Married to a fysiotherapist with his own practice Living in rural area in the middel of The Netherlands Owner of 5 horses, 1 cat Former professional cyclist, now running Program Manager, Kadaster Kadaster Land registry and mapping agency Traditional role: safeguarding legal certainty of immovable property Taking up other responsibilities 3

Traditionally: safeguarding legal certainty of immovable property Registration of ownership of geometric networks Objective: to ensure the legal security of ownership of cables and pipelines New: intermediary Information-exchange of underground networks Objective: to prevent damage to cable s and pipelines 4

7 At that time in the Netherlands... Self regulation: Network owners funded the foundation KLIC ( Foundation for Cable and Pipeline Information Exchange ) Request for information by diggers recommended, not obligated No fee for diggers to get network information No legislation 7

11 A long way to go.(2) By the end of 2006: Underground Cables and Pipelines Information Exchange Act Highlights of the act: When digging mechanically > 50 cm: request obligated Request max. 20 / min. 3 days before digging Information is valid for 30 days When expired: new request obligated Network owner: send information < 24 hours to Kadaster 11

Make their applications available and suitable Diggers Obligated to require information Information must be available on site Diggers pay for every request Kadaster Intermediary Finances the development of the Information Exchange application Can charge a fee that will cover the costs, no profit 12

13 The act in detail.(1) Duty of cable and pipeline companies (1.100): register in what area their network (cables, pipelines, connecting devices etc.) are located on top of a uniformed large scale base map inform excavators on request about the location and characteristics of their cable and pipelines in the excavation area 13

14 The Act in detail (2) Duty of the excavator (15.000) (contractor/ service supply agency/ private person) require information from Kdaster to investigate before start to dig and to dig carefully Kadaster acts as intermediary Telecom Agency acts as supervisor 14

15 The Act in detail (3) Two stages of implementation 1. October 1st 2008 A request for information is obligated for every mechanical excavation 2. July 1st 2010 All network owners must be connected to the Information exchange system of Kadaster and deliver the information conform regulations 15

18 Exceptions. (1) 1. Pipelines with hazardous content E.g. Gas, oil, CO2 etc. 2. Security areas E.g. Airports, goernmental pipelines Exception: The network owner does nog provide the digger with the exact location of the network, but visits the site during the digging activities and shows where nót to dig 18

19 Exceptions. (2) 3. Emergency Request by internet (when access on site)or call for information 4. Agricultural business Receive information about location of networks in their agricultural property at no charge from an agency of the Ministry of Agricultural business 19
