4 - BD4C Licensing Program (License Scheme) - BD4C License covers BD Products as well as the DVD portion in BD Products such as Players, Drives and Recorders which have DVD function as backward compatibility under the single form agreement. 5 - BD4C Licensing Program (Licensing Terms(1)) - (1) Licensed Products : BD Products conforming to BD Standard Specifications and, as applicable, DVD Standard Specifications (2) Licensed Patents : Essential BD Patents and, as applicable, Essential DVD Patents. Essential means necessarily infringed when implementing the BD Standard Specifications or, as applicable, the DVD Standard Specifications or claiming technologies for which there is no realistic alternative in implementing those Standard Specifications. (3) Grant of License : A non-exclusive, non-transferable, worldwide license (w/o any sublicense right) to make, have made, use, import, offer for sale, sell and otherwise dispose of BD Products to be granted Copyright Toshiba

6 - BD4C Licensing Program (Licensing Terms(2)) - (4) Royalty Rates : Pls. see the pages 7-8 hereof (5) Report & Payment : - Report : Within 45 days after each semi-annual period ending Jun. 30 and Dec Payment : Within 90 days after each semi-annual period ending Jun.30 and Dec Back royalty : It shall be calculated by applying the royalty rates of the pages 7-8 hereof to the number of BD Products sold by Licensee prior to the effective date. (6) Term : The Term of the license shall continue through December 31, 2017, with fiveyear automatic extensions thereafter subject to Licensees right to terminate at the time of each extension. (Note) Interested parties are also free to negotiate separate license agreements, rather than taking a single portfolio license agreement, with each of the member companies. Copyright Toshiba

10 Administration of Licensing Program (1) - Independence & Neutrality - To secure independence of Licensors and for avoidance of Licensors access to the sensitive business information contained in the royalty reports under the Patent License Agreement, through the use of TDLS, BD4C Licensing Group has already set up a firewall (1) Company Name & Address : from its initial period. 1.
