South Florida Water Management District, et al., Case No.: 2013-CA-1321 Public Records Search The County received the Arbitrator s Decision prepared by arbitrator Howard E. Googe, Esq. on February 15, Since neither the County nor the Plaintiffs requested a trial de novo regarding the Arbitrator s Decision, that decision has become final. In anticipation of an order or judgment being entered by the Court implementing that decision, the County has begun to take steps to fully comply with the Arbitrator s Decision. Among other things, the Arbitrator s Decision concludes that a writ of mandamus should be issued requiring the County to fully produce any and all public records sought by Lake Point in Exhibit D to the Third Amended Complaint, including from any private accounts used by County Commissioners to conduct public business not previously produced. For your reference, I have enclosed with this letter a copy of the public records requests found in Exhibit D to the Third Amended Complaint. Although a number of searches have previously been conducted, in order to provide final assurance to the Court of compliance with the writ of mandamus, we have developed a procedure to confirm that all potentially responsive records have been produced. 11 Questions on Public Records Request Involving Personal Electronic Communications RFS: ###### Name: Date: In order to assure we have complied with an anticipated Court order, the County is collecting documents potentially responsive to the attached records requests identified as Exhibit D. Please provide responses to the questions below, so the County can confirm that we have identified all potentially responsive documents: 1. 12 Questions on Public Records Request Involving Personal Electronic Communications RFS: ###### Personal communications search: 1. If the answer to question two (2) on page one is YES, the Public Records Liaison (PRL) will arrange a time for the Records System Administrator (RSA) to meet with you to begin the copy of all from your personal account(s) onto an external drive to enable a subsequent refined search for any responsive records. The following will apply: a. The copy will require a minimum of two (2) hours (It could be longer, as this is based on the total number of s in your account) to complete and the RSA will perform the copy at your location of choice: i. Your desk ii. Learning Lab iii. Another location of your choosing b. You will personally enter your login and password to your personal account. c. Please plan to remain with the RSA during the procedure. d. The RSA will place the copy of all from your personal account onto a secure location. 2. When the copy is complete, the RSA will then return to ITS to perform the search for potentially responsive records. In reviewing the potentially responsive records identified by the search, the RSA will move responsive records to a responsive folder on the secure external drive. 3. When RSA has completed his initial review of the potentially responsive records, the RSA will deliver the external drive to the PRL for further review. 4. The PRL will again review the records to ensure that all records in the responsive folder are responsive. Any nonresponsive records found in the responsive folder will be moved to the nonresponsive folder. Likewise, any responsive records found in the nonresponsive folder will be moved to the responsive folder. 5. When the PRL has completed her review, the PRL will deliver the external drive to the County Attorney s office for further review of all records. 6. Once the County Attorney has completed the review, the RSA will move all responsive County records to the appropriate public records folder, as read only. 7. A copy of the responsive records will be provided to you upon request. 8. The PRL will release the responsive records to the requestor with all other responsive records. 9. The RSA will disposition all data on the external disk related to this request in accordance with applicable Court order(s) and law. { } Page 2 of 2 12 of 12
