2 ii laporan tahunan 2011 laporan tahunan Kemudahan dan Aktiviti Nuklear Malaysia yang Selamat Sejak 26 tahun yang lalu, Lembaga Perlesenan Tenaga Atom (AELB) telah mengawalselia sektor nuklear negara dan terus memperkukuhkan undang-undang tenaga atom, peraturan dan syarat-syarat perlesenan, dan juga memastikan pematuhan oleh pemegang-pemegang lesen. Kami menyelia penggunaan tenaga dan bahanbahan nuklear untuk melindungi kesihatan, keselamatan dan sekuriti rakyat Malaysia dan alam sekitar negara serta membantu mengemudi pelaksanaan komitmen antarabangsa Malaysia mengenai penggunaan tenaga nuklear untuk tujuan aman. Sektor nuklear negara kita mempunyai rekod keselamatan yang cemerlang, dan kemudahan nuklear kita adalah antara yang paling selamat dan terjamin di rantau ini. Kejayaan ini sebahagian besarnya disebabkan oleh pegangan yang telah kami ambil iaitu tidak bertolak ansur dalam soal keselamatan rakyat Malaysia dan negara keseluruhannya. Kami juga sentiasa terus mendukung penyataan Visi dan Misi kami: Visi Sentiasa relevan sebagai sebuah badan penguatkuasa yang berwibawa di dalam keselamatan, sekuriti sinaran dan nuklear serta kawalgunaannya untuk penggunaan secara aman bagi pembangunan nasional yang mampan. Misi Menggalakkan budaya inovasi bagi memastikan penggunaan teknologi nuklear dan sinaran adalah selamat dan aman. Keselamatan adalah Keutamaan Kami Kami membantu melindungi nyawa rakyat Malaysia dan memastikan negara tetap SELAMAT, TERJAMIN dan TERKAWAL. Kami tidak akan bertolak ansur berkenaan dengan keselamatan dan sekuriti negara. Kami mengamal sikap penuh ketelusan dalam mengawalselia penggunaan teknologi nuklear dan sinaran untuk melindungi: Kesihatan rakyat Malaysia Keselamatan dan sekuriti negara Alam sekitar Adalah keutamaan kami untuk memastikan penggunaan selamat teknologi nuklear dan atom dalam pelbagai bidang seperti: Perubatan Imbasan sekuriti Pertanian dan pemakanan Produk konsumer Aplikasi perindustriaan Perlindungan alam sekitar Pengurusan sisa nuklear Penyelidikan sains Kami komited dalam memastikan bahawa Malaysia akan terus menggunakan teknologi nuklear untuk TUJUAN AMAN semata-mata. Justeru, kami bersikap telus dalam menjalankan aktiviti-aktiviti kami. Ketelusan ini terbukti dalam cara kami mematuhi konvensyen, standard dan nasihat pakar antarabangsa serta melalui hubungan kami yang kukuh dengan International Atomic Energy Agency (IAEA), Asian Nuclear Safety Network (ANSN) dan rakan-rakan kerja sejagat yang lain yang memperkasakan lagi komitmen kami untuk menyumbang kepada KEAMANAN DAN KESELAMATAN ANTARABANGSA.

4 4 laporan tahunan 2011 laporan tahunan JABATAN AELB Bertapak Kukuh Di Seluruh Negara AELB adalah sebuah jabatan di bawah naungan Kementerian Sains, Teknologi dan Inovasi (MOSTI). Sejak 26 tahun yang lalu, AELB telah memainkan peranan yang penting dalam memelihara keselamatan dan sekuriti negara melalui penguatkuasaan, kawalgunaan dan kawalan serta memastikan keberkesanan aktiviti tenaga atom negara. Lokasi-lokasi AELB di SEMENANJUNG MALAYSIA dan juga di SABAH dan SARAWAK membantu peranan kami dalam memastikan SEKURITI dan KESELAMATAN nuklear di seluruh negara. Ibu Pejabat AELB terletak di Dengkil, Selangor dan disokong oleh empat Cawangan AELB iaitu di Cawangan Utara, Cawangan Selatan, Cawangan Malaysia Timur dan Cawangan Pantai Timur dan tujuh stesen pemantauan (ERMS) di seluruh negara. AELB memantau keradioaktifan dalam persekitaran dengan menggunakan Sistem Pengesanan Bahan Nuklear dan Radioaktif Kebangsaan dan Sistem Pemantauan Radiologi Persekitaran (ERMS). Pemantauan dijalankan 24 jam/7 hari seminggu untuk mendapatkan maklum balas masa nyata (real time) yang perlu demi perlindungan sekuriti nasional. 5 6 laporan tahunan 2011 laporan tahunan Sebuah Badan Penguatkuasa Yang Berwibawa AELB bekerjasama dengan pelbagai Kementerian, jabatan dan agensi Kerajaan yang lain untuk memastikan bahawa aktiviti berkaitan nuklear serta bahan-bahan dan kemudahan tenaga nuklear digunakan secara selamat dan terjamin di Malaysia. AELB juga bekerjasama dengan banyak organisasi antarabangsa dan domestik, termasuk pelbagai badan penguatkuasa untuk memenuhi mandat yang diberi kepada kami. Ditubuhkan pada 1 Februari 1985, AELB membolehkan Kerajaan Malaysia mengawal, memeriksa dan menguatkuasa aktiviti tenaga atom negara dengan berkesan. Aktiviti tersebut meningkat dengan pesat pada tahun-tahun selepas 1968 apabila Kerajaan Malaysia meluluskan Akta Bahan-bahan Radioaktif 1968 untuk mengawal penggunaan bahan radioaktif. Pada bulan April 1984, Akta Perlesenan Tenaga Atom (Akta 304) telah dirangka dan diluluskan oleh Parlimen. Ini diikuti dengan penubuhan AELB setahun kemudian. Pada mulanya AELB diletakkan di bawah pengawasan Jabatan Perdana Menteri, dan berfungsi mengikut Seksyen 3 dibawah Akta 304 dan berkhidmat sebagai agensi yang menguatkuasa Akta 304 (aktiviti bukan perubatan). Di bawah akta yang sama, penggunaan tenaga atom untuk tujuan perubatan telah dipertanggungjawabkan kepada Kementerian Kesihatan. Pada 27 Oktober 1990, AELB telah dipindahkan daripada Jabatan Perdana Menteri ke MOSTI. Akta 304 telah dinilai semula bagi memastikan kerelevanan dan keberkesanannya dalam memenuhi keperluan semasa. Tahun 2011 menyaksikan AELB terus berkhidmat dengan cemerlang berdasarkan fungsi, peranan dan komitmennya yang jelas, seperti berikut: Fungsi Memberi nasihat kepada Menteri dan Kerajaan Malaysia atas perkara berkenaan dengan Akta Perlesenan Tenaga Atom 1984 dan perkembangan berkaitan terutamanya mengenai implikasi perkembangan tersebut bagi Malaysia. Mengawal dan mengawasi pengeluaran dan penggunaan tenaga atom dan perkara yang berkaitan dengannya. Menubuh, menyenggara dan membangunkan kerjasama saintifik dan teknikal dengan manamana badan, institusi atau organisasi lain berhubungan dengan perkara bersangkutan dengan nuklear atau tenaga atom sebagaimana difikirkan sesuai oleh Lembaga bagi maksudmaksud yang terkandung dalam Akta Perlesenan Tenaga Atom Melaksana sepertimana diarahkan sedemikian oleh Kerajaan Malaysia, bagi memenuhi obligasi yang timbul daripada perjanjian, konvensyen atau triti berhubungan dengan perkara-perkara nuklear atau tenaga atom yang mana Malaysia menjadi satu pihak jika perjanjian, konvensyen atau triti itu ada hubungan dengan maksudmaksud yang terkandung dalam Akta Perlesenan Tenaga Atom Mengerjakan perkara lain yang timbul atau berbangkit daripada fungsi-fungsi Lembaga AELB di bawah Akta Perlesenan Tenaga Atom 1984 yang tidak berlawanan dengan n maksudmaksud yang terkandung dalam Akta ini, sama ada diarahkan oleh Menteri atau tidak. Peranan Memastikan keberkesanan fungsi penguatkuasaan AELB. Mencapai tahap keberkesanan dan ketelusan yang tinggi dalam operasi AELB. Menarik dan mengekalkan kakitangan cemerlang yang mempunyai pengetahuan, kemahiran dan kecekapan yang diperlukan. Melaksanakan aktiviti AELB dengan tekun, termasuk seperti berikut: - Menyediakan peraturan, kod amali, standard, panduan dan nasihat. - Melesenkan penggunaan tenaga atom. - Melakukan pemeriksaan serta penguatkuasaan. - Menjalankan penyelidikan perundangan. - Meneguhkan kerjasama saintifik dan memenuhi obligasi di peringkat antarabangsa. - Menangani situasi kecemasan yang berkaitan dengan tenaga atom dan bahan nuklear. - Membangunkan budaya keselamatan. Komitmen Melindungi Sekuriti, Keselamatan, Kesihatan dan Alam Sekitar Dengan terbentuknya langkah-langkah dan keperluan peraturan SEKURITI berkaitan dengan bahan dan kemudahan nuklear, AELB memastikan dengan berkesan bahawa semua pemegang lesen beroperasi secara selamat setiap masa agar dapat melindungi KESELAMATAN semua. AELB juga memastikan peralatan sinaran untuk tujuan perubatan dan KESIHATAN sentiasa digunakan dengan selamat, dan membantu melindungi ALAM SEKITAR atas kesedaran tanggungjawab mengikut perundangan relevan yang bersangkutan dengan bahan dan kemudahan nuklear. Kawalgunaan Aktiviti Nuklear untuk Tujuan Aman Penggunaan tenaga dan teknologi nuklear bagi tujuan aman membentuk satu objektif utama penglibatan negara di dalam bidang nuklear. AELB memastikan komitmen dan sokongan negara terhadap Non-Proliferation Treaty (NPT) untuk Senjata Nuklear dan Perjanjian Kawalgunaan IAEA, termasuk pengawalan eksport bahan dan teknologi nuklear. AELB juga turut terlibat dalam pengawalan import/ eksport bahan dan peralatan tenaga nuklear melalui perundangan.

