1 China Telecom Corporation Limited Shanghai Branch Terms and Conditions of Promotion for E-Surfing 4G Bricks Package (2015/D) SHDX/F/JL/F/0/SC I. Promotion Campaign: II. Promotion Period: III. Promotion Target: E-Surfing 4G Bricks Package September 25 to December 31, 2015 Individuals, Government Organizations and Corporate customers IV. Promotion Product: China Telecom Corporation Limited Shanghai Branch Postpaid and real time Pre-paid CDMA Mobile Service (hereinafter referred to as cell phone ) and Mobile Valueadded Services V. Promotion Contents: i. Contents of Basic Package: E-Surfing 4G Bricks Package is a 4G package which is combined with Voice Module Data Module and Optional Package. Voice Module and Data Module are divided to 8 levels. Customers are allowed to select one level of the service from Voice Module and Data Module respectively to form the basic monthly fee of their package. Voice Module Basic monthly Fee (CNY/No.) Domestic airtime (minute/month) Data Module Basic monthly rental (CNY/ No.) Additional charge on top of Package: Domestic Airtime (CNY/Minute) 0.15/Minute Domestic Data Usage (per Month) Domestic Incoming Call Free of Charge Additional charge on top of Package: Domestic Data Usage Complimentary offer Caller ID 189 mailbox MB Additional charge of CNY 0.3/MB is incurred MB for usage below 100MB.

While the data usage out of package exceeds 500MB, it will also be charged according to the principle mentioned above (CNY 30/ 500MB) and by this analogy. ii. Manual of the Basic Package: 1. The domestic call in this Terms and Conditions includes local call, domestic long-distance and direct domestic call with roaming, while 17909, 11808, Family Long-distance calls, 800 calls and voice information are not included in the package above. Airtime is counted on a minute-by-minute basis. 2. Taiwan, Hong Kong and Macau are not covered in the service area for all domestic services. 3. Mobile devices data usage is only available within mainland China, regardless of connection methods such as 4G, 3G or 2G Internet, while WLAN (Wi-Fi) is excluded. 4. Only one CDMA number is eligible for subscribing the Basic Package, while Voice Module and Data Module are compulsory. Duplicate subscription on each level of module will not be entertained. 5. This promotion offer is a monthly Package. Service(s) in the Package is only available in the respective service month. 6. Any changes or termination of the service will be effective upon the next service month. 7. Designated data usage package(s) and optional package(s) can be combined with this promotion offer. For details, please refer to China Telecom Corporation Limited Shanghai Branch Terms and Conditions of Promotion for E-Surfing 4G Designated Data Usage Package and China Telecom Corporation Limited Shanghai Branch Terms and Conditions of Promotion for E-Surfing 4G Application Optional Package (the Terms and Conditions of optional packages at the time of your service subscription shall prevail). 8. The mobile Internet access is compatible with 4G, 3G and 2G network access. No extra payment shall be incurred if the domestic data usage via mobile device(s) does not exceed the maximum limit of the package. For domestic data usage on top of package limit generated below 100MB, CNY 0.3/MB offset charge will be incurred; domestic data usage generated within 100MB-500MB will be free of charge, while domestic data usage generated beyond 500MB will be charged in accordance with the above rule (i.e. every 500MB exceeded package limit will be charged CNY 30), and by this analogy. Minimum charging unit is CNY / KB. Usage under 1KB will be rounded up to the nearest 1KB and charges under CNY 0.01 will be rounded up to the nearest CNY For cell phones with call forwarding function activated, airtime consumed in call forwarding will be counted as domestic airtime in the Package. The
3 exceeded airtime consumed by call forwarding is charged in accordance with standard charging scheme. 10. The user-id of WIFI Internet access is the number(s) of the cell phone(s) in the group. The password will be sent through SMS for secure login to China Telecom WLAN network. Fee will be charged on the basis of the standard service charge. 11. All customers of the above Packages are entitled to a 189 mailbox for communication, with user-id identical to the phone number of the main SIM card. 189 mailbox provides WEB mailbox and mobile mailbox functions. 