3 Applicant: John Pek, New Cingular Wireless AT&T Mobility Agent, (916) , 1665 Benvenito Lane, Lincoln, CA Owner: Mark Covington, Natomas Unified School District, (916) , 1901 Arena Boulevard, Sacramento, CA Architect: Borges Architectural Group, (916) , 1478 Stone Pointe Drive, Suite 350, Roseville, CA Summary: The applicant is requesting the necessary entitlements to construct a new 65-foot monopole telecommunications tower and related equipment on a developed 8± acre parcel in the Light Industrial zone within the Natomas Gateway Corporate Center Planned Unit Development (M-1S-PUD). The property is owned by Natomas Unified School District (NUSD) and is used as transportation garage, bus storage facility, maintenance warehouse, and food service kitchen and warehouse for the district. The applicant is proposing to locate the new telecommunications tower, lease area, and related equipment at the rear of the buildings within the existing bus parking area. The facility will provide 24-hour wireless service to current and potential customers in the area. Table 1: Project Information General Plan designation: Employment Center Low Rise Existing zoning of site: M-1S-PUD (Light Industrial) Existing use of site: School District Facilities Property area: 8± acres Background Information: On August 10, 1999, the City Council a PUD designation and adoption of PUD Guidelines and Schematic Plan to designate 19.5± acres as the Natomas Gateway Corporate Center Planned Unit Development (PUD). As a part of this same application, on June 24, 1999 the Planning Commission approved a Tentative Subdivision Map (one into five) and Special Permit for five (5) buildings containing a total of 346,790± square feet within the proposed Natomas Gateway Corporate Center PUD (P99-003). On January 20, 2000, the Planning Commission approved a Schematic Plan Amendment and Special Permit Modification to replace a planned 94,900 square foot warehouse / office with an open storage area for buses and other district vehicles for Natomas Unified School District (NUSD) on 4.6± acres (P99-145). On November 27, 2000, the Zoning Administrator approved a minor modification to previously approved Special Permit (P / P99-145) to increase the allowed office area for two buildings of the existing four building complex located within the Manufacturing Industrial Park Planned Unit Development (MIP-PUD) zone (Z00-155). On March 21, 2001, the Zoning Administrator approved a parcel merger to merger two parcels into one parcel totaling 8.12± developed acres (Z01-006). 3

4 On August 9, 2001, the City Council approved a North Natomas Community Plan Amendment from Employment Center (EC-30) to Light Industrial and a Rezone from Manufacturing Industrial Park Planned Unit Development (MIP-PUD) zone to Light Industrial Planned Unit Development (M-1S-PUD) zone for 19.59± acres within the Natomas Gateway Corporate Center PUD (P01-006). On May 17, 2004, the Zoning Administrator approved a minor modification to a previously approved Special Permit (P01-006) to add a 10,544 square foot commercial kitchen inside an existing warehouse building at this location (Z04-085). Aerial Image of Project Site The applicant s original submittal was for a stealth telecommunications facility (monopine) at this location. Staff reviewed the applicant s initial proposal and recommended the application revise their application for a standard monopole telecommunications facility. Staff believed that at this location, a stealth monopine telecommunications facility would draw the eye more to this facility due to the lack of full grown trees in close proximity to the telecommunications site (see photosimulations below). A standard monopole facility would blend better into the skyline and with the existing transmission towers in the area. The applicant has revised their application to provide for a standard monopole facility with collocation opportunities on the facility. 4

6 Photosimulation of Currently Proposed Slim Monopole Facility Project Design: The applicant is proposing a new stand-alone 65-foot tall telecommunications facility (monopole) with stackable antennas that would have three (3) antenna sectors with two (2) antennas per sector, for a total of twelve (12) antennas, mounted on the proposed monopole at 54-0 and 62-0 rad center. A new GPS unit, twenty-one (21) RRHS, six (6) A2 modules, and surge suppressors will also be mounted with the antenna arrays. The proposed monopole has been designed to structurally accommodate future collocations on the facility for a future array of antennas to be located at 44-0 rad center. Access to the facility and the lease area will be provided from existing driveways on Arena Boulevard and Gateway Park Boulevard through the existing project site. The 710 square foot lease area for related equipment will be located within the existing bus storage yard, located behind the existing school district building. The bus storage yard is currently fenced, but the applicant is proposing to also fence their lease area with a six-foot high chain link fencing with three strand anti-climb barrier atop it. The proposed lease area and equipment will be conditioned to be screened from street and/or public views. Land Use: The applicant is proposing to construct a new telecommunications facility (monopole) within the existing bus storage area which is located behind their existing buildings that are used for school district facilities (transportation garage, maintenance warehouse, and food service kitchen and storage). The project site is surrounded by: a drainage canal (East Main Drainage Canal) and apartments (Tuscaro) to the west; a SMUD facility, drainage canal, and self-storage facility to the north; industrial buildings that house warehouses and a religious facility to the east; and Arena Boulevard and a beverage distribution center (Coca-Cola) to the south. 6

