Horner Senior Assistant City Attorney Law Department City of Overland Park 8500 Santaa Fe Drive Overland Park, KS RE: ExteNet Systems: telecommunications installations on Cityy of Overland Park Light Poles Dear Mr. Horner, ExteNet Systems, Inc. would like to thank the City of Overland Park for the opportunity to present itself and its telecommunications network. The network, called a Distributed Antenna System, includes the attachment of fiber optic cables, small antenna and related telecom equipment, also known as nodes, to existing utility poles and city owned street light infrastructure. This telecommunications network will be located within portions of the public rights of way of the City of Overland Park in addition to several other communities in the region. ExteNet is a registered utility in over 30 states, includingg Kansas and Missouri. As a result, ExteNet secures structure support agreements with local utilities, including KCP&L forr use of their existing utility pole infrastructure for attachment of our nodes and fiber optic network. Unfortunately, there are many areas within the City of Overland Park wheree KCP&L wooden poles do not exist as the essential utility infrastructure has been buried. In thesee areas, existing street lights and traffic signal poles become the next available option for node attachment versus the installation of a new pole. The intent of this document is to outline ExteNet s pending request to use City of Overland Park s existing street light infrastructure for node attachment. Network: ExteNet will design, construct, and operate the Distributed Antenna System to improve wireless services for FCC Licensed Wireless Service Providers in the region. ExteNet does not provide any services directly to the consumer public. Contract Franchise TF was granted to ExteNet Systems by the Overland Park City Council on February 11, Municipal Property: The proposal consists of installing a small, stealth designed antenna onto the top of an existing (or replacement) city owned street light pole within the public right of way. Each street light node will include a ground based utility cabinet to be placed adjacent to the light pole to accommodate the related telecommunications equipment. Additionally, each node iss interconnected with fiber optic cables and will be integrated into the larger telecommunications network throughout the region. Cables connecting the top mounted antenna to the ground basedd utility cabinet are proposed to be concealed within the internal raceway of the light pole.

2 A structural analysis will be performed on every lightt pole to determine its structural capacity. Replacement poles will be used if the existing light pole is structurally insufficient to accommodate the antenna and internal cables. Exhibit A is the most common deployment scenario that ExteNet is proposing. It shows the proposed attachment of a small antenna onto a standard 35 tall Valmont Feralux street light pole in Overland Park. This pole type is the most common pole type in the region. Only the antenna will be mounted to the pole top. Cables will be concealed within the internal raceway of the pole. Related telecom equipment located within ground cabinet with required landscape buffer. Exhibit B shows the same deployment strategy as Exhibit A, but includes a shroud below the pole top antennaa to conceal the cables. This is optional as it may alter the structural capacity of the specific pole due to increased wind loading. Exhibit C shows a custom/stealth deployment strategy for the ornamental light poles that exist within many residential subdivisions in Overland Park. In this scenario, the existing 14 light pole is proposed for replacement with a new, 25 tall light pole with antenna concealed at the top, and similar ornamental luminaire installed onto the new pole at the original height. Currently, this deployment strategy is only proposed for one (1) selected location but is intended to show a variation to the ubiquitous Valmont Feralux poles. Capital Investment: ExteNet will provide 100% of the capitall investment required to design, construct, operate and maintain the Distributed Antenna System. There is no cost or financial risk to the City of Overland Park. ExteNet will pay established application fees for permits as well as annual rental fees as outlined in the Street Light License Agreement. The City of Overland Park will maintain ownership off the street light poles; even for poles that require replacement. ExteNet will own the antenna, the related node equipment within the ground cabinet and the fiber optic network.
