3 Draft law Digitization of the energy transition The Federal Ministry of Economic Affairs has presented in September 2015 a draft of the Law on the digitization of the energy revolution" POLITICAL CONTEXT Status: draft law Consultation process completed in mid-october Entry into force according to current estimations by early / mid-2016 Focus of the law is a new metering point operation law in which all the "Metrology issues" are summarized finally in a single law the installation of smart metering systems and modern measuring devices (formerly: smart meters) is regulated the responsibilities of existing market roles are newly defined specifications for data communication, which have massive direct or indirect impact on the existing market communication of energy are provided 3
4 Objectives of the Law on the digitization of the energy transition BACKGROUND AND OBJECTIVES Background EU targets for the introduction of smart metering systems Cost-benefit analysis: BMWi recommends rollout of smart meters for specific user groups (> 6,000 kwh pa,> 7 kw RES / CHP plants, 14a) Increasing distributed generation needs increasingly intelligent metering systems for data exchange Despite liberalization in 2005 no effective competition in the Metering Market Objectives Digitization Rules Rollout "Intelligent measurement systems and modern measurement devices Strengthen competition in the metrology Bundling legal adjustments under law to: Measurement and Metering Refinancing data Communication data protection Ordinances and BNetzA specifications required Digitization of Energy Law is to provide comprehensive requirements for smart metrology - from rollout to energy data management 4

7 Act on the digitization of the energy transition Distribution System Operator and Metering Operator are on an informational and accounting level to be unbundled Requirements for unbundling to be determined by the Regulation Authority No de minimis exemption OVERVIEW Distribution System Operators transfers responsibility for balancing data to the Transmission System Operator Reduction of approximately 1000 to 4 market contacts Know-how and responsibility transfer from DSOs for TSOs TSOs distributes aggregated data to VNB Rollout schedule for the distribution of smart metering systems / modern measuring devices Default metering operator is responsible for the rollout of smart metering systems Previous rollout scenarios were confirmed (schedule, mandatory installation situations) 7
8 Act on the digitization of the energy transition OVERVIEW Introduction of staggered price caps Precise definition of the cost of smart metering systems and modern measurement devices New cost design provides improved conditions for wmsb Planned future direct contractual relationship between customer and meter operator Charges shall be levied directly between meter operator and the customer Considerable effort for network operators / dmo through implementation in the payroll systems Possibility to tender for the role of basic competent MO at the instigation of DSO In the event that dmo can not realize the rollout within the boundarys of costs and timelines DSOs have to to go for tender until successful award every 2 years Specification of a suitable infrastructure for construction and modernization of energy supply Introduction of binding safety standards for the future to be used measurement and communication technologies and data processing systems 8
9 Act on the digitization of the energy transition OVERVIEW Option ( for the real estate proprietor) for an multi-sector meter operation in buildings Restricted access to competitive offers by the customer (lessee), economic planning security esp. for competitive MSB concerned Risk for the business case of the dmo through third parties In the electricity business parallel market processes for old and new measurement systems System adjustments in all market partners processes e.g. GPKE, MaBiS, WiM, MPES Parallel process mode for transition period required for an undefined period Gas meter is only an appendix to the electricity gateway No further process of harmonization with current possible permanently parallel process mode Specifications for the required and allowed traffic Regulation: who is allowed to collect what data to which purpose and to process and use it Data collection and access only with consent of the customer 9
