3 Page 3 of 15 A new window will open to this: Click on Browse and select the digital certificate of the attorney whose filing it will be. Digital certificates are located at F://users/IP Dept/EFS Profiles. Password for all digital certificates in LA is xxxxx.

4 Page 4 of 15 Enter password, and click Authenticate. It will take you to this screen: Either certify that you are the certificate holder or working on behalf of the certificate holder (whichever is appropriate).

5 Page 5 of 15 Choose Existing application/patent. Enter application and confirmation numbers and click Continue.

6 Page 6 of 15 Click on Browse to upload your amendment. Be sure that the document is a.pdf and that there are no spaces in the file name (for example, name the file ClientAmendment or Client_Amendment, NOT Client Amendment). Your amendment will be a multi-part document. Underneath where you have uploaded the file, click in the circle indicating Yes to Does your PDF file contain multiple documents?

7 Page 7 of 15 The category will be Amendment for all of the parts of the document. The Document Description for the first part of the document will be Amendment/Req. Reconsideraton-After Non-Final Reject if you are responding to a non-final office action. It will be Amendment After Final if you are responding to a final office action. The Document Description for the following parts of the amendment depends upon what parts of the application are being amended: they will be Claims, Specification or Drawings in the order in which the sections appear in the amendment. The Document Description for the Remarks will be Applicant Arguments/Remarks Made in an Amendment. Each section must be defined and the Page Start and Page End numbers indicated. Click Upload & Validate when you have uploaded and described all of the documents to be filed.

8 Page 8 of 15 The ideal is to have the blue diamond next to all validated documents, which means that there are no errors. Documents with a yellow, upward-facing triangle will allow you to proceed with the filing; it merely indicates a minor irregularity, like the fact that you are using your own form rather than a standard USPTO form. Documents showing a red, downward-facing triangle will not be accepted by the system and there is an error that must be corrected. Once all of the documents display a blue diamond or a yellow triangle, click on Continue.

9 Page 9 of 15 The next screen you see will be the payment screen, where you can pay any of the fees you might need to pay. The most likely fees in an amendment will be for an extension of time (see below). If you are filing a response to a Final Office Action, it is likely that you will also need to pay the fee for a Request for Continued Examination (RCE). That fee is located under Miscellaneous Patent Fees. When you have selected all of the fees that you need to pay, click on Continue.

10 Page 10 of 15 Next, you will see a screen that summarizes the documents that you have uploaded and the fees that you have chosen to pay. This is your last opportunity to review the documents to be sure that everything is present and correct. When you are certain that everything is correct, click on Submit.

11 Page 11 of 15 Click on YES! I want to pay now. There are very few situations in which you would not want to pay fees.

12 Page 12 of 15 Choose Charge USPTO Deposit Account (unless you have been instructed to pay by some other method). Click Start online payment process.

13 Page 13 of 15 You will be taken to the screen in which you enter the Deposit Account Number (502638) and the Account Access Code (2220). Affirm that you are acting on behalf of the filing attorney and select from the drop down the attorney whose filing it is and authorize the payment of all fees except for post issuance fees.

14 Page 14 of 15 Click on YES! - Charge Deposit Account Now, which will take you to the acknowledgment screen, detailing what has been filed and in what case.

15 Page 15 of 15 Print and save your filing receipt. Be sure to report the filing to LAIPMail and any charges to the Deposit Account to the Docketing Manager.