12. Basic monthly fee of the package is effective on the first calendar day of the next service month. Between the service completion and the package basic charge becomes effective: For new customers, the payment of the first month is calculated with the formula: basic monthly fee of the first month = (basic monthly fee/number of calendar day of that month) * number of days among the first day of service to the last calendar day of the month. The level of discount is exercised in proportion to the number of calendar days in the first month of service and calculated with round up basis (the nearest KB for network traffic, the nearest minute for domestic airtime and Wi-Fi hours). Charges for domestic incoming calls, 189 mailbox, caller ID service and all one-off charges are free of charge. Every 500MB data usage on top of package limit will be charged by CNY 30, while other unspecified charges are calculated on the basis of current standard charging scheme. For existing customers subscribing the service if under the original package charges incurred in the current month are due in the next month, then the charges of the original package will continue to apply in the month of subscription change, until the standard charges of the package of this promotional offer become effective. Value added services that are activated during this time (which are not included in the original package) are charged at the standard rates for the relevant services. 13. All services and modes of cell phone Internet access and Wi-Fi Internet access pinpointed in our Terms and Conditions are activated alongside the capability of the mobile devices. 14. Domestic data usage of the mobile device is capped at CNY 600 per month, including the 4G/3G/2G services domestic charge beyond the Package fee, while the basic monthly fee, SMS/MMS, voice, WLAN, other value-adding service charge and the function fees of all the designated data packages are not included. Within the CNY 600 limit, customers are eligible to use 15GB domestic data usage at most (not including data usage from designated data usage package(s)). 4G/3G/2G/WLAN Internet access will be discontinued automatically when the maximum data usage is exceeded. Any value-adding services provided for Internet access will not be available upon service termination. Wireless Internet access will be reactivated upon the next service month. If customers want to reactivate the service in the month of service discontinuation, please visit our sales outlets or call Additional charge of CNY 0.3/ MB is incurred for usage below 100MB. All additional charge will be waived for usage in between 100MB to 500MB. For usage over package limit an additional charge of CNY 30/ 500MB will be incurred, and by this analogy. Data usage will be calculated on a pay-asyou-go basis of CNY /KB (usage under 1KB will be rounded up to the
4 nearest 1KB and charges under CNY 0.01 will be rounded up to the nearest CNY 0.01). Maximum usage will be restored in the next service month. 15. All charges regarding our service not mentioned in our Terms and Conditions are charged in accordance with current standard charging scheme. 16. For real time pre-paid customers, a deposit is required to be settled upon service activation. Deposit ranges in between CNY 100, CNY 200, CNY 300, CNY 400, CNY 500 and CNY 600. The amount of deposit shall be tantamount to or higher than basic monthly service fee. The deposit will be refunded within 24 hours upon service activation. The deposit is not applicable to CP/SP. It is neither cashable nor transferable. VI. Points-to-note for Customers: 6.1 Customers who joined E-Surfing 4G Bricks Package are eligible to change the level in each package. Any changes in the Package are validated on the first day of the next service month after service activation. 6.2 The promotion fee of this Package is validated on the first day of the next service month after validation. Customers are eligible to change or terminate service Package(s) (including dissembling of mobile devices) by following respective procedures, while promotion offers (include optional packages) is terminated and customers are eligible to join other valid E-Surfing 4G Packages available. Any changes in the Package are validated on the first day of the next service month after validation. If the services of this package cannot be provided, China Telecom Corporation Limited Shanghai Branch is obligatory to inform customer of the cancellation of promotion offer in one month s advance notice. 6.3 If the customer has already joined other China Telecom Corporation Limited Shanghai Branch promotion packages which include the above optional package services with ongoing validity, the subscription will be deemed invalid by China Telecom Corporation Limited Shanghai Branch. 6.4 Customers with outstanding service charges are only eligible upon clearance. 6.5 Customers benefit from their voluntary use of CDMA UIM card provided by China Telecom Corporation Limited Shanghai Branch. During the service period, if the UIM card is lost, stolen or damaged caused by misuse, customers can apply for temporary suspension, reissue or replacement with additional charges. Reissue and replacement of card is charged with the standard charging scheme. 