Dasar, Kod dan Standard Bertanggungjawab untuk pembangunan polisi dan penderafan dokumen perundangan serta menyediakan khidmat nasihat dan khidmat maklumat dalam melaksanakan Akta 304. Perlesenan Bertanggungjawab dalam menjalankan penyelidikan perundangan, penilaian risiko radiologikal dan menilai permohonan lesen. Penguatkuasaan Bertanggungjawab dalam menjalankan pemeriksaan, memastikan keadaan lesen dan penyiasatan untuk penjatuhan hukuman adalah memenuhi syarat. Khidmat Sokongan Teknikal Bertanggungjawab ke atas pengawasan operasi di ibupejabat AELB serta merancang dan menyelaras pentadbiran makmal penyelidikan perundangan. 7 10 laporan tahunan 2011 laporan tahunan Sekalung Penghargaan Laporan Operasi Sebagai satu badan kawalselia dan penguatkuasa, AELB sentiasa bersedia dan memastikan penggunaan teknologi dan sinaran untuk tujuan aman demi melindungi sekuriti nasional dan orang awam seperti yang termaktub dalam penyataan misi AELB. AELB sangat menghargai sepenuhnya sokongan padu yang berterusan dari Kerajaan Malaysia, Menteri Sains, Teknologi dan Inovasi dan pemimpinpemimpin utama Kementerian, serta lain-lain Kementerian, jabatan dan agensi Kerajaan, dan juga agensi-agensi sejawat antarabangsa dan industri. Terima kasih kami juga kepada Lembaga AELB yang terdiri dari lima ahli termasuk Pengerusi Lembaga. Lembaga merupakan satu badan perangka polisi yang mengemudi AELB dalam penguatkuasaan dan pengawalan penggunaan teknologi nuklear dan sinaran dan sekuriti dan kawalseliaannya. AELB, melalui badan Lembaga, juga berkhidmat sebagai penasihat kepada Menteri Sains, Teknologi dan Inovasi dan Kerajaan Malaysia dalam segala hal berkaitan dengan aktiviti tenaga atom dan nuklear. Sejak sekian lama, pihak Lembaga sentiasa memberi penekanan terhadap penggunaan tenaga nuklear dan sinaran semata-mata untuk tujuan aman. Posisi ini adalah sangat penting dalam memastikan kestabilan, sekuriti dan keselamatan negara dan juga kesejahteraan ekonomi. Di peringkat antarabangsa, Lembaga menggalakkan AELB meneruskan kerjasama padu dengan IAEA, ANSN dan rakanrakan kerja global yang lain. Kerjasama ini dapat membantu mengekalkan penglibatan Malaysia yang kuat dalam aktiviti antarabangsa. Penglibatan aktif di peringkat antarabangsa juga membolehkan AELB menjadi pihak yang relevan dalam merangka rancangan dan penyelesaian antarabangsa, serta melindungi kepentingan Malaysia. Kami juga ingin merakamkan penghargaan kami kepada pengurusan atasan dan semua kakitangan AELB di atas komitmen dan sokongan mereka yang membolehkan jabatan ini terus memikul tanggungjawab kami dan kekal sebagai satu badan penguatkuasa yang relevan, berkesan dan berwibawa yang dapat membantu negara mencapai matlamat ekonomi dan pemeliharaan alam sekitar. Terima kasih di atas sokongan anda. Tahun 2011 menyaksikan AELB melalui satu fasa yang boleh dikatakan tidak normal sebagai sebuah badan penguatkuasa. Banyak pihak telah menyoal kami tentang apa yang berlaku di tempat lain, terutamanya di Jepun semasa berlakunya bencana nuklear Fukushima Daiichi yang mengakibatkan satu siri kegagalan peralatan, peleburan nuklear dan pengeluaran bahan radioaktif di Loji Kuasa Nuklear Fukushima I, akibat dari gempa bumi yang besar dan tsunami pada 11 Mac Ia merupakan malapetaka nuklear yang paling besar sejak berlakunya bencana Chernobyl pada tahun Malaysia tidak terkecuali dari merasai kesan bencana Fukushima Daiichi dari segi kebimbangan dan rasa takut yang tersebar di kalangan rakyat Malaysia tentang kemungkinan merebaknya pencemaran bahanbahan radioaktif terhadap alam sekitar. Pasukan tindak balas kecemasan Malaysia telah digerakkan menerusi AELB untuk menangani kebimbangan orang ramai dan meningkatkan keyakinan mereka dengan segera. Kami telah menghantar pasukan ke beberapa lapangan terbang di seluruh negara untuk membantu dalam pengimbasan penumpang dan barangan. Pengimbasan sinaran di lapangan terbang telah meningkatkan tahap kesedaran awam tentang peranan kami. Kekhuatiran awam telah dapat ditangani dan kehadiran pegawai kami telah menaikkan keyakinan orang ramai. Pusat-pusat pengesanan sinaran juga telah dibuka di Ibu Pejabat kami di Dengkil. Di samping itu, Sistem Pemantauan Radiologi Persekitaran kami telah digunakan untuk memantau alam sekitar seluruh negara demi meredakan khabar angin yang mengatakan awan yang tercemar oleh radioaktif dari Jepun sedang bergerak menuju Malaysia. Para pegawai di stesen pemantauan kami bertugas 24 jam/7 hari seminggu untuk memberi maklum balas harian. Kami juga mengeluarkan siaran akhbar sekali atau dua kali sehari untuk memberitahu orang ramai tentang keadaan masa nyata (real time). Atas nasihat kami, Kerajaan Malaysia telah menghantar satu kumpulan pegawai dari AELB dan Nuklear Malaysia ke Jepun untuk menentukan keperluan membawa balik rakyat Malaysia dari Jepun. Setelah membuat penilaian teliti dan mengadakan perbincangan dengan rakan-rakan sejawat Jepun dan badan-badan yang berkenaan, telah diputuskan bahawa pemindahan pulangrakyat Malaysia tidak perlu. Bencana nuklear Fukushima Daiichi telah melonjakkan kami ke barisan hadapan dan memberi kesempatan kepada kami untuk membuktikan diri dan meningkatkan kesedaran awam tentang peranan kami. Selepas bencana tersebut, satu lagi isu yang menonjol ialah penubuhan Lynas Corporation di Kuantan. Perhatian awam sekali lagi tertumpu kepada Projek Nadir Bumi Lynas yang dilihat berbahaya mengeluarkan radionuklid ke dalam persekitaran. AELB kerap memberi taklimat di Kuantan untuk menangani persepsi ini dan meredakan kebimbangan dan kerisauan orang ramai. Kami juga telah membuka satu pejabat sementara untuk memudahkan proses pemantauan aktiviti Lynas dan menangani kebimbangan awam dengan segera melalui hubungan secara langsung dengan orang ramai. Sebagai badan penguatkuasa, AELB mengamalkan sikap adil terhadap semua pemegang lesen termasuk Lynas. AELB tidak akan sekali-kali bertolak ansur tentang soal keselamatan orang ramai. Permohonan awal Lynas telah ditolak, dan hanya diluluskan setelah Lynas memenuhi syarat-syarat tambahan yang ketat. AELB bertindak secara bebas dan berkecuali tanpa campur tangan dari manamana pihak, termasuk Kerajaan. Taraf professional Jabatan dapat dibuktikan dengan komposisi ahli Lembaganya, yang mana tidak seorang pun dari ahlinya mempunyai kepentingan yang boleh menjejaskan kewibawaan Jabatan, terutamanya dari segi hal pemberian kelulusan lesen dan keseluruhan pelaksanaan perkhidmatan dan dalam membuat cadangan dan keputusan. Pengeluaran dan kelulusan lesen, termasuk kepada Lynas, dibuat dengan penglibatan antara agensi dan juga berdasarkan penilaian profesional pelbagai isu, termasuk yang berhubung dengan keselamatan. Penilaian-penilaian ini juga mematuhi undang-undang yang berkenaan,

