3 Introduction In Decision No. D06/11 of 8 July 2011, ComReg designated eircom as having SMP in the market for Wholesale Broadband Access and imposed a number of obligations on eircom in relation to the provision of WBA over both copper-based and fibre-based infrastructure. Section 10.9 of ComReg Decision D06/11 requires eircom to do the following: Pursuant to its obligations of transparency, Eircom shall, within four month of the effective date, publish on its website sufficient information to identify and justify any differences between the services and facilities set out in the WBARO and the comparable services and facilities which Eircom provides to itself. The information shall include all material associated terms and conditions, including relevant processes, and shall be kept updated as new services or facilities are developed and deployed or existing services or facilities are amended. This document is published in discharge of this obligation and includes information concerning the products and services available in the WBARO and the comparable services and facilities which eircom provides to itself for the purposes of offering Broadband services on the retail market, including associated terms and conditions and processes. 3/7

4 Network Access Availability ANNEX WBARO eircom Retail A. Conditions for Broadband Access 1. Network elements to which access is provided: The service includes the connection over the copper pair between the end user premise at the NTU and a DSLAM at the local exchange (Access element) and transport across eircom s network between the DSLAM to the Operator s handover point (Backhaul element). (a) Access element; Different access element products are available: (a) Bitstream IP Access is provided using world-wide standard IP protocols for the transfer of data. eircom Wholesale s Bitstream IP Products range from speeds of 1Mb/s to 24Mb/s on Download and 128kb/s to 2Mb/s on Upload, they are rate adapted and are provided at the 12:1 or 48:1planning ratios. (b ) Bitstream VC Bitstream Virtual Circuits (Bitstream VC) Access includes a connection over an ATM pipe from the Customer premises to an ADSL Regional PoP.. eircom will assign one VC per DSLAM port. Both Variable Bit Rate (VBR) and Unspecified Bit Rate (UBR) categories of service are available. (c) Bitstream MB Bitstream MB includes a DSL port connection capable of delivering either 8Mb and 24Mb at NGN enabled exchanges, and access to dedicated VLANs delivering the aggregated Bitstream traffic over the Operator s BECS. These ranges of profiles provide the Operator with the capability of defining their own product proposition. eircom Wholesale s Bitstream products are accessible under the conditions set out in the relevant Service Schedules in the Wholesale Bitstream Access The service includes the connection over the copper pair between the end user premise at the NTU and a DSLAM at the local exchange (Access element) and transport between the DSLAM to the BRAS for connection to eircom s ISP (Backhaul element). Different versions are used (a) IP based ADSL Access is provided using worldwide standard IP protocols for the transfer of data at speeds ranging from 1Mb/s to 24Mb/s on Download and 128kb/s to 2Mb/s on Upload; they are rate adapted and are provided at the 12:1 or 48:1planning ratios. (b) ATM based ADSL Access is provided over an ATM pipe from the customer premises to an ADSL Regional PoP.. One virtual circuit is assigned per DSLAM port. (c) NGN based ADSL In NGN based ADSL, access includes a DSL port connection capable of delivering either 8Mb and 24Mb at NGN enabled exchanges and a dedicated SVLAN delivering eircom Retail customers' aggregated broadband traffic. eircom Retail assign the profile to the customer. 5 Reference Offer and the Bitstream Product descriptions. (b) element; Backhaul eircom s Bitstream Backhaul service provides access from the eircom BRAS / Edge router to the operator Hand-over Point. Transport is provided between the eircom BRAS/Edge router and the point of connection with eircom s ISP. 2. Information concerning the locations of physical access sites. availability of DSL enabled Exchanges, ADSL 2+ Exchanges, NGN enabled Exchanges in specific parts of the access network; 3. Technical conditions related to access and use; There are two variants: Bitstream IP and Bitstream MB products require Bitstream Ethernet Connection Service Backhaul; Bitstream VC requires Bitstream Connection Service Backhaul. Backhaul is accessible under the terms and conditions of the Backhaul products as set out in Service Schedule 201 and 202 in the Wholesale Bitstream Access Reference Offer and the Industry Process manual. A deployment plan showing all DSL enabled Exchanges, ADSL 2+ Exchanges, NGN enabled Exchanges and the rollout schedule is provided to Operators with regular updates circulated. Handover points to the operator are available within the BECS and BCS Product Descriptions. eircom Wholesale Customer must have an Edge Router/BRAS which is connected to eircom s NTU/CLE. The technical conditions related to access and use of Bitstream are outlined in the Wholesale Bitstream Access Reference and set out in the Service Schedules and the associated Product Descriptions, Process Manuals and Service Level Agreements. Operators have access to a prequal database through the Unified Gateway (UG) which processes the lines capacitance information and on this basis details the suitability of lines, on an individual basis. Based on prequal result, operators put their orders through the UG for provisioning of their preferred product For IP DSL and NGB based products, an Ethernet Connection Backhaul is used. For the ATM DSL based product, IP Connection Backhaul is used. eircom Retail receives from eircom Wholesale updates to the deployment plan showing all DSL enabled Exchanges, ADSL 2+ Exchanges, NGN enabled Exchanges and the rollout schedule. eircom Retail has access to a prequal database which processes the lines capacitance information and on this basis details the suitability of lines, on an individual basis, for the purpose of Broadband provisioning. Based on prequal result, eircom Retail provides customers with the highest broadband speed achievable based on the Specification of the provisioned product. 5/7

Ordering and provisioning procedures, usage restrictions. The interface between the Operator and eircom for the submission of orders and provisioning procedures are outlined in the Industry Process Manual for Bitstream Service (Click here for further information.) There are two ordering options available to an Operator: (i) Web GUI (Graphical User Interface): The operator processes orders via the on line web GUI; and (ii) FTP (File transfer protocol) (Transfer Syntax is XML File Format): the operator sends in all orders via FTP and receives all order status notifications via same. Supply conditions Bitstream Services are provided as set out in the relevant Service Schedules in the Wholesale Bitstream Access Reference Offer. Specific service levels and processes are detailed in the Service Level Agreement and Process Manual for the Bitstream services Access to the single core information and operational support systems, information systems and databases for provisioning and repair is provided through Retail front end systems.
