click the Recent Documents Viewed sub tab. 1. Click the name of a recent document to view it again. If the document is available in other formats (such as PDF or LexisNexis HotDocs ), icons appear in the format column. 68 Saved Searches Save a search and run it manually later. Saved searches remain until you delete them. You can save a search from the search page or when you are viewing your results. Saving a Search From the Search Page complete the search form, then click the Save This Search link, or From the Results Page select the Save Search option from the Next Steps dropdown list. From there: 1. Enter a name for your saved search (up to 255 characters). 2. You may also change the Client ID associated with your search by clicking the Change Client ID link. 3. Click the Save as an Alert checkbox to schedule your search if you wish to run automatically. This turns your saved search into an alert. 4. 69 Managing Saved Searches From the History & Alerts tab, click the Saved Searches sub tab to run, modify, or schedule a saved search as an alert Click the Run link next to the appropriate search. 70 Alerts Alerts come in two forms: Legal Updates and Scheduled Searches. You may save a search as a scheduled search that runs at pre defined intervals. You may also set up a legal update, which is a periodic search on specific legal topics. To view your current list of scheduled searches and legal updates, click the History & Alerts tab, then click the Alerts sub tab. Creating a Legal Update 1. From the History & Alerts tab, click the Alerts sub tab, then click the Legal Updates tertiary tab. 2. Click the Create New Update link. Note: If this is your first time creating a legal update, click the Legal Update Wizard link and follow the step by step process. 3. 71 Managing Legal Updates Search Archive Click the Search Archive link and use the Search Archive form to search your Legal Update results from the last 90 days. Modify a Legal Update click the Modify link next to the legal update, change the settings in the step by step form that appears, and then click Save. 4. Click the Alert link next to a recent search, or From the Saved Searches sub tab click the Alert link next to a saved search. From there: 1. Name the alert (up to 255 characters) in the Save As field. 2. Select how often and at what time you would like to run the alert. 3. Select your Delivery Options. Enter an address to specify where you would like the results to be sent, or chose to view the results online only. 4. 74 Managing Scheduled Searches Click the History & Alerts tab, then click the Alerts sub tab. Click the Scheduled Search tertiary tab to perform the following: 1. Manually Run an Alert click the Run Now link next to an alert. 2. Change the Schedule for a Scheduled Search under the Schedule column, click the Change link next to a search. The Change Schedule window is displayed. Change the schedule, and then click Save. 3. Modify the Search Criteria for a Scheduled Search click the Modify link next to a search, make your changes, click Test Search, and then click Save. 4. Delete a Scheduled Search click the checkbox next to an alert, then click the Delete Selection(s) link. A confirmation screen appears. Click OK to delete the alert. 5. Search Archive Click the Search Archive link and use the Search Archive form to search your Scheduled Search results from the last 90 days. 75 Document Delivery You may deliver documents from your search results in any of the following ways: Print to an attached printer Send to up to three recipients (including yourself) Download a document to your computer or network To deliver your documents: 1. Submit your search request. 2. Review the documents in your search results. 3. Select one or more checkboxes next to your results to choose which documents you would like to deliver. Note: If your search results return only one document, the checkboxes will not appear. Simply click the delivery icon you wish to use. 4. Click the icon for the delivery method you would like to use. 76 Printing Documents 1. Click the Print icon from any search results page to open the Print Documents window. 2. Add a Brief Note (up to 960 characters) to be included on the cover page of your printout. If you enter a note in this field, the text will appear on a cover page even if you donʹt select the Cover Page option under Page Options. 3. Select the Document View. Choose to print the Full Text of selected documents, or choose to print the List, List with Keywords, or Search Terms in Context Note: Select Full from the Document View drop down list to receive the full text document. 4. Select the Document Range. Choose from All Documents, Tagged Documents, or Select Items. 5. Select Page Options such as a Cover Page, End Page, and Each Document on a New Page (e.g., select the Cover Page option to include a cover page with your document set). A cover page includes information such as the time of request, source searched, Client ID, and more. 6. Select Font Options including type (Arial, Times New Roman, or Courier), and format (Search Terms in Bold Type or Search Terms Underlined). 7. Click the Print button to deliver your results. 79 Customization Start Page You can specify which search form should first be displayed when you sign in to Quicklaw. For example, if your research consists primarily of tribunal searches, you may wish to have the Tribunal Cases search form displayed as your start page To designate a search form as your start page, display the search form, and then click the Make This My Start Page link in the upper right hand corner of the form. 2. 80 Client ID You can enter a Client ID to associate with your online activities. This name or number is used for identification and billing purposes. Depending on your firm set up, entering a Client ID may be mandatory. To remove this restriction, contact your office s Quicklaw administrator, or contact Customer Support at or service@lexisnexis.ca. 1. Click the Client link in the Navigation Bar. If you have never entered a Client ID previously, the link will read as None In the screen that appears, select the Client ID that you would like to associate with the research you are conducting. You can continue working with the Current ID, select a Client ID that you have used before from the Previous dropdown list, or you can create a new Client ID in the Enter New Client ID field. 3. 81 Preferences You can set a variety of features in Quicklaw by changing your preferences. Preferences consist of two sub tabs: General and Search and Results. To change your preferences, click the Preferences link on the Navigation Bar. General Preferences Tab The features you can set under the General settings tab include: 1. Start Page select a search form from the drop down list to set as your start page. 2. Password click the Change my security settings link to change your password. 3. Source Directory select this option to hide source subsets in the Source Directory. 4. Entering a Client ID select this option to have Quicklaw remember the lastused Client ID between research sessions. 5. Security select this option to use a secure connection (SSL) for the entire session. This change will take effect the next time you sign in. Note: Using a secure connection for the entire session is not normally required and will slow down your session. 6. Information about LexisNexis Products and Services select this option to receive LexisNexis marketing information. 7. 82 Search and Results Preferences Tab The features you can set under the Search and Results tab include: 1. Displaying Search Results set the number of results to display per page. Choose from 10, 25, 50, or 100. You may also set the default display format to List, Search Terms in Context, Hits in Context, or Full Document. 2. Results Classification select this option to open the Result Groups panel by default. 3. Document Display select a document display option from the Publication Tree Format drop down list. Choose from Full or Truncated. You may also choose to scroll to the first term hit in Full document view, show all citator symbols, and highlight only narrow search terms in narrow search results. Scroll to first term hit when you display the full text of your document, Quicklaw will automatically scroll down the page to the first occurrence of your search terms. Show all citator symbols keep this box checked to always display the QuickCITE citator symbol for your case whenever available. In narrow search results check this box to highlight only the terms you used to narrow your search.