8 12 laporan tahunan 2011 laporan tahunan termasuk standard dan amalan antarabangsa dan tempatan. Berikut adalah lain-lain perkara penting dalam operasi AELB pada tahun 2011: Draf Bil Akta Tenaga Atom 201_ AELB terlibat dalam penyediaan draf bil Akta baru untuk menggantikan Akta Perlesenan Tenaga Atom 1984 yang ada sekarang. Pendrafan Akta baru ini sedang dibuat oleh seorang perunding antarabangsa yang bertugas di bawah arahan Malaysia Nuclear Power Corporation (MNPC). Peraturan Perlesenan Tenaga Atom (Pengurusan Sisa Radioaktif) 2011 Peraturan Perlesenan Tenaga Atom (Pengurusan Sisa Radioaktif ) 2011 telah diwartakan pada 16 Ogos Peraturan ini dikenakan terhadap semua aspek sisa radioaktif dan pengurusannya yang merangkumi pelbagai bidang dari perubatan, penyelidikan dan industri ke lain-lain kegunaan yang ditentukan oleh Lembaga AELB. Pelaksanaan Akta Perdagangan Strategik 2010 (Akta 708) Diluluskan oleh Parlimen Malaysia pada tahun lepas, Akta Perdagangan Strategik memperuntukkan kawalan ke atas eksport, pemindahan ke kapal, transit, pembrokeran barangan strategik termasuk senjata dan bahan-bahan berkenaan dan lain-lain aktiviti yang mungkin membantu pengeluaran dan penghantaran senjata pemusnah massal. Ia juga memberi peruntukan kepada lain-lain hal yang berkaitan, selaras dengan sekuriti negara dan obligasi antarabangsa. Di bawah Akta ini, AELB telah dilantik sebagai penguatkuasa untuk mengeluarkan permit untuk barangan di bawah kategori 0, iaitu bahan-bahan, kemudahan dan peralatan nuklear, berkuatkuasa dari 1 Januari Para pegawai AELB juga diberi kuasa di bawah Seksyen 2 Akta 708 untuk melaksanakan aktiviti penguatkuasaan seperti yang ditetapkan dalam Akta ini. Untuk memastikan pelaksanaan Akta 708, AELB telah menjalankan beberapa program seperti berikut: Pembangunan Sistem epermit di bawah Akta 708: Semua permohonan permit dibuat atas talian online bermula pada 1 April Ini adalah sebahagian dari usaha memodenkan proses kerja kami yang meliputi permohonan lesen, kelulusan, pindaan dan pembaharuan. Pemegang-pemegang lesen sendiri juga telah melalui perubahan dan menerima khidmat atas talian online yang telah memudahkan proses pengeluaran lesen. AELB akan terus menilai sistem epermit ini demi meningkatkan mutunya. Perbincangan dua hala antara AELB dan Department of Energy (DoE) Amerika Syarikat: Perbincangan dua hala mengenai pelaksanaan Akta 708 telah diadakan pada 25 Januari Perbincangan ini menyentuh pelaksanaan Akta secara keseluruhan, termasuk cadangan melaksanakan program kesedaran bersama, latihan pembangunan keupayaan dan pembangunan panduan dan prosedur yang berkenaan. Bengkel tentang End Use End User Licensing Analysis (EUEU) under Strategic Trade Act 2010 (Act 708): Diadakan dari Januari 2012, bengkel ini bertujuan melatih pekerja cara memproses permohonan eksport, transit dan pemindahan barangan strategik ke kapal. Sistem Pengurusan Kualiti MS ISO 9001:2008 Pada 1 Julai 2011, AELB telah menerima pengiktirafan Sistem Pengurusan Kualiti MS ISO 9001:2008 dari SIRIM. Pengiktirafan ini ialah untuk perlesenan atas talian (online) dan sistem penguatkuasaan AELB yang dianugerahkan tanpa syarat dan sah selama satu tahun. Ini adalah satu kejayaan besar bagi AELB pada tahun Perlantikan sebagai Pengerusi Nuclear Security Advisory Group IAEA Pada tahun 2011, Ketua Pengarah AELB telah dilantik menjadi pengerusi Nuclear Security Advisory Group IAEA yang merupakan badan penguatkuasa tertinggi dalam standard keselamatan nuklear antarabangsa. Perlantikan ini yang berdasarkan kepakaran individu juga dianggap sebagai satu pengiktirafan terhadap kepakaran yang terdapat di Jabatan AELB. Sumbangan kepada Ekonomi Negara AELB terus menyumbang kepada ekonomi negara melalui pengeluaran lesen dan memudahkan kegunaan aman sumber dan teknologi nuklear dan tenaga atom. Pada tahun 2011, jumlah keseluruhan permohonan lesen, pengeluaran kelulusan, pengiktirafan Pegawai Perlindungan Sinaran (RPO) dan pendaftaran pekerja mencecah 8,485, di mana 6,678 atau 78.7% merupakan pengeluaran kelulusan, yang mana memperlihatkan kemajuan yang dicapai oleh industri nuklear dan tenaga atom Malaysia. Usahasama Antarabangsa dan Tempatan Usahasama dengan pihak luar di dalam dan luar negara membantu pertukaran pengetahuan dan kepakaran untuk membangunkan keupayaan program nuklear sejajar dengan standard dan amalan antarabangsa. Usahasama ini sangat penting dalam usaha Malaysia untuk membangunkan Loji Kuasa Nuklear (NPP) sendiri. Pada tahun 2011, AELB telah bekerjasama dengan banyak pihak yang relevan, terutamanya IAEA dan ramai lagi, termasuklah yang berikut: Lawatan DoE Amerika Syarikat di bawah Global Threat Reduction Initiatives (GTRI) Lima pakar DoE Amerika Syarikat yang terlibat dalam program GTRI telah melawat Malaysia dari Januari Tujuan lawatan ialah untuk mengesah dan menilai peralatan sekuriti di bawah program GTRI yang telah dipasang di beberapa tempat. Antara tempat yang telah dilesenkan oleh AELB untuk pemasangan peralatan sekuriti dan yang telah dilawati oleh pakar DoE Amerika Syarikat ialah Universiti Kebangsaan Malaysia (UKM), Ansell Malaysia dan Isotron (M) Sdn Bhd. Pakar-pakar ini juga telah melawat tempat-tempat di bawah bidang kuasa Kementerian Kesihatan Malaysia. Kerjasama dua Hala antara AELB dan National Nuclear Security Administration (NNSA)/DoE Amerika Syarikat Selepas pertukaran surat hasrat (LoI) yang ditandatangai pada 25 Mac 2010 antara AELB dan NNSA/DoE Amerika Syarikat berkenaan kerjasama dua hala dalam bidang sinaran dan keselamatan dan sekuriti teknologi nuklear, beberapa perbincangan teknikal telah diadakan dalam tahun Perbincangan teknikal State System of Accounting for and Control of Nuclear Material (SSAC) and Regulatory Development telah diadakan dari 2-4 Mac Perbincangan ini bertujuan membuat penilaian bersama draf dokumen latihan untuk pindaan Akta 304, Akta Atom (Sekuriti) Peraturan 201_ dan Akta

