4 Terms & Conditions Plans Please refer to the "Inmarsat BGAN Pricing Terms & Conditions" on Liftoff for a complete set of rules. The below notes offer some basic clarification and do not overrule the T&C document: (1) BGAN Link Application Form (2) BGAN Link Global & Geo plans are available for Class 1 BGAN Terminals only. BGAN Link Unlimted plans can be utilized with a Class 1 or Class 2 terminal. (3) Fair Use Policy - A fair use policy is applied to all BGAN Link usage, please refer to the above documents for details (4) Flat Fee usage management by SAC-C - Inmarsat's Service Aware Control and Charging system will be utilised to manage customer terminal usage within the allocated data allowance of the selected Flat Fee rate plan. (5) VLA Plans - For the VLA Plans any additional IP usage in excess of the monthly Data Allowance will be charged at the same rate as the in-bundle IP rate per MB (6) Flat Fee and VLA Plans - Usage of all other BGAN Class 1 terminal supported services is permissible at the rates shown in the pricing tables above. For more details please refer to the BGAN Pricing T & C's (7) Subject to Inmarsat approval, UT locations may be re-provisioned on a minimum quarterly basis to another pre-defined location. Customer must provide thirty (30) days notice of intention to relocate each terminal, along with relevant GPS co-ordinates information for each re-provision location. BGAN Link Charging Increments: (1) Billing increments: 5 seconds for streaming, 15 seconds for voice and ISDN calls. Inmarsat also applies billing increments to all the intermediate CDR's, both for the uplink and downlink for background IP and on a combined basis for streaming traffic. (2) Minimum durations: 30 seconds for voice, streaming and ISDN calls. Inmarsat applies minimum volumes separtely to both the uplink and downlink portions of data sessions for background IP. This applies to the first (partial) CDR. General Terms & Conditions (1) The date of activation counts as the first month of the contract (for example a 12 month package activated on 12 April 2012 ends at 31 March 2013) (2) BGAN Link Activations are pro-rata, deactivations are based on a full month (3) All activations automatically renew at the end of the minimum contract period (4) Early termination fees apply in cases where a package is deactivated before the minimum contract term is completed. (5) The early termination fee will be the total of the outstanding monthly subscriptions to the end of the contract period. (6) If a SIM moves from one Package to another, it is either an upgrade or a downgrade depending on the priorities shown in the table below. A change to the same priority is treated as a downgrade. Please note that "1" is the highest priority. (7) For a terminal to be considered for an upgrade or downgrade of a package the upgrade or downgrade must be carried out within the same calendar day (00:00:00 to 23:59:59 GMT) (8) If a terminal is required to be upgraded into a BGAN Link Plan and a penalty charge is triggered under the existing Package Rate Plan, the charge will be waived automatically as this will be considered an upgrade as per the standard BGAN terms. (9) In the case of a downgrade during the minimum contract period an early termination fee applies. The subscription that relates to the remaining portion of the minimum duration period will be charged. (10) Package upgrades/downgrades can utilise the feature in Stratos Dashboard and no longer require a SIM deactivation/reactivation. The Package change becomes effective immediately. Please note that if this is done during a month then the full month of the existing package is still charged + pro-rata the first month of the new package. (11) BGAN Link Plan upgrades and downgrades take effect from the first day of the next calendar month. (12) On deactivation there will be no pro-rating of subscriptions or allowances. A full month's subscription will be charged and a full month's allowance will be available. Page 4 of 6
