The complaint was not ed to Bent Tree operations staff at the time the alleged noise issues and thus staff were unable to perform real-time investigation. Bent Tree operations staff were unavailable to perform a real-time investigation but reviewed operating data and weather data during the time period addressed in the complaint. That data indicated that the turbines were operating normally and would not be expected to exceed noise standards. In addition, based on the 2011 and 2014 noise studies and analyses ordered by the Commission and performed by, operations at Bent Tree do not exceed Minnesota noise standards as reflected in the permit. No further action taken. 04/15/16 Greg Kaelberer Bernie and Cheryl n/a Noise Cheryl called Greg Kaelberer's desk phone regarding a noise complaint at 1:44 PM. She stated that she was having problems with her ears and that she was forced to go back to town. All turbines were working within normal operating parameters when checked at 1:50 PM via the VOB control system. At 1:55 PM, Staff visited turbines upwind and near to the property T397, T357, T312, and T358. Upon physically inspection, all turbines were producing normal sound levels. Winds were at 10.5M/sec. Based on the 2011 and 2014 noise studies and analyses ordered by the Commission and performed by, operations at Bent Tree do not exceed Minnesota noise standards as reflected in the permit. No further action taken. 04/16/16 Greg Kaelberer Bernie and Cheryl n/a Noise aint received by voic on Mr. Kaelberer's desk phone on Saturday 4/16/2016 at 6:25 AM. Mr. stated that the wind turbines kept them awake through the night and asked that the turbines around their home be shut down. Turbines were verified to be operating normally both through the VOB control system logs and per turbine visits conducted the afternoon prior to the complaint as part a previous investigation. Based on the 2011 and 2014 noise studies and analyses ordered by the Commission and performed by, operations at Bent Tree do not exceed Minnesota noise standards as reflected in the permit. No further action taken. 04/18/16 Greg Kaelberer Bernie and Cheryl 04/19/16 Greg Kaelberer Bernie and Cheryl n/a Noise Natalie Ries, MN Permit iance Coordinator, received three s from the s through out the day Monday, 4/18/2016 at 9:33 AM, 10:01 AM, and 5:15 PM reiterating the two aforementioned complaints that Mr. Kaelberer had received via voic on 4/16/2016 and 4/18/2016, and also referencing turbine noise and ear pain and pressure experienced by Mr. and Mrs. on 4/15/2016 through 4/18/2016. Ms. Ries forwarded the s to Alliant Energy Legal Services on 4/18/2016. The investigation performed by Bent Tree personnel on April 18 addressed the complaints. Based on the 2011 and 2014 noise studies and analyses ordered by the Commission and performed by, operations at Bent Tree do not exceed Minnesota noise standards as reflected in the permit. 8 05/12/16 Greg Kaelberer Dave Langrud th Ave Alden, MN n/a Noise Natalie Ries, MN Permit iance Coordinator, received a complaint via on 5/11/2016, at 5:02 PM from Dave Langrud. The contained a document sent to the State Minnesota Public Utilities Commission, dated 5/11/2016. responded to Mr. Langrud's complaint in writing on May 18, In his letter, Mr. Langrud stated that failed to adequately respond to his February 2011 complaint concerning TV inference, shadow flicker, and noise. As noted in 's response, that complaint was submitted approximately four years ago. Records indicate that responded to Mr. Langrud s TV interference complaint by providing mitigation. responded to Mr. Langrud s shadow flicker complaint by purchasing blinds for his residence. With respect to noise, at that time s consultant was preparing the sound study ordered by the Commission under the Siting Permit. In March 2011, the Commission approved the sound monitoring protocol submitted by. In May, Mr. Langrud was assigned a payment from for a wind easement on Parcel No (Tract D). In June 2011, submitted the results the monitoring study to the Commission. As with the modeling results used to site the turbines, the monitoring results showed that Project operations comply with noise standards in the Permit. Taken together, these circumstances indicate that Mr. Langrud s noise, TV interference, and shadow flicker related complaints had been sufficiently resolved in In addition, Mr. Langrud asserted in his complaint that one 's turbines was located less than the minimum setback distance 1,000 ft. Because Mr. Langrud is a participating landowner in the Bent Tree Project Phase I, the property line rotor diameter setback distance for prevailing and non-prevailing wind directions not apply. Instead, the residential setback distance 1,000 feet governed the siting Turbine 362 in relation to Mr. Langrud's residence. Turbine 362 is 1,143 feet from Mr. Langrud's residence, in excess the 1,000 ft. setback. Mr. Langrud's letter also references sound levels from the west/ south west on an unspecified date. Without more information, and as noted in 's response, it was difficult for Bent Tree personnel to perform an investigation this noise complaint. Nevertheless, reviewed turbine operating data and weather data on Thursday, May 12, within one day the date Mr. Langrud's letter. Bent Tree personnel also conducted a site visit to the turbines near his property.