9 14 laporan tahunan 2011 laporan tahunan Seminar Peaceful Use of Nuclear Energy and Nuclear Non-Proliferation dengan Japan Atomic Energy Agency ( JAEA). Program latihan IAEA Norwegian - Capasity Building in Safety Assessment of Nuclear Power Plant. Atom (Pengawalan/Non Proliferation) Peraturan 201_. Perbincangan ini juga menyemak skop kerjasama antara Jabatan AELB dan NNSA/ DoE Amerika Syarikat, dan merangkumi SSAC, pembangunan modal insan dan kerjasama dalam membangunkan makmal kawalan. Memorandum Persefahaman (MoU) antara AELB dan Japan Nuclear Energy Safety Organization ( JNES) Sempena dengan Technical Support Organisation (TSO) Conference bermula dari 1-5 November, 2010 di Jepun, AELB dan JNES telah membincangkan kemungkinan menandatangani kerjasama antara kedua pihak. Kedua-dua pihak sedang dalam proses mengenalpasti skop MoU ini sebelum menyiapkannya. Lawatan Agensi Luar Negara ke AELB AELB telah menjadi tuan rumah kepada lawatan delegasi agensi asing yang mahu menjalinkan hubungan dengan jabatan. Di antara agensi tersebut ialah: - Tokyo Electric Power Services Co. (TEPCO) Lawatan TEPCO, Japan pada 10 Januari 2011 dibuat oleh kerana agensi itu ingin mengetahui tentang program tenaga nuklear Malaysia dan ingin berkongsi pengalaman mereka di bidang nuklear. - IAEA Extra Budgetary Programme (EBP) tajaan Norway AELB menerima kunjungan pakar IAEA dari Januari 2011 di bawah Pilot Programme on Strengthening of Nuclear Safety Assessment Competence through the Global Safety Assessment Network (G-SAN). Melalui rangka kerja G-SAN, pihak EBP IAEA yang dibiayai oleh Norway ini akan: Menyokong negara-negara yang akan membangunkan program tenaga nuklear dari segi penilaian keperluan keselamatan nuklear. Menyokong negara ahli dalam membangunkan keupayaan penilaian keselamatan dan pengurusan maklumat. Memperkukuhkan perkongsian maklumat dan pengalaman tentang penilaian keselamatan. - Kerjasama dengan Republik Slovakia Lawatan ke Malaysia oleh Duta Republik Slovakia, Yang Berhormat En. Milan Lajciak pada 14 Februari 2011 dibuat untuk membincangkan kemungkinan menjalinkan kerjasama di antara Republik Slovakia dan Malaysia. Skop kerjasama telah dikenalpasti seperti berikut: Penilaian pemilihan tapak untuk perlesenan NPP. Program keyakinan awam. Pembangunan kepakaran melalui program penempatan pakar. Perkhidmatan pakar. Penempatan/pertukaran pegawai. Program pasca-siswazah dalam bidang kejuruteraan nuklear di Slovak University melalui cadangan akreditasi oleh Kementerian Pendidikan Tinggi Malaysia. - Japan Atomic Industrial Forum ( JAIF) Lawatan oleh JAIF pada 25 Februari 2011 membincangkan kemungkinan menjalin kerjasama dalam membangunkan aktivitiaktiviti nuklear di antara JAIF dan AELB. - Japan Atomic Energy Agency ( JAEA) Lawatan oleh JAEA pada 7 Mac 2011 telah dibuat untuk membantu AELB dalam bidang Pembangunan Sumber Manusia Nuklear. Latihan Anjuran AELB dengan Kerjasama Agensi Antarabangsa International Radiological Assistance Training Programme for Emergency Responders (IRAPTER), Februari 2011 Diadakan di Ibu Pejabat AELB dari Februari 2011, dengan kerjasama NNSA/ DoE Amerika Syarikat, IRAPTER bertujuan memberi latihan dan pendedahan tentang teknik mengesan bahan nuklear dan radioaktif dan cara untuk menyelaraskan tindakan-tindakan yang melibatkan pelbagai agensi penguatkuasa di Malaysia bertujuan mengesan bahan nuklear dan radioaktif di luar bidang kuasa. Ini sejajar dengan peranan AELB di bawah Arahan 20 Majlis Keselamatan Negara di mana AELB telah disebut sebagai badan yang bertanggungjawab ke atas kecemasan radiologi. Bengkel Persediaan dan Tindakan Kecemasan Radiologi, Mac 2011 Workshop on Radiological Emergency Preparedness and Response dianjurkan oleh AELB dengan kerjasama Australia Nuclear Science & Technology Organization (ANSTO). Bengkel Serantau tentang Sistem Pengawalan Nasional untuk Keselamatan, Sekuriti dan Kawalseliaan Nuklear IAEA Workshop on National Regulatory System for Nuclear Safety, Security and Safeguards dianjur oleh AELB dari 28 November 2 Disember Berlangsung di Pusat Sains Negara, Kuala Lumpur, ia diadakan bersempena dengan Program Tahun Promosi Sains dan Matematik 2011 di bawah kelolaan MOSTI. Seramai 26 peserta antarabangsa dan 10 peserta tempatan telah menyertai bengkel ini. Kursus Latihan Serantau (RTC) tentang Keselamatan dalam Pengangkutan Bahanbahan Radioaktif Kursus yang diadakan dari 4-8 Julai 2011 di Hotel Royale Bintang, Kuala Lumpur telah dianjurkan oleh AELB dengan kerjasama IAEA. RTC tentang Komunikasi Awam Kursus yang diadakan dari Julai 2011 di Hotel Royale Bintang, Kuala Lumpur ini adalah anjuran AELB dengan kerjasama IAEA. Penempatan Pegawai Kontrak dari Korea Institute of Nuclear Safety (KINS) sebagai Sebahagian dari Perlaksanaan Perjanjian antara AELB dan KINS Seorang pegawai dari KINS Dr. Young Joon Choi, pemegang PhD Kejuruteraan Nuklear dari KAIST (Korea Advanced Institute of Science and Technology) telah memulakan tugas sebagai Pegawai Kontrak Gred C48 di Installasi Nuklear, AELB selama tiga bulan bermula 1 Ogos 30 Oktober Pembangunan Modal Insan AELB terus membangunkan kecekapan pekerja menerusi pelbagai program latihan, kursus, seminar, bengkel, taklimat, ceramah, lawatan pakar dan perbincangan di peringkat antarabangsa dan tempatan. Para pekerja digalakkan melanjutkan pelajaran di peringkat Sarjana Muda, Sarjana dan Kedoktoran (PhD) di dalam dan di luar negara. Pelbagai aktiviti pembangunan insan dijalankan untuk membolehkan pekerja mendapat pendedahan, pengetahuan dan kemahiran yang diperlukan.

