1 BOARD OF COUNTY COMMISSIONERS SARPY COUNTY, NEBRASKA RESOLUTION APPROVING THIRD ADDENDUM TO AGREEMENT FOR JAIL COMMISSARY SERVICE WHEREAS, pursuant to Neb. Rev. Stat (6), the County has the power to do all acts in relation to the concerns of the county necessary to the exercise of its corporate powers; WHEREAS, pursuant to Neb. Rev. Stat , the powers of the County as a body are exercised by the County Board; WHEREAS, on October 15, 2002, the County Board entered into an agreement with DVAL Enterprises, Inc. for jail commissary services. Said agreement was amended by addendum pursuant to Resolutions and ; and WHEREAS, the County Board desires to enter into a third addendum to the October 15, 2002 agreement with DVAL Enterprises, Inc., for the purpose of authorizing the use of electronic tablets in the Sarpy County Jail. NOW, THEREFORE, BE IT RESOLVED that the Third Addendum to the Agreement for Jail Commissary Service, attached hereto, is approved, along with is hereby approved and the Chairman is authorized to sign it along with any other related documents, the same being approved by the Board. This agreement has been very beneficial for the County and therefore extended twice. Addendum 3 modifies the commissary agreement to include electronic services through a 3 rd party contractor. The contract will continue to be maintained by DVAL with no changes to commissary services except the ability to place orders electronically. This addendum has been reviewed by the Sheriffs Office, Purchasing and the County Attorney s Office and is recommended for approval. 3 From the desk of: Lieutenant Brian Richards To: County Board of Commissioners Date: July 21, 2017 Re: Electronic Tablets for the Jail Jail Administration has recognized a need to modernize Jail processes and the benefit of having electronic tablets available for use by the inmates. Over the past couple of years, representatives from Sarpy County Administration and Jail Administration listened to presentations from several companies who offered electronic tablets for the Jail. Tablet services include electronic forms such as commissary orders, medial requests, grievance submittals, as well as games, movies, s, and banking features for the inmates. The companies that made presentations to Sarpy County Administration and Jail Administration wanted the food service contract and commissary contract in order for them to provide free electronic tablets, software, installation, and service to the County. Stand-alone electronic tablet systems, without a food service/commissary contract or JMS (Jail Management System) contract were in excess of $100,000. We were and are happy with our long standing and affordable food service/commissary provider (DVAL) so we didn t want to disrupt that service. Through an arrangement between CBM Managed Services and DVAL, CBM will provide free electronic tablets, software, installation, and 24-hour service to the County. Additionally, CBM will be completely integrated with our inmate phone provider, pod kiosks, lobby ATM, booking manager, and inmate debit release cards. CBM is a nationally recognized managed services provider, present in over 700 correctional facilities across the nation. The only budget impact is $3,500 in wiring for the installation and an additional Cox Communications line at the cost of $100 per month. Both of these items are budgeted. The County Attorney s Office drafted an addendum to the DVAL Commissary Contract in order to account for the addition of the electronic tablets in the Jail and to allow DVAL to work with CBM to provide tablet services in the Jail. Due to the minimal budget impact and value in having the tablets in the Jail, I recommend approval of the addendum. Lt. Richards Page 1

4 THIRD ADDENDUM TO AGREEMENT FOR JAIL COMMISSARY SERVICE THIS THIRD ADDENDUM is entered into by and between Sarpy County ( County ) and DVAL Enterprises, Inc. (hereinafter DVAL ) to an agreement between the parties for the provision of jail commissary services originally entered into on October 29, 2002 and modified by addendums on November 7, 2006 and August 21, It is mutually agreed between the parties that the following terms and conditions are hereby amended to read as follows: [Insert] SECTION VI. ELECTRONIC DEVICES County authorizes the use of electronic tablets in the Sarpy County Jail. To the extent that the tablets are used for ordering commissary services, said services are limited to those identified in the November 7, 2006 Addendum referenced above. Said electronic tablets and related services shall be provided by DVAL at no cost to the County. The County is not responsible for the maintenance of the electronic tablets, nor is the County responsible for any replacement costs. Attached hereto as Exhibit A is an itemization and fee structure for the tablets and related services. DVAL shall notify the County in the event that there are modifications to the services or fee structure shown in Exhibit A. The County, at its sole discretion, at any time, and at no cost to the County, may terminate the use of electronic tablets in the Sarpy County Jail. 6 Exhibit A Tablet Services for the Sarpy County Jail Commission: Sarpy County receives a 20% commission on commissary goods sold. The introduction of the tablets in the Sarpy County Jail would not alter this commission and Sarpy County would not receive commission on tablet services. However, it will be easier for inmates to order commissary services and therefore it is likely that Sarpy County s overall commission will increase due to increased ordering. Paid Tablet Rental: Inmates may rent a tablet at the cost of $4.99 for 24 hours. The tablet rental includes unlimited movies, games, and music. Free Tablet Rental: Every two hours, inmates may rent the tablet for free for 15 minutes. During that time, the inmate has unlimited access to games. Additionally, the use of the tablet for the following services is always free and accessible 24/7: ordering commissary, submitting medical requests and grievances, viewing the mandatory Prison Rape Elimination Act (PREA) video, reviewing jail rules, and accessing the jail law library. Inmates may use the tablet to send s at the cost of $0.50 per . Phone Time Purchase: Inmates can use the tablet to transfer money from their account to the cost of phone time at the cost of $0.80 per transaction. For example, if an inmate used the tablet to transfer $5.00 from his or her account to pay for phone time, it would cost the $5.80. The actual use of the phone time would then be debited by Synergy, the phone company. Any unused phone time will be credited back to the inmate at the time of release. Cash Deposit: The tablet subcontractor will have an ATM located in the jail lobby for purposes of adding money to an inmate s account. The cost per cash transaction is $3.25 and 10% per credit card transaction. For example, if someone deposits $100 cash on an inmate s account from the ATM in the jail lobby, the inmate will be credited with $96.75 ($100 minus $3.25 service fee). Similarly, if someone deposits $100 via credit card on an inmate s account from the ATM in the jail lobby, the credit card is charged $110 ($100 plus 10% service fee). Debit Cards: Prior to release, any money left on an inmate s account will be transferred to a debit card. There is no charge to the County for the issuance of the debit cards. After an inmate is released, and prior to performing any transaction with the debit card, an inmate may request a check in lieu of the debit card so long as the request is made within the first three days of receipt of the debit card.