7 An antenna / telecommunications facility is a conditional use in the Light Industrial (M- 1S) zone, subject to Section of the Planning and Development Code. The new construction of a telecommunication facility that does not replace an existing telecommunications facility requires a commission-level conditional use permit. The proposed telecommunications facility (monopole) is also subject to site plan and design review approval at the same level as the conditional use permit. Public/Neighborhood Outreach and Comments: The project was routed to the following neighborhood associations: North Natomas Community Association (NNCA), Natomas Community Association (NCA), North Natomas Alliance (NNA), North Natomas Community Coalition (NNCC), Environmental Council of Sacramento (ECOS) and WalkSacramento. Staff also posted a public notice at the property, notified the above neighborhood associations and property owners within 300 feet of the site of this public hearing. At the time of the writing of this report, staff had not received any communications from neighbors or neighborhood associations regarding this proposed telecommunications facility. Environmental Considerations: The Community Development Department, Environmental Planning Services Division has reviewed this project and determined that it is exempt from the provisions of the California Environmental Quality Act (CEQA) under Class 3, Section New Construction or Conversion of Small Structures. The project consists of the construction of a new monopole telecommunications facility and related equipment at an existing site developed for a school bus storage facility. There would be no additional significant cumulative effect that was not already evaluated in the Master EIR for the 2030 General Plan. The project would have no significant effect on the environment and involves negligible expansion of an existing use. The Telecommunications Act of 1996 includes provisions relating to the exclusive federal jurisdiction to regulate human exposure to RF emissions from certain transmitting devices as regulated by the Federal Communications Commission (FCC). In particular, Section 704 of the Act states that, No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission s regulations concerning such emissions. The facilities at issue would comply with federal regulations and thus fall within the above provision restricting the City s authority to regulate on the basis of environmental effects of radio frequency emissions. Policy Considerations: General Plan: The subject site is designated Employment Center Low Rise in the 2035 General Plan Update. This designation plays an important role in the city by supporting businesses and providing employment. It is not anticipated that there will be any significant change in the form and character of areas designated Employment Center Low Rise in the foreseeable future. Changes are likely to be more subtle, including improvements in accessibility to pedestrians, bicyclists, and transit and the integration of 7

8 additional support uses. Specifically regarding telecommunications facilities, the proposed project supports the following goals and policies: High-Quality Infrastructure and Services. Provide and maintain efficient, highquality public infrastructure facilities and services throughout the city (Goal U 1.1). Safe, Attractive, and Compatible Utility Design. The City shall ensure that public utility facilities are designed to be safe, aesthetically pleasing, and compatible with adjacent uses (Policy U ). Telecommunication Technology. Provide state-of-the-art telecommunication services for households, businesses, institutions, and public agencies throughout the city that connect Sacramento to the nation and world (Goal U 7.1). Access and Availability. The City shall work with service providers to ensure access and availability of a wide range of state-of-the-art telecommunication systems and services for households, businesses, institutions, and public agencies throughout the city (Policy U 7.1.1). Adequate Facilities and Service. The City shall work with utility companies to retrofit areas that are not served by current telecommunications technologies and shall provide strategic long-range planning of telecommunication facilities for newly developing areas, as feasible (Policy U 7.1.2). The Telecommunications section of the General Plan states Telecommunication infrastructure will be designed to be compatible with adjacent uses and to minimize visual impacts. This project is compatible with the existing school bus storage facility at this location. The property is surrounded by a drainage canal and apartments to the west, a drainage canal, SMUD facility, and self-storage facility to the north, industrial buildings to the east and south, with no structures of significant height in close proximity. By constructing a new telecommunications facility / monopole at this location with collocation capabilities, the applicant will be minimizing the visual intrusion and expanding the telecommunications coverage, which is compatible with the nonresidential and residential uses surrounding the property. Telecommunication Facilities Development Guidelines: The goals of the City s Telecommunications Policy are to minimize the number and visibility of telecommunications facilities, provide locational opportunities on City owned property or right-of-ways, encourage collocation of facilities, and minimize the proliferation of monopoles. The City has developed guidelines concerning siting preference and facility location and design. The siting preference, listed in order of preference is: 1. Located completely within an existing or constructed structure 8

9 2. Existing structures (public or private) that allow a façade mounted antenna 3. Existing structures (public or private) which require a modification of the structure architecturally or in height in order to mount antennas (includes roof mounts) 4. Collocation on existing poles or light standards at a lower height 5. Collocation on existing poles or light standards at a higher height 6. New monopole (whether co-developed or single carrier) As the proposal includes the construction of a new monopole capable of collocating additional carriers on the facility, this proposal is the least preferred method of providing new antennas. The surrounding buildings within close proximity to the project site are industrial buildings, mini-storage buildings, and apartments. With the lack of existing structures with adequate height and capacity to locate telecommunications antennas in this area, the proposed monopole is the most feasible option for providing additional telecommunication coverage in this area. The purpose of the telecommunication facilities development guidelines is to ensure compatibility of the telecommunications facility with the existing site and to minimize its visual impact. The proposed project meets the following elements of the guidelines: o o o Monopoles should be constructed of materials that match the prevalent poles and/or buildings and landscaping in the area or provide stealthing for the pole (i.e. wood, metal, palm/pine tree). Also carriers should consider using close proximity / bi-polar or tight antenna arrays configurations on monopoles instead of traditional top hat antenna arrays. Monopoles should be painted to match either the sky line (dull matte gray) or other prevalent architectural or natural features (i.e. trees). Carriers should locate all equipment shelters or cabinets to the rear of existing buildings away from the streetscape view. Conditional Use Permit: Section of the Planning and Development code requires a commission-level conditional use permit for new telecommunications towers that are not subject to director level review. This proposal does not qualify for directorlevel review in that: the proposal does not replace an existing telecommunications tower. In evaluating conditional use permit proposals of this type, the Commission is required to make the following findings: 9