10 16 laporan tahunan 2011 laporan tahunan Isu Dan Cabaran Masa Hadapan Kedua-dua isu yang menonjol iaitu bencana nuklear Fukushima Daiichi dan Lynas telah menambahkan lagi dorongan kepada AELB untuk menjadi lebih telus dalam semua aktiviti dan sentiasa bersedia untuk memberi maklumat yang perlu diketahui oleh orang awam. Oleh itu, kami telah membentuk Jawatankuasa Perundingan Awam untuk mengendalikan semua komen awam dan membuat cadangan berdasarkan komen yang diterima untuk perhatian Lembaga AELB. Peristiwa-peristiwa ini juga telah menonjolkan lagi kehadiran kami dan keperluan untuk membuktikan bahawa kami mempunyai kakitangan yang professional dan berintegriti. Tahun ini bukan sahaja sangat mencabar dari segi menangani kebimbangan awam tetapi juga dalam berurusan dengan semua pihak berkepentingan supaya difahami peranan dan fungsi kami. Dalam menghadapi masa hadapan yang lebih mencabar, kami juga sedang melakukan transformasi diri selaras dengan program transformasi Kerajaan Malaysia. Ketika negara bergerak maju dalam usaha menjadi sebuah negara industri, kami pula akan terus berfungsi sebagai payung yang memberi perlindungan dari aspek keselamatan, sekuriti dan kawalseliaan. Perindustrian melibatkan teknologi baru, termasuk teknologi yang membawa risiko radiologi, justeru, kami akan terus memberi perlindungan dan memastikan keselamatan di seluruh negara. Langkah-langkah keselamatan jangka panjang telah diambil oleh AELB sejak dahulu lagi namun langkah-langkah ini hanya menjadi tumpuan pada tahun 2011 terutamanya semasa bencana nuklear Fukushima Daiichi. Sebenarnya, kami telah lama memastikan bahawa negara sentiasa bersedia mengawalselia keselamatan negara dan rakyat jelata pada bila-bila masa yang diperlukan. Kesediaan seumpama ini merupakan satu usaha yang baik untuk masa hadapan. Inilah langkah strategik kami setiap masa, iaitu sentiasa bersedia menangani tindak balas kecemasan. Negara kita sebenarnya telah lama mempunyai pengalaman dalam bidang nuklear, dengan rekod keselamatan yang sangat baik sejak lebih dari 30 tahun dahulu. Kita tidak pernah mengalami kemalangan besar berkaitan dengan nuklear. Kadar keradioaktifan dan kemalangan nuklear Malaysia adalah sangat rendah dan kes yang berlaku adalah kes ringan. Ini mengesahkan bahawa penguatkuasaan peraturan dan undang-undang kita adalah berkesan. Kita juga tidak pernah menghadapi kes bahan nuklear dimiliki secara haram dalam negara ini, yang mana ini menunjukkan bahawa undang-undang kita telah dipatuhi. Selain itu, kami terus mengukuhkan kedudukan kami sebagai penguatkuasa utama dalam mengawal penggunaan tenaga atom termasuk untuk tujuan perubatan, dengan kerjasama yang erat dengan Kementerian Kesihatan. Masa hadapan industri tenaga atom adalah positif memandangkan jumlah permohonan lesen meningkat dengan kadar yang sihat pada tahun lepas. Begitu juga dengan pertumbuhan teknologi Bengkel Orphan Source Search Kuala Lumpur. Para peserta membuat praktikal untuk bengkel Orphan Source Search Kuala Lumpur. sains nuklear yang berkembang dalam banyak sektor ekonomi termasuk pertanian dan kesihatan. Pada tahun 2017 dijangka bahawa akan berlaku kemelesetan sumber gas di Semenjung Malaysia yang mana pada waktu itu wujud kemungkinan perlunya memperoleh tenaga dari Sabah dan Sarawak. Ini menggariskan keperluan Semenanjung terhadap tenaga mampan dari pelbagai sumber, termasuk tenaga solar yang perlu digunakan sepenuhnya. Walaupun kuasa nuklear hanya merupakan satu opsyen untuk menjana kuasa, keputusan belum lagi dibuat oleh Kerajaan Malaysia tentang penggunaan tenaga nuklear untuk menjana kuasa. Keputusan rasmi sama ada untuk menggunakan kuasa nuklear untuk menjana kuasa akan dibuat pada tahun Dalam membuat keputusan ini, Kerajaan Malaysia perlu mengambil kira kemunculan negara serantau yang mempunyai rancangan nuklear mereka sendiri. Ini termasuklah Vietnam yang akan memulakan program nuklearnya pada tahun 2018, Thailand pada tahun 2021 dan Indonesia pada tahun Kita perlu memastikan bahawa negara kita akan kekal selamat dalam keadaan aktiviti nuklear serantau yang semakin meningkat. Walau bagaimanapun, AELB kini memberi penekanan terhadap pengukuhan infrastruktur perundangan termasuk pengawalan kuasa nuklear. Kami telah lama menjalankan pelaksanaan tiga S keselamatan, sekuriti dan kawalguna (safety, security, safeguards), dalam menyediakan sistem perlindungan Pakar IAEA dan Risk Spectrum. menyeluruh, di samping perlaksanaan Akta Perdagangan Strategik kami yang mengawal eksport bahan nuklear. Dengan usaha-usaha tersebut, kami dapat membantu dan memudahkan Kerajaan dalam membuat keputusan mengenai penggunaan tenaga nuklear untuk menjana kuasa. Rancangan jangka panjang AELB termasuklah usaha-usaha memastikan badan penguatkuasa nuklear negara menjadi sebuah organisasi yang lebih bebas dan berkecuali, yang mampu mengawal dan membiayai operasi sendiri serta mempunyai kuasa untuk bertindak tanpa takut kepada sebarang serangan balas dari mana-mana pihak supaya konsep 3S dapat dilaksanakan dengan sempurna. Kami juga akan berusaha mendapatkan kuasa pusat untuk memastikan tiada konflik kepentingan dalam setiap perkara yang kami lakukan. Kami juga akan sentiasa berhubung dengan orang awam dalam membentuk persepsi dan konteks yang betul serta memberi mereka kefahaman yang tepat mengenai aktiviti berkaitan dengan nuklear. Pelan Strategik Untuk Tahun Misi Nasional merangkumi tempoh dan Rancangan Malaysia ke-10 ( ) menyediakan konteks yang diperlukan bagi merangka teras strategik dan pelan tindakan AELB. Dalam konteks agenda pembangunan nasional dan untuk memastikan bahawa AELB memenuhi keperluan Kerajaan dan negara, lima Bidang Hasil Utama (KRA) telah dikenalpasti: Infrastruktur pentadbiran dan perundangan untuk sinaran dan keselamatan, sekuriti dan kawalguna nuklear. Kawalan dan penyeliaan. Kerjasama nasional dan antarabangsa. Modal insan. Pengurusan pengetahuan.

