2 EU Affairs: Getting the best possible EU energy policy Energy business is heavily dependent on regulatory framework: EU energy policy defined by three (conflicting) policy goals: the Energy triangle Priorities are continuously shifting as a result of external effects (Gas crisis, , etc.) Additional complexity added due to: overlap with EU Financial market regulation Axpo = Third country company Energy policy Security of Supply EU Financial Market Regulation Liberalisation Sustainability EU CH relations EU Affairs: Monitors all relevant developments of EU energy policy Provides an analysis of possible impacts on Axpo s operational business Lobbies Axpo s interests with EU stakeholders EU institutions: European Commission EU Government 27 Commissioners responsible for 27 different topics Each one nominated by his home country / Member State But: supposed to represent the interests of the EU and to be completely independent in the performance of their duties Physically located in the Berlaymont building in Brussels ( Berlaymonstre ) Responsible for the implementation of the Treaties Can launch infringement procedures against Member States Has the sole right to propose legal initiatives In total: civil servants Commissioners / Directorate General relevant for energy: o o Commissioner for Energy (Günther Oettinger, DE) / DG ENER Commissioner for Climate (Connie Hedegaard, DK) / DG CLIMA o Commissioner for Environment (Janez Potočnik, SL) / DG ENVI 2

4 EP : Political groups EU institutions: Council of the European Union Represents Members States through their governments The Council, together with the EP is the legislative body of the EU Composed of twenty-seven national ministers: one per Member State according to topic President of the European Council (Herman Van Rompuy, BE) Voting: need for triple majority 50% / 67% of the members states, 74% of the voting weights 62% of the EU population Vital issues: still unanimity Currently: conservative majority Relevant for Energy: Energy Council (~ meeting of energy Ministers) 4

8 Hot topics for CH power industry Preserve LTC LTC are under threat from EU-Commission due to possible anticompetitive behaviour Inter TSO compensation mechanim (ITC) Allow for a fair compensation of CH TSOs for power Transit across CH Unbundling Ensure intergation of CH infrastructure in particular swissgrid whilst respecting non-eu status Capacity allocation & congestion management (CACM) Market coupling and market design are a main driver for further market integration (might shortcut bila) Ensure development of NTC allows for marketing of CH hydro power to Germany / Northern borders Certificates of origin (COO) Level playing field for CH hydro = RES swissgrid v. ENTSO-E / ElCom v. ACER ACER ElCom not member But: ElCom applied for observer status in CEER (Council of European Energy Regulators) ElCom involved on a bilateral basis with other NRAs on Market Coupling Central-West ENTSO-E Swissgrid is founding member but membership depends on sunset clause Might end if unbundling requirements according to 3rd Energy Package are not met 8
