2 Infrared Data Association s (IrDA) Philosophy on Trademarks and Brands IrDA's trademarks, certification marks and brands ( Marks ) are IrDA s Intellectual property and are important and valuable assets of the association. These Marks must be used properly. While certification marks are acknowledged by the IrDA as being a type of trademark, their somewhat unique nature may compel the IrDA to enforce unique rules related to them as compared to traditional trademarks. Follow these Guidelines for using IrDA's and others' trademarks and brands properly in internal and external communications, documents and electronic messages. Who Do These Guidelines Apply To? These Guidelines apply to IrDA employees, members, licensees, consultants, outside vendors, and other third parties. If you are an authorized user of an IrDA trademark or an owner of a product registered to use IrDA Marks, your agreement that you signed with IrDA may have trademark usage guidelines. Please follow these guidelines. Using IrDA s Certification Trademarks Products that use IrDA Certification Marks must successfully complete testing by an IrDA Authorized Test Lab. You may refer to IrDA products by their associated IrDA trademarks, so long as such references (a) are truthful, fair, and not misleading, and (b) comply with these Guidelines, which may be modified by IrDA from time to time in IrDA's sole discretion. Specifically: Follow the internationally recognized and established Trademark Golden Rules. Use the appropriate trademark symbol and trademark acknowledgment of IrDA's ownership of the Marks in question. Do not incorporate IrDA Marks into your own product names, service names, trademarks, logos, or company names, and do not adopt marks that are confusingly similar to IrDA's marks. Do not make unauthorized use of IrDA's marks. Third party usage of specific IrDA marks requires a license or written permission from IrDA. If you are interested in using an IrDA Mark, contact the IrDA office. The Trademark Golden Rules The Trademark Golden Rules are internationally recognized and applied worldwide. The appropriate trademark symbol should be used with each of IrDA's trademarks for consistency. 1. ALWAYS use a trademark as an adjective or adverb, accompanied by an APPROPRIATE noun or verb. Do not use a trademark as a noun. Do not pluralize a trademark or make it possessive (which would be using it as a noun). Do not join a trademark to other words, symbols, or numbers, either as one word or with a hyphen. And do not abbreviate a trademark. 2

In letters, memos, press releases, white papers, advertising, slides, video, and other multimedia presentations: A. Properly designate (with, or SM ) all of IrDA's trademarks at the most prominent use (usually a headline) and again on the first occurrence in copy. B. In the case of presentation graphics, trademarks should be designated with the proper trademark symbol on each page.. ALWAYS use trademarks in the ways they were intended to be used. Do not use trademarks for goods or services for which they were not originally intended. Do not alter them in any way. Do not make puns out of them or portray them in a negative light. When establishing global standards for infrared data transmissions, the Infrared Data Association at times may encounter trademark and certification mark ("marks") issues that stem from language and/or cultural (usage) translation discrepancies. In such circumstances, licensees and/or certified users of IrDA marks are obligated to make their best efforts at compliance with the "Infrared Data Association Trademark, Certification Trademark and Brand Guidelines" and the "Golden Rules" contained therein. In the interest of maintaining the strength of its Marks, the Infrared Data Association will routinely accept the opinion from its foreign licensees and certified users that such best efforts have been made. Do not convert or translate trademarks into foreign languages. If special consideration is needed, contact the IrDA office for assistance. Devices that implement the IrSimple Profile specification must be certified in accordance with the IrDA requirements for certification and must use the appropriate certification word mark. It is a necessary pre-condition of the trademark regulations when the IrSimple profile is implemented. IrDA Trademarks and Certification Marks Qualification is necessary step in order to use any of the IrDA trademarks with a product. Qualification must be performed by an Infrared Data Association approved Test Lab*. IrDA qualification uses testing standards for all products that use the IrDA wireless technology. There are three distinct certification processes: IrReady certification for devices that implement IrDA Classic IrSimple certification for devices that implement bi-directional IrSimple certification for devices that implement uni-directional It is the responsibility of the company requesting certification to select which certification test sets they want performed. In order to select the right specification to implement for your device, please review the Infrared Data Association Technology Selection Guide. If your device contains ONLY the IrSimple Bi-directional protocol, please indicate this type of implementation in your product s documentation. 4

5 Example: (Product Name) implements only the bi-directional protocol of the IrSimple Profile Specifications. Completing the certification process for the IrDA trademark or the IrDA qualification does not guarantee that a product fully complies with the IrDA specification or is interoperable with other IrDA enabled designs and products. That remains the responsibility of the product manufacturer. 5