11 18 laporan tahunan 2011 laporan tahunan Teras strategik (ST) yang telah dikenalpasti di bawah Pelan Strategik untuk tahun ialah: ST1: Pengukuhan terhadap rangka kerja kawalan perundangan yang berkesan untuk sinaran dan keselamatan, sekuriti dan kawalguna nuklear, termasuk sebuah badan penguatkuasa yang bebas dan berkecuali. Pelan tindakan termasuk: Pembangunan dokumen-dokumen panduan baru: - Panduan permohonan lesen berkaitan dengan Pusat Pengurusan Sisa Radioaktif Nasional. - Senarai rujukan berkaitan dengan kemudahan nasional untuk menghapuskan sisa radioaktif. - Panduan perlantikan tugas dan tanggungjawab berkenaan dengan Penasihat Perlindungan Sinaran (RPA). - Panduan permohonan lesen berkaitan dengan makmal kalibrasi. Pelaksanaan peraturan perlesenan installasi nuklear. Pendrafan dan penyerahan standard penerimaan dan pengesahan kod atau standard untuk reka bentuk dan pembinaan NPP. Pelaksanaan penuh Akta-akta baru termasuk Akta Perlesenan Tenaga Atom 1984 (Akta 304)/ Bil Akta Atom 201_, Perlesenan Tenaga Atom (Pengurusan Sisa Radioaktif ) Peraturan 201_ dan Perlesenan Tenaga Atom (Pengangkutan) Peraturan 201_, kesemuanya akan siap pada tahun ST2: Kerjasama yang berkesan dan penyertaan cergas di peringkat nasional dan antarabangsa dalam isu teknikal dan polisi sinaran dan keselamatan, sekuriti dan kawalguna nuklear. Pelan tindakan termasuk: Mengadakan program kesedaran keselamatan untuk pemegang lesen, pekerja sinaran dan komuniti. Memperkukuhkan infrastruktur keselamatan, sekuriti dan kawalgunaan melalui pengurusan yang berkesan dan pelaksanaan EBP untuk keselamatan nuklear. Meningkatkan lagi program kesedaran awam. Menjalankan penyelidikan biodosimetri. Menandatangani surat hasrat (LoI) dengan NNSA/DoA. Kursus MEST (Mobile Expert Support Team) Train for Trainers dengan kerjasama pihak KASTAM Diraja Malaysia. Kakitangan AELB sebagai MEST dengan peralatan pengesanan Identifinder berbincang dengan pihak KASTAM (FLO-Front Line Officer). ST3: Pengukuhan mekanisme penyeliaan terhadap pematuhan pemegang lesen kepada syarat-syarat kawalseliaan dan kepuasan pelanggan demi menyokong pertumbuhan ekonomi nasional. Pelan tindakan termasuk: Memproses permohonan atas talian (online) dan menyemak dokumen-dokumen sokongan yang diserahkan oleh pemohon, menjalankan kaji selidik kepuasan pelanggan, membangunkan Piagam Pelanggan yang baru untuk proses pemohonan lesen untuk tujuan penyelidikan reaktor nuklear. (Catatan: Piagam Pelanggan Delegasi ISCN dengan Ketua Pengarah AELB dan Pegawai-pegawainya. untuk permohonan lesen telah digunakan) dan menjalankan penyelidikan kawalselia dengan tujuan berikut: - Penentuan pembuangan sisa radioaktif nasional (EIA/RIA untuk kajian NORM dan TENORM). - Kajian tetang arang batu dan komposisi radiologi produk berkaitan. - Kajian tentang produk konsumer. Menjalankan pemeriksaan yang kerap ke atas kemudahan reaktor penyelidikan untuk memastikan pematuhan kemudahan reaktor penyelidikan kepada pelaksanaan syarat perlesenan. Melaksanakan program perlindungan sinaran dan menjalankan pengambilan sampel alam sekitar untuk pemantauan radiologi. Membina garis panduan dan prosedur Akta 708 dan Akta 304. ST4: Pengukuhan perancangan yang berkesan berkenaan persediaan dan tindakan kecemasan untuk sinaran dan peristiwa dan kemalangan nuklear. Pelan tindakan termasuk: Memastikan pemantauan dan peralatan makmal ada tersedia pada masa yang diperlukan. Meluluskan dokumen-dokumen yang relevan melalui audit forum. ST5: Membangunkan keupayaan dan kebolehan infrastruktur kawalselia sinaran dan nuklear dan modal insan. Pelan tindakan termasuk: Memastikan pelaksanaan licin sistem permohonan atas talian (online). Menghadiri kursus teknikal dan bukan teknikal di peringkat nasional dan antarabangsa. Membangunkan makmal NDA. Menyiapkan latihan berkomputer kecekapan mampan pegawai. ST6: Perlindungan dan jaminan hak tetap untuk membangunkan teknologi nuklear secara selamat dan terkawal untuk tujuan aman di Malaysia dan memupuk keyakinan awam terhadap kegunaan aman sinaran dan teknologi nuklear. Pelan tindakan termasuk: Memperuntukkan/menarik balik pemeriksa kawalselia IAEA melalui penilaian kecekapan. Menubuhkan Sistem Pemantauan Radialogi Nasional untuk membantu lain-lain agensi penguatkuasa dalam mengesan tahap pencemaran dan pengedaran haram bahan nuklear dan radioaktif demi keselamatan nasional. Mengesahkan protokol tambahan terhadap perjanjian kawalselia menyeluruh dengan IAEA. AELB akan senantiasa menyemak pelan tindakan dan mempertingkatkan tahap proses kerja supaya kami kekal sebagai sebuah badan penguatkuasa yang sangat berkesan. We oversee the use of nuclear energy and materials to protect the health, safety and security of Malaysians and the environment and to help steer the implementation of Malaysia s international commitments on the peaceful use of nuclear energy. Malaysia s nuclear sector has an excellent safety record, and our nuclear facilities are among the safest and most secure in the region due largely to our position of never compromising the safety of Malaysians and the nation as a whole. 15 26 annual report 2011 annual report THE DEPARTMENT OF AELB Strong Presence Nationwide A department of the Ministry of Science, Technology and Innovation (MOSTI), AELB has since 26 years ago played a critical role in ensuring the safety and security of Malaysia by regulating, safeguarding, controlling and ensuring the effectiveness of the country s atomic energy activities. 16 28 annual report 2011 annual report A Credible Enforcement Body AELB collaborates with various Ministries, Government departments and agencies in order to ensure that nuclear-related activities as well as nuclear energy facilities and materials are used safely and securely in Malaysia. The Department also works with many other domestic and international organisations, including regulators to fulfil the mandate given to us. Established on February 1, 1985, AELB enables the Malaysian Government to effectively control, inspect and enforce atomic energy activities in the country. There was a rapid rise in such activities after 1968 when the Government passed the Radioactive Substances Act 1968 to control the use of radioactive substances. In April 1984, the Atomic Energy Licensing Act (Act 304) was drawn up and passed by Parliament. The establishment of the Department of AELB followed a year later. Placed initially under the ambit of the Prime Minister s Department, AELB functions according to Section 3 of Act 304 and serves as the enforcement agency for Act 304 (nonmedical activities). Under the same act, the use of atomic energy for medical purposes comes under the purview of the Ministry of Health. On October 27, 1990, AELB was moved from the Prime Minister s Department and placed under MOSTI. Act 304 has been reviewed so as to ensure its relevancy and effectiveness to meet current requirements. The year 2011 saw AELB continuing to perform based on the organisation s clear-cut functions, roles and commitments, as follows: Functions Advising the Minister and the Government of Malaysia on matters relating to the Atomic Energy Licensing Act 1984 and developments pertaining thereto with particular reference to the implications of such developments for Malaysia. Exercising and supervising over the production, application and use of atomic energy and matters incidental thereto. Establishing, maintaining and developing scientific and technical co-operation with such other bodies, institutions or organisations in relation to nuclear matters or atomic energy as the Board thinks fit for the purposes of the Atomic Energy Licensing Act Performing as and when directed by the Government of Malaysia to fulfil the obligations arising from agreements, conventions or treaties relating to nuclear matters or atomic energy to which Malaysia is a party where such agreements, conventions or treaties relate to the purposes of the Atomic Energy Licensing Act Undertaking such other things arising out of or consequential to the functions of the AELB Board under the Atomic Energy Licensing Act 1984, which are not inconsistent with the purposes of this Act, whether or not directed by the Minister. Commitments To Protect Security, Safety, Health and Environment By establishing SECURITY measures and regulatory requirements pertaining to nuclear facilities and materials, AELB effectively ensures that licensees will be able operate their facilities safely at all times, thus protecting the SAFETY of everyone. AELB also ensures the safe use of radiation equipment for medical and HEALTH purposes as well as helps protect the ENVIRONMENT through the use of relevant legislation on nuclear facilities and materials. To Safeguard Peaceful Nuclear Activities The use of nuclear energy and technology for peaceful purposes forms the core objective of the country s foray into nuclear fields. AELB ensures Malaysia s commitment and support for the Non-Proliferation Treaty (NPT) of Nuclear Weapons and the IAEA Safeguards Agreement, including export control of nuclear materials and technology. AELB is also a party to the import/ export control of nuclear energy materials and instruments through legislation.

