OPEN FORUM Jack Tunstill, th Way, Seminole Mr. Tunstill is frustrated by the administrative process related to distribution of meeting agendas and minutes. He does not feel this information is being made available to the public on the City s website in a timely manner. He also does not feel the Committee has been provided ample time to review the minutes before approving them at their meetings. Mr. Tunstill requested this information be prepared in a more timely manner. Chair Morris shared Mr. Tunstill s frustration. In speaking with a City Councilmember recently, they expressed being extremely irritated by the lack of support from City officials and staff related to the airport review process being followed versus what the Task Force was originally charged to do. Chair Morris felt that the June 29 th Design Committee Meeting was not conducted properly, and the voting that occurred should be considered null and void. Mr. Stroud and Mr. York emphasized that the recommendations which were voted on and passed by the Design Committee have subsequently been submitted and voted upon by the full Task Force. It should be noted that Committee recommendations that were previously voted down can be brought back to the Design Committee for reconsideration. Mr. Morris received a request from Dr. Eric Whitted, 238 Sunset Drive South, St. Petersburg, to speak at the end of the Design Committee Meeting. Discussion followed. Motion made to maintain the current Open Forum policy which allows the public 15 minutes to speak at the beginning of all Albert Whitted Airport Meetings. (M. Stroud); Motion seconded (M. Murphy). Ayes: Murphy, Stroud, Van Kesteren, York Nayes: Lange, Morris, Varn 4-3 Motion passed. Approval of Minutes.
2 Motion made to defer approval of the July 8, 2004 Minutes until the next Design Meeting. Motion carried. Ayes: 7 Nayes: 0 Motion passed. NEW BUSINESS Avigation Easement Mark Winn, Chief Assistant City Attorney Mr. Winn explained as a property owner you have a right to the navigable air space above your property. In the case of an avigation easement, the property owner waives this right (generally in exchange for compensation) to litigate regarding air traffic (noise) in that air space. An avigation easement attempts to protect the Airport from future noise complaints from new property owners moving into the area. It provides the City the right to own that flight path compaint free. Mr. Lesniak explained that St. Pete/Clearwater Airport established an avigation easement based on noise contours (DNL: Decible Noise Levels) that measure noise levels around the airport. The flight path is a determining factor, but what the FAA considers incompatible from a noise level, doesn t extend beyond the runway system for that particular airport. Ms. Varn handed out a St. Pete Times article related to high-rise development in the downtown area. She addressed 3 main components of an avigation easement: 1) requires noise level reduction materials in building design within specified distance from the airport; 2) property owner allows the use of air space above his property; and 3) property owner agrees airplanes make noise. Agreement is between City and developer. The County version affords the builder the right to sue for acts of negligence and other things unrelated to noise and over flights. Does not handicap the builder. Dave Metz explained that any analysis or evaluations regarding avigation easements is not typically part of a Master Plan Update scope. From a legal perspective, at the current level of activity, Mr. Winn does not see the City having any liability issues related to noise or airport operations, and the need for an aviation easement is not required. Mr. Morris stated that due to the tremendous residential growth planned for downtown, and considering the recommendations being proposed by the Task Force, in his opinion it would be in the City s best interest (as a protective measure) to implement an avigation easement. Mr. Winn stated that depending upon what the Task Force recommends to City Council and if the level of air traffic does significantly increase, the City should consider this. If there was probability for liability, and there is an opportunity to reduce that liability, Mr. Winn felt the Task Force should consider this. Ruth Varn made the following motion The Task Force recommends that the Master Planning process consider the feasibility of some form of avigation easement to afford protection for Albert Whitted Airport. Motion seconded. Discussion followed. As a point of clarification, Mr. Lange s original recommendation regarding avigation easement referred to all new development. Mr. Van Kesteren amended the motion as follows: The Task Force recommends that the City Council and Mayor determine the feasibility of some form of avigation easement as it pertains to new construction. 2
