2 March 18, 2010 File: A Re: Stakeholder Information Session Lakeshore Drive Upgrades - Stage 2 Dear Sir/Madam: The Town of Sylvan Lake will be holding a Stakeholders Information Session on April 8, 2010 at 7:00 p.m. at the Town Hall. This session will provide information regarding the constrl.lcticm upgrades along Lakeshore Drive from Wildrose Drive to 34 Street. Items of discussion will include cch)structibn schedule, signage, roadway access and closures. There will be 45 minute presentation followed by a 1 hour question and answer period. Comments from the January 27,2010 open House have been tabulated and incorporated where applicable. 9 ADMINISTRATION REPORT TO: FROM: DATE: SUBJECT: Helen Dietz, Mayor & Council Rae-Anne Ornella, Financial Services March 17,2010 Business License Bylaw Amendments 1.0 PURPOSE: For discussion and direction from Mayor and Council on amendments to the Business License Bylaw # 1392/ BACKGROUND ITEM #1 Mobile Vending At Council Committee on April 27, 2009 discussion was held around potential locations for mobile vendors on Lakeshore Drive and ifthis type ofactivity is necessmy. ACTION Bring forward on amendment to the Business License Bylaw to permit busking and street peliormers only. ITEM #2 Prorated Business License Fees A common question from a new business owner who is purchasing a business license past the beginning of the new year is "does the Town have a reduced rate for the business license fee?" In particular this is requested in the latter palt of the year when someone will only have their business license for a couple ofmonths before they have to pay the full fee again to renew. 3.0 DISCUSSION ITEM #1 Mobile Vending Mayor and Council can consider the following options with regards to mobile vending. Adm Report for Council Committee Business License Amendments.doc

10 OPTION 1 Delete Section 13 (b) (vii) (i)(ii)(iii) and replace with the following: "Hawkers/Peddlers, Mobile Vending Units and Push Cali Vending Units may not operate within the Town of Sylvan Lake." OPTION 2 Amend Section 13 (b) (vii) by adding the following: HawkerslPeddlers, Mobile Vending Units or Push Cart Vending Units may be permitted at locations approved by the Town on public or private property. Permission will not be granted to Hawkers/Peddlers, Mobile Vending Units or Push Cart Vending Units where a conflict with an existing business is evident. Where a conflict arises with an existing business, the Town reserves the right to relocate the vendor. OPTION 3 Amend Section 13 (b) (vii) by adding the following: HawkerslPeddlers, Mobile Vending Units or Push Cart Vending Units are not permitted to operate on Lakeshore Drive between 40 Street and 50 Street. ITEM #2 CD Prorate Business License Fees Mayor and Council can consider the following options with regards to prorated business license fees. OPTION 1 Any business which commences business in Sylvan Lake on or after January 1 and has not previously been in operation in Sylvan Lake will pay a prorated amount ofthe appropriate business license fee provided for in this bylaw, which amount shall be prorated on a monthly basis. OPTION 2 Any business which commences business in Sylvan Lake on or after January 1 and has not previously been in operation in Sylvan Lake will pay a prorated amount ofthe appropriate business license fee provided for in this bylaw, which amount shall be prorated on a halfyear basis. 4.0 FINANCIAL IMPLICATIONS Adm Report for Council Committee Business License Amendments.doc 2

11 5.0 ALTERNATIVES 6.0 SUMMARY ITEM #1 Mobile Vending If taking into consideration the removal of Hawkers/Peddlers, Mobile Vending Units and Push Cart Vending Units it should be noted that some vendors that have previously existed in Town and which there has been little to no problems with are the Fresh ChelTY Vendor located at Petro Can and Hot Tub Vendor located at the Extra Foods parking lot in to name a few. ITEM #2 Prorate Business License Fees Using a monthly prorated business license fee system would be welcoming to new businesses that stat1 operating in Sylvan Lake as they would only be charged for the months that they operate in their first year and not a full year fee. The financial database for the Town is set up to accommodate a prorated system therefore causing no added expenses. 7.0 STAFF RECOMMENDATION That Mayor and Council provide direction on the amendments of the Business License Bylaw #1392/2006.