18 32 annual report 2011 annual report Bouquet of Thanks Operational Report As a legislative and regulatory body, AELB always prepares and ensures the safety and peaceful use of nuclear technology and radiation in order to protect national security and the society as stated in AELB s mission statement. AELB fully appreciates the continuing strong support from the Government of Malaysia, the Minister of Science, Technology and Innovation and the Ministry s key leaders, other Ministries and Government departments and agencies as well as industry and international counterpart agencies. Our gratitude also goes to the Board of AELB, which comprises of five members including the Chairman of the Board. The Board is the policy-setting body that steers AELB in enforcing and controlling the use of nuclear and radiation technology and its related security and safeguards. AELB, through the Board, also serves as the advisor to the Minister of Science, Technology and Innovation and the Government of Malaysia in matters concerning atomic energy and nuclear-related activities. It has always been the priority of the Board to maintain the use of radiation and nuclear energy for peaceful purposes only. This position is crucial in ensuring the country s stability, security and safety as well as economic well-being. At the international level, the Board encourages AELB to maintain active collaboration with IAEA, ANSN and other global counterparts, which helps retain Malaysia s strong presence and participation in international activities. Remaining active internationally also allows AELB to become a relevant party in formulating international solutions and plans as well as protect the interest of Malaysia. We would also like to extend our appreciation to the top management and all employees of AELB for their commitment and support that enable the department to continuously discharge our duties and remain as an effective, credible and relevant regulatory body that will help the nation to achieve our economic and environmental goals. Thank you for your support The year 2011 saw AELB undergoing a phase which could be considered abnormal for a regulatory authority. Many parties questioned us about what was happening elsewhere, particularly in Japan during the Fukushima Daiichi nuclear disaster which caused a series of equipment failures, nuclear meltdowns, and releases of radioactive materials at the Fukushima I Nuclear Power Plant, following the massive earthquake and tsunami on March 11, It was the largest nuclear disaster since the Chernobyl disaster of Malaysia was not spared from the effects of the Fukushima Daiichi nuclear disaster in terms of the concern and fear spreading among Malaysians of the possible contamination of the environment with radioactive materials. Malaysia s emergency response team was mobilised through AELB to address the people s concerns and raise their confidence immediately. We dispatched teams to airports in the country to help in scanning passengers and goods. Radiation scanning at the airports raised the level of the public awareness on our roles. Public anxiety was addressed and the presence of our officers boosted public confidence. Screening centres were also opened at our Headquarters in Dengkil. In addition, our Environmental Radiological Monitoring System was used to monitor the environment of the whole country and allay the rumours that radioactivity clouds from Japan were moving towards Malaysia. Officers at our monitoring stations worked round the clock to give daily feedbacks. We also released Press statements once or twice daily to keep the people informed of the real-time situation. On our recommendation, the Malaysian Government dispatched a team of officers from AELB and Nuclear Malaysia to Japan in order to ascertain the necessity to evacuate Malaysians from Japan. After a thorough assessment and discussion with the Japanese counterparts and relevant authorities, it was concluded that evacuation was not necessary. The Fukushima Daiichi nuclear disaster pushed us at the forefront, giving us the opportunity to make our mark and increase the awareness of our roles and activities. Following the disaster, another high-profile issue resurfaced the establishment of Lynas Corporation in Kuantan. Public attention was again focused on the Lynas Rare Earths Project with its perceived danger of the release of radio nuclides into the environment. AELB had to give frequent talks in Kuantan to address the perception and allay public fears and concerns. We also set up a temporary office to facilitate monitoring process of Lynas activities and address public concerns immediately by engaging with the people directly. As a regulator, AELB remains impartial to all its licensees including Lynas. AELB will never compromise public safety. The initial application by Lynas was rejected, and was only approved when it met additional stringent requirements. AELB acted independently without any interference from any parties, including the Government. The Department s professional stand could be seen even from the composition of its Board members whereby none of the members have any conflict of interest that may affect the credibility, particularly in matters concerning the approval of licences and in the overall delivery of services and in making recommendations and decisions. The issuance and approval of licences, including to Lynas, were done with inter-agency involvement and were also strictly based on professional assessments of many issues, including those concerning safety. The assessments were also in compliance with the relevant law, as well as international and local standards and practices.

19 34 annual report 2011 annual report The following are other operational highlights of AELB in 2011: Draft of the Bill for Atomic Energy Act 201_ AELB was involved in the preparation of the draft of the bill for the new Act to replace the existing Atomic Energy Licensing Act The new Act was being drafted by an international consultant acting under the directives of Malaysia Nuclear Power Corporation (MNPC). Atomic Energy Licensing Regulations (Radioactive Waste Management) 2011 Atomic Energy Licensing Regulations (Radioactive Waste Management) 2011 was gazetted on August 16, These regulations apply to all aspects of radioactive waste and waste management from medical, research, industry to any other application that may be specified by the Board of AELB. Implementation of Strategic Trade Act 2010 (Act 708) Passed by the Malaysian Parliament last year, the Strategic Trade Act provides control over the export, trans-shipment, transit and brokering of strategic items, including arms and related materials, and other activities that will or may facilitate the production and delivery of weapons of mass destruction. It also provides for other related matters, consistent with Malaysia s national security and international obligations. Under the Act, AELB was appointed as the authority to issue permits for goods under category 0, namely materials, facilities and nuclear equipment, effective from January 1, AELB s officers were also given the authority under Section 2 of Act 708 to implement enforcement actions as stipulated in the Act. To ensure the smooth implementation of Act 708, AELB has carried out several programmes, as follows: Development of epermit System under Act 708: All permit applications were made online beginning from April 1, This is part of the modernisation of our processes, encompassing licensing application, approval, amendment and renewal. The licensees themselves are also transforming and embracing online services which have facilitated licensing processes. AELB will continue to assess the epermit system to further improve it. Bilateral discussion between AELB and the United States (US) Department of Energy (DoE): The bilateral discussion concerning the implementation of Act 708 was held on January 25, The discussion touched on the implementation of the Act as a whole, including the proposal to implement a joint awareness programme, capacity development training and the development of related guides and procedures. Workshop on End Use End User Licensing Analysis (EUEU) under Strategic Trade Act 2010 (Act 708): The workshop held from January 25-27, 2011 was aimed at providing staff training on ways to process export applications, transit and transhipment of strategic goods. MS ISO 9001:2008 Quality Management System Certification On July 1, 2011, AELB received the MS ISO 9001:2008 Quality Management System certification from SIRIM. The certification, which was for AELB s online licensing and enforcement system, was awarded without conditions and is valid for one year. This was a landmark achievement for AELB in Appointment as Chairman of IAEA s Nuclear Security Advisory Group In 2011, the Director General of AELB was appointed as the chairman of IAEA s Nuclear Security Advisory Group, which is the highest authority in international nuclear safety standards. The appointment, which was based on the individual expertise, was also seen as recognition for the expertise available within AELB. Contribution to the Malaysian Economy AELB continued to contribute towards the Malaysian economy by issuing licences and facilitating the safe use of nuclear and atomic energy resources and technology. In 2011, the total of licence applications, issuance of approvals, certification of Radiation Protection Officers (RPOs) and registration of workers reached 8,485, of which 6,678 or 78.7% were for issuance of approvals, which reflected the progress of Malaysian nuclear and atomic energy industry. International and Local Collaborations Collaborations with external parties both locally and internationally facilitate the exchange of knowledge and expertise to develop the country s capacity in nuclear power development programme in line with international standards and practices. Collaboration is especially important in Malaysia s endeavour to develop the country s own nuclear power plant (NPP). In 2011, AELB collaborated with many relevant parties, particularly IAEA and many others, including the following: US DoE Visit under Global Threat Reduction Initiatives (GTRI) Five US DoE experts involved in the GTRI programme visited Malaysia from January 17-21, The objective of the visit was to verify and assess security equipment under GTRI programme which were installed at various premises. Among the premises licensed by AELB for the installation of the security equipment and which were visited by the US DoE experts were Universiti Kebangsaan Malaysia (UKM), Ansell Malaysia and Isotron (M) Sdn Bhd. The experts also visited the premises under the purview of the Ministry of Health, Malaysia. Bilateral Cooperation between AELB and National Nuclear Security Administration (NNSA)/US DoE Following the exchange of Letter of Intent (LoI) signed on March 25, 2010 between AELB and NNSA/US DoE pertaining to bilateral cooperation in the field of radiation and nuclear technology safety and security, several technical meetings were held in The technical meetings on State System of Accounting for and Control of Nuclear Material (SSAC) and Regulatory Development were held from March 2-4, The meetings were held with the aim of making joint assessment of the training document draft for the amendment of Act 304, Atomic Act (Security) Regulations 201_ and Atomic Act (Non-Proliferation) Regulations

