1 3Com Trade-Up Program END USER PROMOTION Effective June 4, 2005 through September 2, 2005, Trade-in your 3Com products and be eligible to receive a 25% mail-in rebate on 3Com qualifying purchases. 3Com continues to deliver innovative solutions that remove the complexity from networking to empower your business. 3Com meets these needs with new wire-speed, core switching solutions, and cost-effective, high-performance routing products. 3Com s Trade-up Program rewards you when you trade-in old technology and move up to specific models of new 3Com products. Trade in a competitor s product and you can qualify for a 15% rebate towards the purchase of the new equipment. Now through September 2, 2005, trade in a 3Com product and qualify for up to a 25% rebate for the new equipment. There s never been a better time to trade up with 3Com. Follow these four simple steps to participate: Step 1: Purchase new 3Com product(s). Purchases must be made from the 3Com Qualifying Purchases table (page 4-7) and may be made from an authorized reseller of the participant s choice, and are based upon the normal terms an end user would use when buying through this channel. Step 2: Complete all Trade-up Claim Forms. Complete the Trade-Up Claim Form (page 2), using the 3Com Qualifying Purchases form to calculate the amount of your rebate. Make sure to include the Certificate of Destruction (page 3). Step 3: Send in all completed forms within 60 days of receiving new 3Com product. Participants must send in their completed forms within 60 days of receiving their new 3Com products in order to receive a rebate. Only 3Com product purchases that have a matching trade of used product will receive a rebate. A copy of the Trade-Up form, Certificate of Destruction, and a copy of the invoices showing proof of purchase of new 3Com product(s) must be included. Box 1142 Grand Rapids, MN Important: Inaccurate or incomplete information will delay receipt of rebates and in some cases may result in the package of forms being returned to the participant. Please ensure that all information and appropriate forms are included in the package, and please keep a copy of all forms for your records. Step 4: Receive rebates. Once the completed forms have been received, processed and verified by 3Com, a rebate check will be issued for qualified transactions. Please allow up to 8 weeks after receipt of forms for receipt of rebate check. Please note: Rebates are based on End-User purchase price. All rebates will be paid in U.S. dollars. Open to end-user companies in the U.S. and Canada. This Trade-Up program may not be used with any other 3Com discount program, including Summer School. Any education claims submitted with invoices dated prior to July 1, 2005 will be eligible for the Trade-Up promotion as well as Summer School. 8 3COM TRADE-UP PROGRAM OFFICIAL RULES AND TERMS AND CONDITIONS 3Com s Trade-up Program is open to eligible enduser companies in the United States and Canada. Resellers or resale companies are not eligible to participate in the 3Com Trade-up Program unless acting on the behalf of an identified end user. 3Com employees and their immediate families as well as 3Com agencies and their employees are not eligible to participate in the 3Com Trade-up Program. The claim form must be fully completed and accompanied by an end-user invoice with purchases of eligible products clearly indicated. 3Com will only accept a claim that is accompanied by an invoice dated between June 4, 2005 through September 2, 2005 and postmarked within 60 days of receiving new 3Com products. All claims must be received by October 31, End Users trading in 3Com products are eligible to receive a 25% mail-in rebate. Trade-up awards will not be honored without complete documentation. Resellers are not eligible for a Special Pricing Quote (SPQ) on deals where they know the end user is claiming a trade-up as part of the 3Com Trade-Up Program. Claims where the reseller attempts to claim both the SPQ and the Trade-Up Rebate will be denied. There is a U.S. $250,000 Trade-up Program credit maximum for every enduser company. If credit totals more than U.S. $250,000, 3Com corporate approval is required. Leased, rented, stolen, or licensed-against equipment is prohibited for use in 3Com s Trade-up Program. Product(s) being traded must be wholly owned by the end-user company. Parts or partial products are not acceptable as trade-up product(s). 3Com reserves the right to determine whether equipment being traded is comparable or complete. In the event of a dispute over whether or not equipment is equal in type and quantity, the judgment of 3Com will prevail. Please allow up to 8 weeks to receive your rebate check. All rebates will be paid in U.S. dollars. 3Com reserves the right to require reseller proof of purchase or other documentation from its reseller[s], at its sole discretion, before payment of the rebate. 3Com may, at its sole discretion, disqualify claims that do not comply with the guidelines established in the Terms & Conditions or where 3Com believes that fraudulent or inaccurate claims have been submitted. Attempts to obtain cash award in violation of these terms and conditions may constitute fraud, and may be a violation of postal, federal and state or local laws. 3Com may not permit any participant found in violation of these Terms & Conditions to participate in this or any other 3Com promotion. Program is void where prohibited by law or company policy. 3Com will not be held liable if credit is issued in violation of specific company policies or local country laws. Rebate checks will be issued to the end-user company, not the participant as an individual. Rebate checks may be issued to the reseller if authorized in writing by the enduser company. 3Com shall not be liable to any end-user company or any participant for its issuance of rebate(s) to the name and place specified on the Trade-up Form. Once issued by 3Com, rebate checks are not transferable and will not be reissued for use by another participant. If the end-user company representative wants his/her reseller to receive the rebate check directly, the end-user company representative must transfer the rebate over to the reseller (see Page 2 for details.) 3Com is not responsible for claim forms that are illegible, late, lost or mutilated in the mail or postage due to postal service. End-user company is responsible for payment of all taxes in connection with the receipt of any trade-in rebates, if applicable. Rebate values will be calculated according to eligible product(s) purchase price. 3Com reserves the right to change or terminate this promotion at any time without advanced notice. This promotion cannot be used in conjunction with any other pricing promotion on this product. By participating in this promotion you hereby grant to 3Com the right, subject to reasonable requirements of safety and security, to audit your records as is reasonably necessary for 3Com to ensure the validity of any claim for a rebate payment and compliance with the terms and conditions of the promotion. 3Com shall be entitled to such audit any promotion claim at any time after giving at least 48 hours written notice. Audit is to be carried out at 3Com s expense and during normal business hours. You shall give 3Com all reasonable assistance in making arrangements for such investigations and audit. In the event that such an audit leads 3Com to reasonably conclude that claim for Rebate Payment is not valid, 3Com may: Reject the claim without any rights of recourse; and/or Recover the Rebate Payments paid under this Promotion and all 3Com reasonable costs of the audit; Terminate your participation in any future Promotions.