6 The following are marks relating to the Infrared Data Association. These marks require permission for use from the Infrared Data Association. IrSimple IrSimpleShot IrSS IrSimple is a word brand name (certification trademark) which indicates a device contains both IrSimple uni-directional and bidirectional transmission protocol. Devices using this brand name are required to be certified by an IrDA Authorized Test Lab and registered with the IrDA Office. IrSimpleShot (IrSS) is a word brand name (certification trademark) which indicates a device contains the IrSimple uni-directional transmission protocol. Devices using this brand name are required to be certified by an IrDA authorized test lab and registered at IrDA Office. When the product uses IrSimple uni-directional protocol and functions only as a secondary communication device, you must indicate in your product specifications that the device supports secondary unidirectional communication only. IrSS is a word brand name (certification trademark) which is the abbreviation of IrSimpleShot. Devices using this brand name are required to be certified by an IrDA authorized test lab and registered at IrDA Office. IrReady Font: Impact, Bold The Basic Feature Trademark is used to indicate that the product has an implementation of the IrDA feature and can perform infrared data transfer based on our standard specifications (IrPHY, IrLAP and IrLMP). This was used with legacy products and is no longer used. The IrReady Certification marks are used to indicate that the product has been tested by an IrDA authorized Test Lab for interoperability and will work with similar types of devices also tested for interoperability based on our IrDA Classic specifications, not IrSimple specifications. Devices using this brand name are required to be certified by an IrDA Authorized Test Lab and registered with the IrDA Office. The following marks do not require a permission to use but proper trademark rules for usage apply. The IrDA Service mark is authorized for use in association administrative, technical and marketing communications. Members can use this mark when combined with the word Member of to indicate membership in IrDA. Infrared Data Association, IrDA IrFM, IrMC,, IrPHY,, IrLAP,, IrLMP,,IrTran-P,, IrWW,, IrPNP,, IrPNS,, OBEX, IrCOMM, IrLAN, IrBurst, Giga-IR, Ir-USB The official word marks for the association name. These are abbreviations for IrDA Specifications and normal usage rules apply. 6

7 ACQUIRING AUTHORIZATION FOR TRADEMARK USAGE All products using the IrDA certification marks IrReady, IrSimple and IrSimpleShot, IrSS must be tested and certified by an authorized test lab. The test lab will provide the manufacturer s name and product information to the Infrared Data Association. Manufacturers using these marks must submit a completed IrDA Certified Product Trademark Authorization form (Appendix A) to the association. Members: Upon receipt of the IrDA Certified Product Trademark Authorization Form, the association will acknowledge in writing within one week the permission to use the requested trademark and will provide an authorization number. The Authorization form needs to be filed with the association prior to using the trademark unless specifically given other instructions. Non-members:Use of the trademarks is free for Infrared Data Association members. Nonmembers are required to pay a fee for each product using a trademark. The Infrared Data Association will invoice non-member companies. Once the Authorization form is approved, an authorization number will be provided. ACQUIRING PERMISSION FOR EARLY TRADEMARK USAGE The Infrared Data Association authorizes access to IrDA trademarks while the product is in the process of qualifying at the test house by submitting IrDA Early Access for Trademark Use form (Appendix C). This early trademark usage is a temporary permission. Upon receipt of qualification from the test house, the company needs to submit the official IrDA Certified Product Trademark Authorization Form (Appendix A). QUESTIONS? 15 IrDA IrSimpleShot Product Certification Process IrDA requires product qualification for consumer devices that will use any of the IrDA IrSimple branding certification marks. The following are certification marks owned by IrDA. Manufacturers need to register their products with IrDA to obtain authorization for the use of the certification marks. IrDA IrSimple Marks: IrSimpleShot IrSS IrSimple Manufacturers may submit a product for certification to any IrDA Authorized Test Lab. The Test Lab will perform the relevant tests for the intended functions of the device. The certification process is as described below. 1) Manufacturer submits production samples of a product, as well as any documentation required to the IrDA Authorized Test Lab. 2) The Test Lab designs a test plan based on the appropriate usage models and application profiles that apply to the device. The Test Lab performs all tests. 3) The Test Lab evaluates the test results to ensure relevant and required tests were passed. A. If passed; continue with step 4. B. If failed; the Test Lab determines if the failure requires the client to revise the product to correct the failure. If it is a design failure (hardware/software), then the product is returned to the manufacturer with the results and recommendations. If revising the product is not necessary, the test lab can submit only the failed data to the Test Council for assistance in resolving. The Test Council has no more than 5 working days to review the failed data and recommend the proper action to be compliant or create a waiver. 4) The Test Lab extends an IrDA Qualification Certificate to the manufacturer. The certificate includes the Test Lab s name, the manufacturer s name, products DUT number, and product s name and version number. 5) The manufacturer submits the IrDA Certified Product Trademark Authorization Form (Appendix A). 6) The IrDA office authorizes the use of the IrSimpleShot certification marks on the registered products. IrDA adds the product to the IrDA Product Data base at when it is officially announced. Non-members must pay a use fee before authorization is given. 15