Malaysian and Vietnamese participants from various agencies together with the experts during the Risk Spectrum Workshop. 201_. The meetings also reviewed the scope of co-operation between AELB and NNSA/US DoE, and encompassed SSAC, human capital development and co-operation in developing a safeguards laboratory. Memorandum of Understanding (MoU) between AELB and Japan Nuclear Energy Safety Organization ( JNES) In conjunction with the Technical Support Organisation (TSO) Conference from November 1-5, 2010 in Japan, AELB and JNES discussed the potential of signing a MoU on technical cooperation between the two parties. Both parties are in the process of identifying the scope of the MoU before finalising it. Visits of Foreign Agencies to AELB AELB hosted the visits by the delegations of various foreign agencies which want to establish relationships with the department. Among the agencies are: - Tokyo Electric Power Services Co. (TEPCO) The visit by TEPCO, Japan on January 10, 2011 was made as the agency wanted to know about Malaysia s nuclear energy programme and shared their experience in the field of nuclear - Norwegian-funded IAEA Extra Budgetary Programme (EBP) AELB received IAEA expert mission from January 13-14, 2011 under the Pilot Programme on Strengthening of Nuclear Safety Assessment Competence through the Global Safety Assessment Network (G-SAN). Through G-SAN framework, the Norwegian-funded IAEA EBP will: Support countries which will develop nuclear power programme in terms of the assessment of needs for nuclear safety. Support member countries in developing safety assessment capacity and knowledge management. Strengthen the sharing of knowledge and experience on safety assessment. - Co-operation with Slovak Republic The visit to Malaysia by the Ambassador of Slovak Republic, the Honourable Mr. Milan Lajciak, on February 14, 2011, was made to discuss the potential of establishing co-operation between the Slovak Republic and Malaysia. The scope of co-operation has been identified as follows: Assessment of the selection of the site for licensing NPP. Public confidence programme. Expertise development through experts attachment programme. Expert services. Attachment/exchange of officers. Post-graduate programme in the field of nuclear engineering in Slovak University through the recommendation of accreditation by the Ministry of Higher Learning, Malaysia. - Japan Atomic Industrial Forum ( JAIF) The visit by JAIF on February 25, 2011 discussed the potential of establishing co-operation in developing nuclear activities between JAIF and AELB. - Japan Atomic Energy Agency ( JAEA) The visit by JAEA on March 7, 2011 was made to assist AELB in the field of Nuclear Human Resource Development. Training organised by AELB in co-operation with international agencies International Radiological Assistance Training Programme for Emergency Responders (IRAPTER), February 21-24, 2011 Held at AELB Headquarters from February 21-24, 2011, in co-operation with NNSA/ US DoE, IRAPTER was aimed at providing training and exposure on the technique for tracking radioactive and nuclear materials and the method for co-ordinating actions involving enforcement agencies in Malaysia in order to track radioactive and nuclear materials outside legal jurisdiction. This is in line with AELB s role under Directive 20 of the National Security Council whereby AELB has been named as the body responsible for radiological emergency. Workshop on Radiological Emergency Preparedness and Response, March 14-18, 2011 The Workshop on Radiological Emergency Preparedness and Response was organised by AELB in co-operation with Australia Nuclear Science & Technology Organization (ANSTO). Regional Workshop on National Regulatory System for Nuclear Safety, Security and Safeguards IAEA Workshop on National Regulatory System for Nuclear Safety, Security and Safeguards was organised by AELB from November 28 to December 2, Held at the National Science Centre in Kuala Lumpur, it was held in conjunction with the Promotion of Science and Mathematics Year 2011 Programme under MOSTI. A total of 26 international participants and 10 local participants were involved in the workshop. Regional Training Course (RTC) on Security in the Transport of Radioactive Materials The course was held from July 4-8, 2011 at Hotel Royal Bintang, Kuala Lumpur. It was organised by AELB in co-operation with IAEA. RTC on Public Communication The course which was held from July 11-15, 2011 at Hotel Royal Bintang, Kuala Lumpur was organised by AELB in co-operation with IAEA. Placement of Contract Officer from Korea Institute of Nuclear Safety (KINS) as part of the implementation of the agreement between AELB and KINS An officer from KINS, Dr. Young Joon Choi, who holds a Ph.D on Nuclear Engineering from KAIST (Korea Advanced Institute of Science and Technology) began his duty as Contract Officer Grade C48 at the Nuclear Installation, AELB for three months beginning from August 1, 2011 to October 30, Human Capital Development AELB continued to develop staff competency through various training programmes, courses, seminars, workshops, briefings, talks, experts visits and meetings locally and internationally. Staff members were encouraged to pursue higher education at Bachelor s Degree, Masters Degree and PhD levels in the country and overseas. Human capital development activities were carried out to provide our staff with the necessary exposure, knowledge and skills.

21 38 annual report 2011 annual report Outlook and Challenges Both the high-profile Fukushima Daiichi nuclear disaster and the Lynas issue served as a further impetus for AELB to be more transparent in its activities and to keep the public informed at all times. Thus, we formed a Public Consultancy Committee to deal with public comments and to make recommendations based on these comments to the Board of AELB. The events also pushed us to a high level of visibility and the need to prove that we have people with professionalism and integrity. The year was very challenging indeed not only in dealing with public concerns but also in engaging all the stakeholders to see our roles and functions. In facing more challenging times ahead, we are also transforming ourselves in tune with the Malaysian Government s transformation programme. With the country going full steam ahead in efforts to become a more industrialised nation, we will continue to be the umbrella to provide the cover in aspects of safety, security and safeguards. Industrialisation will involve new technologies, including those that pose radiological risks, therefore we will continue to ensure that we will protect and provide safety cover for the entire nation. AELB s long-term safety measures which have been put in place years before came into the spotlight in 2011 particularly during the Fukushima Daiichi nuclear disaster. We have made sure that the country was well prepared to safeguard the nation and its people when the situation arose. Such preparedness will augur well in the future. This has always been our strategic positioning always be prepared to deal with emergency response. Our country actually has long had the experience in the nuclear field, with a tremendous safety record since more than 30 years ago. We have not had any major nuclear-related accidents. Malaysia s rate of radiation and nuclear accidents was too low and the cases too minor. This confirms our effective enforcement of rules and regulations. We also have not had a case of nuclear materials being possessed illegally in the country, which showed that the law has been observed well. In addition, we continued to strengthen our position as the central authority to control the use of atomic energy including for medical purposes, working in close collaboration with the Ministry of Health. The atomic energy industry outlook has been positive with the number of applications for licences registering a healthy increase in the past year. Likewise, the development of nuclear science technology has also grown in many sectors of the economy, including agriculture and health. By 2017, it is expected that there will be a depletion of gas in Peninsular Malaysia which by then will be likely to import energy from Sabah and Sarawak. This underscores the Peninsula s needs for more multi-faceted sustainable energy sources, including solar power that must be exploited fully. An official decision on whether to proceed is currently set for In making the decision, Malaysia also has to take into consideration the emergence of countries in the region with their own nuclear power plans. These include Vietnam which will commence its nuclear energy programme in 2018, Thailand in 2021 and Indonesia in We must ensure that our country will remain safe with increasing regional nuclear activities. However, what is more important currently is putting the legal infrastructure including the control of nuclear power in place. We have also long begun the implementation that encompasses the three S safety, security and safeguards, to provide total protection system along with our Strategic Trade Act governing the export of nuclear materials. With these, we have facilitated and made it easy for the Government to decide on nuclear power for energy generation. AELB s long-term plans include efforts to ensure that the country s nuclear regulatory authority become a more independent organisation, which is self-regulating, self-financing, and has the full authority to act without fear of reprisal from any party so as to ensure the 3S fully. We will also work towards having central authorisation so as to ensure that there will be no conflict of interest in everything we do. We will also constantly engage with the public to fight the war of perception and to make the ordinary people understand nuclear-related activities accurately and in the right context. Strategic Plan For The National Mission covering the period and the 10th Malaysia Plan provide the essential context in framing the strategic thrusts and action plans of AELB. In order to enhance the efficiency of AELB in safeguarding atomic energy activities in Malaysia, both legal and non-legal documents were developed and adopted by AELB and licence holders involved in such activities.
