2 Basic Assessment for the Amendment of the KEW Foundries Atmospheric Emission Licence Application in Kimberly, Northern Cape Province (DENC Ref: Still To Be Issued) Notice is hereby given, in terms of the National Environmental Management Act, (Act no. 107 of 1998) (NEMA), the NEMA Environmental Impact Assessment (EIA) Regulations 2014 (published in Government Notice R. 982, 4 December 2014) and Section 37 of the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004) (NEM:AQA), of Kimberly Engineering Works (KEW) Foundries intent to carry out activities that require Environmental Authorisation and an Atmospheric Emission Licence (AEL) amendment/variation: Installation and operation of two additional 3 tonne furnaces for Casting of cast iron and Spheroidal Graphite (SG) products. Basic Assessment Process The proposed project triggers an activity from Listing Notice 1 (published in Government Notice No. R.983) of EIA regulations of Accordingly, a Basic Assessment Process as defined in the NEMA EIA Regulations (2014) must be followed. Atmospheric Emission Licence Application Process Variation/Amendment The proposed project triggers a Category 4 Subcategory 4.10 (Foundries) listed activity as published in terms of section 21 of the NEM:AQA. KEW Foundries is therefore required to undertake an AEL variation/amendment process in terms of Section 38(2) read with Section 46(3) of NEM:AQA. In terms of Section 38(2) reading with Section 46(3) of NEM:AQA, a Basic Assessment Process as defined in the NEMA EIA Regulations (2014) must be conducted prior to AEL variation/amendment process and/or submission. 4 Basiese Evalueringsproses vir die Wysiging van KEW Foundries se Atmosferiese Vrystellingslisensie Aansoek, Kimberley, Noord-Kaap Provinsie (DONB Verwysingsnommer: Nog nie uitgereik nie) Kennis geskied hiermee in terme van die Wet op Nasionale Omgewingsbestuur (Wet no. 107 van 1998) (NEMA), die NEMA Omgewingsinvloedbepaling (OIB) Regulasies 2014 (gepubliseer in Staatskoerant R. 982, 4 Desember 2014) en Artikel 37 van die Wet op Nasionale Omgewingsbestuur: Wet op Luggehalte, 2004 (Wet No. 39 van 2004) (NEM:AQA), van Kimberl ey Engineering Works ( KEW) Foundries se voorneme om die ondergenoemde aktiwiteite wat n Omgewingsmagtiging en n Atmosferiese Vrystellingslisensie (AVL) wysiging/verandering benodig, uit te voer: Installering en bedryf van twee vervangings van 3 ton oonde vir die Giet van Gietyster en Sferoïdaal Graftiet (SG) produkte. Basiese Evalueringsproses Die voorgestelde projek sluit 'n aktiwiteit van Lyskennisgewing 1 (gepubliseer in Staatskoerant No. R.983) van OIB Regulasies van 2014 in. Gevolglik moet 'n Basiese Evalueringsproses, soos omskryf in die NEMA se OIB Regulasies 2014, gevolg word. Atmosferiese Vrystellingslisensie Aansoekproses - Wysiging/Verandering Die voorgestelde projek val in 'n Kategorie 4, Subkategorie 4.10 (Foundries (gietery)) gelyste aktiwiteit soos gepubliseer in terme van Artikel 21 van die NEM:AQA. KEW Foundries moet dus om 'n AVL wysiging- /veranderingsproses onderneem in terme van Artikel 38(2) saamgelees met Artikel 46(3) van die NEM:AQA. In terme van Artikel 38(2) gelees met Artikel 46(3) van die NEM:AQA, 'n Basiese Evalueringsproses, soos omskryf in die NEMA se OIE Regulasies 2014, moet gedoen word alvorens die AVL wysiging/verandering voorlegging gedoen word. KEW Foundries has an AEL for the current operations on site, since 01 April They are currently planning to replace two existing 3 tonne furnaces in their operations. An amendment of the AEL is required to reflect the increased melting capacity that results from replacement of two existing 3 tonne furnaces. The proposed project is located at ERF in Kimberley, within the Sol Plaatje Local Municipality. 17 Basic Assessment (BA) and Water Use License Application (WULA) for the proposed upgrading of the 66kV Network to 132kV Network in the Hotazel, Kuruman and Kathu areas, Northern Cape Province DEA Reference No.: 14/12/16/3/3/1/1376 Notice is hereby given, in terms of the National Environmental Management Act, (107 of 1998) (NEMA), the NEMA Environmental Impact Assessment (EIA) Regulations 2010 (published in Government Notice R. 543, 18 June 2010), and in terms of Section 21 of the National Water Act (36 of 1998) (NWA) of Eskom Holdings SOC Ltd s intent to carry out the following activities that require Environmental Authorisation: Construction of a new 132kV network between the Hotazel Substation and Sekgame Switching Station (near Kathu), intended to supply the existing Eldoret, Riries, Mothibistat. Basic Assessment Process The proposed project triggers activities from Listing Notice 1 (published in Government Notice No. R.544 (2010) as well as Listing Notice 3 (published in Government Notice No. R.546 (2010)). Accordingly a Basic Assessment Process as defined in the NEMA EIA Regulations (2010) must be followed. Water Use License Application The proposed project will also trigger Water Uses listed in Section 21 of the NWA (1998) that require licensing. Accordingly a Water Use License Application (WULA) will be submitted to the Department of Water Affairs. The WULA process will run concurrently with the Basic Assessment Process and will include a single integrated Public Participation Process.
