PUBLIC SERVICE COMMISSION OF WEST VIRGINIA CHARLESTON GENERAL ORDER N In the Matter of the Effects on Utilities of the 2017 Tax Cuts and Jobs Act \;?;pa A;&.\h -~:=- :.*- ~ k.-:=.-.-- : bi-kr. %.=?<~....i.d j ~ I -2 NOTICE OF INTENT TO PARTICIPATE Comes now the Kanawha County Commission ( County Commission ), by counsel, and the City of Charleston ( Charleston ), by counsel, and respectfully submits this Notice of Intent to Participate in the above referenced proceeding. In support of this Notice the County Commission and Charleston state as follows: 1. On January 3, 2018, the Public Service Commission of West Virginia issued an Order initiating a General investigation into the effects that the 2017 Federal Tax Cuts and Jobs Act ( TCJA ) would have on West Virginia privately-owned utilities. 2. On or about May 30th, 2018, several utilities filed Direct Testimony in the above referenced matter indicating that, in total, the TCJA will result in hundreds of millions in savings for privately-owned utilities in West Virginia. 3. County Commission is a political subdivision of the state of West Virginia, charged with the superintendence and administration of the fiscal affairs of Kanawha County. W. Vu. Const. Art. IX, 11; W. Vu. Code Further, County Commission is a public entity that represents the residents of Kanawha County, especially the residents of the County s large unincorporated areas. Similarly, Charleston is also a public entity that represents the residents of the City of Charleston and pursuant to WV Code (48), Charleston has the power to investigate and inquire into all matters of concern to the municipality

3 or its inhabitants. Both the County Commission and Charleston consistently strive for public transparency. In this matter, County Commission and Charleston seek to further inform the public concerning the enormous savings that privately-owned utilities will realize from the TUA. 4. The cost of utility services -- particularly electric, gas, and water -- are a significant matter of public concern to thousands of individuals, businesses, and commercial utility service users in both Charleston and Kanawha County. In particular, rising utility rates are a constant matter of concern to many residents and their families, as the costs of utility service have risen at a rate that significantly outpaces increases in wages, salaries, and social security payments. 5. County Commission and Charleston both strongly believe that the proper course of action is for the privately-owned utilities to find a fair and reasonable means to return the enormous savings resulting from the TCJA back to the ratepayers in the form of reduced costs of utility service, monthly bill credits, or other rate reductions. 6. For the reasons above, County Commission and Charleston submit this Notice of Intent to Participate and further intend to file a Response to the Direct Testimony submitted by the privately-owned utilities. 7.
