1 Process Serving Information Sheet Thanks for your interest in process service through our company. The following information explains some of the processes involved in completing your service: 1. To serve 1 party, we require a minimum $ deposit before the service can be initiated. Credit card (VISA or MasterCard accepted) Cash, if bringing to one of our offices. We do not accept cheques. Billing for services will be taken out of this deposit. Any remaining balance is refunded back to you after completion. Please allow 3-5 business days, after the date of the final invoice, for credit card processing (or, if paying by cash, 15 business days to process and mail the refund cheque to you). 2. For a list of our fees and additional charges, please see the Process Serving Contract Package. 3. We will make every effort to serve your party as quickly as we can. We generally begin with 4 attempts a morning, afternoon, evening and weekend attempt. If we are unable to serve, and it is warranted to continue, we will do another group of attempts. (A maximum of 8 attempts will be made). If we are unable to personally serve the party and we believe that the party is evading, at your request, we will provide you with an Affidavit of Attempted Personal Service. This can then be used to support an application to the court to obtain an Order for Alternative Service which (if granted by the Judge) permits another method of service to be used. (e.g. Post to the Door) 4. An Affidavit of Service is proof for the Courts that the service was completed successfully ($30.00). This includes having the signature of our server witnessed by a Commissioner of Oaths. This document should then be taken back to the court registry where your documents were originally registered, as proof of service to the courts. We can file it on your behalf, but we charge a filing fee. 5. If we are not able to serve your party, at your request, we can complete an Affidavit of Attempted Service ($42.00 min). This document gives a detailed overview of each attempt made and the details surrounding what transpired. This can be used to support an application to the court to obtain an Order for Alternative Service which (if granted by the Judge) permits another method of service to be used. (e.g. Post to the Door). If required, we can explain this option and why it would be helpful. 6. In addition to our process servicing fees, we charge a $16.00 administrative/handling fee for cash or credit clients. 7. Please advise when sending the documents, whether you wish to have the documents returned via: regular mail ($8.00) or by Loomis overnight courier ($15.00 minimum) or if you intend to pick up the final documents from our New Westminster or Vancouver office. Please complete all of the Process Serving Contract Package. Remember to print your name, sign and date the form, and include with your court documents. For Service Information, complete as much as possible and if you are supplying multiple addresses, please identify as home or business and write a 1 beside the service address to attempt first / as priority. You may choose one of the following methods of getting documents to us: Via - scan the PS Contract Package, plus one copy of the court documents to info@wcts.com. In Person - please bring the completed documents attached and one copy of the court documents (if multiple parties, one each) for each service, plus one copy for the Affidavit of Service, if required. West Coast Title Search, Ltd. - Process Serving *** $200 Deposit required for one person / party being served *** $150 Deposit required for each additional person / party being served Rush Fee - $35 (min.) for service attempts made within 24 hours. How to Estimate the Cost: If you require us to make attempts at multiple addresses, and the addresses are listed below in different areas, there will be an additional charge. We will make a maximum of 8 attempts to serve the person/party; if we are unable to serve, you may request an Affidavit of Attempted Service. Serving a Person Any single personal service (or attempted service) per area: $80 Burnaby, Richmond, New Westminster, North Vancouver, Vancouver & West Vancouver $100 Coquitlam, Port Coquitlam, Port Moody, Delta, Surrey, White Rock, Langley (west of 216 St.) & Maple Ridge (west of 232 St.), $35 per Additional Party, served at the exact same time and place $20 per Additional Action, served at the exact same time and place Serving an Office Any service (or attempted service) from West Vancouver to Langley (west of 216 St.) or Maple Ridge (west of 232 St.), $48 on a Law Firm, Financial institution, ICBC, Dept of Justice, Registered Company Offices, Immigration and Refugee Board, Municipal or Provincial Government Offices, or Company offices where documents can be left with someone who is able to accept General Fees $16 Administrative/Handling fee per invoice $30 Affidavit of Service (sworn), per process server / action $16 Certificate of Service $35+ Rush fee (minimum) $1 Photocopies/page, first 10 pages then $0.50/page Additional Services $8 Return completed file by regular mail $ File Certificate / Affidavit of Service in Court after service is completed $42 min. Affidavit of Attempted Service, Detailed Affidavit of Service/Delivery $ Affidavit Notarization $35 Locate from directories or telephone database $35 Locate by physically attending an address $35 Wait time, per 1/4 hour (requires deposit in advance) Payment: We accept Visa or MasterCard. If you do not have a credit card, we will accept a cash deposit and, after the invoice has been completed, a cheque for the remainder of your deposit will be mailed to you within 4 6 weeks. In the event that we are unable to serve the recipient and have exhausted all leads, we will still charge for the attempted service (our labour). We do not accept personal cheques. Processing: Your service will be processed within 48 hours of receipt. Please do not expect our office to have an update before that time. If your service is subject to a technical court deadline, we will process the service accordingly in order to meet the deadline. Completion: We will call you the same day or the following morning when we have successfully served the recipient. We will also provide you with regular service updates, but if you do not hear from us within a week of receiving your file, please do not hesitate to call us at Attempted Service: If we are unable to personally serve the person/party and we believe that the person/party is evading, at your request we will provide you with an Affidavit of Attempted Personal Service, which can then be used to support an application to the Court to obtain an order for alternative service. We will refund any difference between the deposit amount and the final invoice to you. In the event that we are unable to locate the party and have exhausted all leads, we will still charge for the attempted locate (our labour and disbursements). We do not accept personal cheques. 5 Credit Card Receipt: The $200 deposit is charged to your credit card and this document showing authorization # is your receipt. Terms and Conditions & DISCLAIMERS AND LIMITATIONS OF LIABILITY We are a service-oriented firm. Please advise us of your specific needs and we will do everything possible to meet them. If you have a concern, please tell us immediately so we can deal with it promptly. We will do everything we can to assist you in resolving it. FEES The fees listed are the normal ones charged and do not include disbursements or GST. Where extra work is required, our fees will reflect the additional work. West Coast Title Search Ltd. ( West Coast ) reserves the right to change our fees, service charges and disbursement policies without notice. All government fees are subject to change without notice. All invoices should read E & OE - Errors and Omissions Excepted. URGENT FILES Please be specific about the time requirements - Rush, Urgent and ASAP can be ambiguous. If you are sending something urgent by courier, please advise us in advance so we can monitor its arrival. If you are sending us a large, timeconsuming file, especially towards the end of the day, tell us so that we can schedule our staffing to give it the priority it requires. CREDIT POLICY We do not provide credit to non-account holders. Please visit our website to view the list of requirements for account holders. The same applies to damage caused by delay due to traffic accidents, heavy traffic or weather conditions.