3 Ayes: 7 Nayes: 0 Motion passed. Chair Morris noted that it will not be necessary for Mr. Winn to return with additional information. Zoning & Environmental Committee Recommendations In a letter from Mr. Lange, he requested that the Design Committee not discuss the Zoning & Environmental Committee Goals & Objectives, which were previously voted down by the Design Committee until he was present for those discussions. Mr. Lange requested the following Goals & Objectives (submitted by the Zoning & Environmental Committee), which were voted down at the June 29 th Design Committee Meeting, be brought forward at the July 26 Task Force Meeting for reconsideration: Goals: 4. The Task Force recommends that should the Mayor and City Council choose to establish an ongoing task force to give advice and made recommendations to the Mayor and City Council, that the members for this ongoing task force be chosen equally from the Advisory Comittee, Albert Whitted Airport Preservation Society, Albert Whitted Airport Blue Ribbon Task Force Committee, and members from the public. 5. The Task Force recommends that the Mayor and City Council set out a published schedule of dates and deadlines for the completion of specific phases of redevelopment at Albert Whitted Airport (i.e. consideration of any studies, study of runway extensions, mitigation, permitting, master planning, and architectural/engineering drawing times). Objectives: 12. The Task Force recommends that the three roads surrounding Albert Whitted Airport be renamed and identified with appropriate honorary signage as follows: 8 th Avenue South and National Airlines Avenue 1 st Street South and Benoist Boulevard The entrance leading into the parking lot and main entrance into the new terminal building be called Albert Whitted Way 14. The Task Force recommends that all new building development be constructed with conventional construction materials without metal-skinned exterior walls. 15. The Task Force recommends that any new building development be designed in the Art- Deco architectural style, and that the entire airport redesign be similarly disposed such that an overall and consistent appearance be given to all airport improvements. 17. The Task Force recommends that the City study constructing a new three-level parking garage for airplanes and/or cars located where the current metal T hangars are generally located. The first level would house airplane maintenance facilities as well as larger corporate and non-corporate planes. The second level would park smaller planes, and the 3
4 rooftop level would park airplane tie-downs and/or cars. The building would be built above the flood plain and designed in compliance with the Florida building code for storage-type facilities. Access to the second and third levels would be by a large airplane lift or elevator. Access for cars to the third level would be by circular up and down ramps located on Port land just east of the Port terminal building. 21. The Task Force recommends that the airport property be brought into full compliance with the local City landscaping ordinance. 27. The Task Force recommends that applications be prepared and submitted such that hangar #1 and the attached office side wings be designated as a nationally registered historic building and a locally designated historic landmark. 28. The Task Force recommends that the word Municipal be dropped from the airport name and that the airport name should simply be Albert Whitted Airport. 29. The Task Force recommends that once a new FBO facility is constructed, that hangar #1 and office side wings be converted into a flight museum replete with historic airplanes and aviation memorabilia. 30. The Task Force recommends that once a flight museum and/or an aviation museum/education center are constructed at Albert Whitted Airport, that the historic aviation materials and displays currently housed at the St. Petersburg Historical Museum be considered for relocation to one or both of the new Albert Whitted Airport museums. 31. The Task Force recommends that the attached Albert Whitted Airport Buildable Areas Site Plan become the basis of all Albert Whitted Master Planning processes. Motion made to take the above listed Goals and Objectives, as written by the Zoning & Environmental Committee, which were previously voted on and rejected by the Design Committee, back to the Task Force for reconsideration (M. Stroud); Motion seconded (M. Murphy). Ayes: Murphy, Stroud, Varn, Van Kesteren Nayes: Lange, Morris, York 4-3 Motion passed. Final Review and Editing of Task Force Recommendations The Task Force Chair is requesting that the next couple Task Force Meetings begin the final edit of the approved recommendations and agreeing on a concept plan that visually shows what the Airport looks like based on these recommendations in order for The LPA Group, Inc. to begin preparing the final report. The recommendations section of the Final Report will include a timeframe for implementation and costs. A draft report will be distributed to City Council for the September 16 th presentation. The final report for public distribution by October 1 st. The Task Force Chair would like the Design Committee to assist in consolidating and editing the recommendations. Mr. Lesniak distributed a copy of the Task Force Recommendations. A copy will also be distributed to the entire the Task Force 4