6.6 China Telecom Corporation Limited Shanghai Branch is not held responsible for any CDMA irregularity caused by terminal devices and will not be liable to any reimbursement in the form of service fee reduction. 6.7 Postpaid service customers should settle service charge on time. A 0.3% penalty fee will be incurred each day if customers fail to comply. If customers have not settled service payment before payment deadline, China Telecom Corporation Limited Shanghai Branch reserves the right to terminate one of the services and customers are only eligible to receive domestic SMS and calls. If customers have not settled service payment after 5 days after partial service termination, China Telecom Corporation Limited Shanghai Branch reserves the right to terminate all the services (double termination), while monthly service fee in respective month will be fully incurred. An extra 0.3% penalty fee will be incurred each day if customers fail to comply before payment deadline. During service termination period, customers are eligible to top up, settle
5 payment and report lost. Other service application is not entertained. China Telecom Corporation Limited Shanghai Branch implements credit control measures for new postpaid service subscription for six months commencing from the second month of service subscription: When the outstanding amount reached the credit limit of CNY 2000, customers should settle the payment as soon as possible for service continuation. China Telecom Corporation Limited Shanghai Branch reserves the right to terminate the service. During the period of service suspension, service charge will be incurred continuously on monthly basis. If the service is suspended for more than 90 days, China Telecom Corporation Limited Shanghai Branch reserves the right to terminate the service (including service account termination). 6.8 With the activation of service, customers should maintain sufficient account balance. Account balance on the 1 st day of every service month should be tantamount to or higher than basic monthly service fee. Negative account balance may result in temporary suspension of service or termination of service account by China Telecom Corporation Limited Shanghai Branch. Customers should settle outstanding service charge via top-up procedure (note: top up procedure can be completed via top-up cards available from China Telecom Corporation Limited Shanghai Branch or through our sales representatives in sales outlet). Value restoration will first settle outstanding payment. With sufficient account balance, service will be reactivated within 24 hours by China Telecom Corporation Limited Shanghai Branch. Suspended service can only be reactivated through top up procedures. If service suspension exceeds 90 days, China Telecom Corporation Limited Shanghai Branch reserves the right to terminate service account. 6.9During the validity period of service, any change of service plan, transfer of account, suspension of service, or termination of service will be regarded as withdrawal of this campaign due to personal reasons. The package (including optional packages) will be terminated. 6.10Mobile Internet access may have unstable connection speed or failure in connection in some locations. Internet access while roaming depends on the network coverage of respective locations. Your consideration on the failure in connection while roaming is highly appreciated Individual customer with one ID is eligible to transact maximum 5 singleproduct packages and mobile convergence packages After activating service with postpaid monthly package, package fee of the first service month and one-time service charges will be incurred in the next service month. Basic monthly fee will be charged in the third month. VII. China Telecom Corporation Limited Shanghai Branch provides service in accordance with Terms and Conditions on Telecommunications of the People's Republic of China. Legal responsibility is incurred in case of breach or violation. VIII. The above Terms and Conditions are an appendix of China Telecom Corporation Limited Shanghai Branch Services Agreement, China Telecom Corporation Limited Shanghai Branch Mobile Phone Network Agreement If the above agreements conflict with the Terms and
6 Disclaimer Conditions, the Terms and Conditions shall apply and prevail. China Telecom Corporation Limited Shanghai Branch Customer Registration Form is a component of the Terms and Conditions. The Terms and Conditions will be effective upon authorization by customers signature of the registration form. Signature of the registration form will be regarded as confirmation and acknowledgement of the Terms and Conditions and the above agreements.
