9 Horizon Terms Gamma Horizon Hardware Incentive Conditions Under the Horizon Hardware Incentive Zest4 will provide Horizon handsets free of charge or discounted by 60 each when channel partners fulfil the conditions set out below. In summary, to qualify for the Horizon Hardware Incentive: Handsets must be connected to the Horizon service using certain types of data access circuits provided by Gamma; Handsets must be ordered within 12 months of the relevant account being activated and be committed for a minimum fixed term; The total number of handsets ordered must not exceed the number of active subscriptions. Gamma Access Requirements The primary access method for the Horizon service into the site where the handsets are to be located must be one of the following Gamma access services: Assured Broadband Converged Broadband (including Converged FTTC) Converged Ethernet Converged Private Networks Contract Term Requirements The Horizon subscriptions to which the handsets are associated must be purchased with a 3 year or 5 year minimum commitment. Qualifying Handsets Once the primary access method has been selected, the following handsets can be chosen at no additional charge: Polycom VVX 411 Yealink W52P DECT phone Cisco SPA 504 The following handsets can be chosen with a 60 discount on each unit: Any Polycom conferencing unit Cisco SPA 525 If a handset or other hardware is chosen which is not included in either of the above lists, then the full price must be paid. Qualifying handsets can only be ordered within the first 12 months of the relevant account being activated. Availability The Horizon Hardware Incentive is only available to end customers who are new to Gamma s Horizon service, notwithstanding where such end customer has previously purchased the Horizon service either directly from the channel partner or from any other provider. The gaining channel partner shall use reasonable endeavours to ensure it is operating in accordance to this clause. Zest4 reserves the right to withdraw the Horizon Hardware Incentive and to retrospectively invoice the channel partner for any benefits extended in respect of any Horizon company where in Gamma s reasonable opinion the underlying end customer is not new to the Horizon service. Cancellation Zest4 may invoice an 80 cancellation fee where a subscription is cancelled prior to its minimum commitment. Page 09