The proposed use and its operating characteristics are consistent with the general plan and any applicable specific plan or transit village plan; The proposed telecommunications facility is consistent with Employment Center Low Rise land use designation and the related goals and policies of the General Plan related to providing and maintaining efficient, high-quality public infrastructure facilities and services throughout the city. B. The proposed use and its operating characteristics are consistent with the applicable standards, requirements, and regulations of the zoning district in which it is located, and of all other provisions of this title and this code; The proposed use and its operating characteristics are consistent with the applicable standards, requirements and regulations of the Light Industrial (M-1S- PUD) zone and Planning and Development Code, as conditioned, in that the proposed telecommunications facility complies with several key objectives of the Guidelines for Telecommunications Facilities, as adopted by the City Council on April 29, 1997, in that the antennas painted dull matte grey to blend in with the skyline. C. The proposed use and its operating characteristics are not detrimental to the public health, safety, convenience, or welfare of persons residing, working, visiting, or recreating in the surrounding neighborhood and will not result in the creation of a nuisance. 11 o o Should the facility cease operations, the operator(s)/owner(s) will be required to dismantle and completely remove the facility within six months of the telecommunication facility s operations cessation. The RF emission of the antenna will be subject to all applicable FCC regulations. Staff is in support of the conditional use permit in that the use is consistent with the goals and policies of the General Plan. Staff is supportive of the requested location and height of the proposed telecommunications facility. As currently proposed, the telecommunications facility will blend better with the sky line and catch the eye as much as a stealth monopine facility, and the proposed telecommunications facility will facilitate increased telecommunications coverage in the area. Staff also believes, as conditioned the proposed use is compatible with the existing industrial uses in close proximity, and with the surrounding non-residential and residential uses. Site Plan and Design Review: Section of the Planning and Development Code states that a new telecommunications tower is also subject to site plan and design review at the same level as the required conditional use permit. At 65 feet in height, the proposed telecommunications facility exceeds the maximum height limit for the Natomas Gateway Corporate Center, which allows a maximum of 40 feet. Therefore, the proposal requires a deviation from the maximum height limit requirements in the Natomas Gateway Corporate Center PUD guidelines. Per section of the Planning and Development Code, site plan and design review includes the authority to approve or require deviations that are more or less restrictive than the applicable development standards. In evaluating site plan and design review, the commission is required to make the following findings: A. The design, layout, and physical characteristics of the proposed development are consistent with the general plan; The design, layout, and physical characteristics of the proposal are consistent with the Employment Center Low Rise land use designation and policies of the 2035 General Plan Update. B. The design, layout, and physical characteristics of proposed development are consistent with all applicable design guidelines and with all applicable development standards or, if deviations from design guidelines or development standards are approved, the proposed development is consistent with the purpose and intent of the applicable design guidelines and development standards; The design, layout, and physical characteristics of the proposed telecommunications facility are consistent with all applicable design guidelines and with all applicable development standards. 11

All streets and other public access ways and facilities, parking facilities, and utility infrastructure are adequate to serve the proposed development and comply with all applicable design guidelines and development standards; All streets and other public access ways and facilities, parking facilities, and utility infrastructure are adequate to serve the proposed development and comply with all applicable design guidelines and development standards, in that the project has been analyzed by City departments and it has been determined that all streets and other public access ways and facilities, parking facilities, and utility infrastructure are all existing and adequate to serve the proposed development and comply with all applicable design guidelines and development standards. D. The design, layout, and physical characteristics of the proposed development are visually and functionally compatible with the surrounding neighborhood; The design, layout, and physical characteristics of the proposal are visually and functionally compatible with the surrounding neighborhood, in that the proposal incorporates design elements intended to minimize visual impact and blend in with the surrounding landscape. E. Environmental Determination: Based upon the determination and recommendation of the City s Environmental Planning Services Manager and the oral and documentary evidence received at the hearing on the Project, the Planning and Design Commission finds that the Project is exempt from review under Section 15303, New Construction or Conversion, of the California Environmental Quality Act, as follows: The project consists of the construction of a new monopole telecommunications facility and related equipment at an existing site developed for a school bus storage facility. There would be no additional significant cumulative effect that was not already evaluated in the Master EIR for the 2030 General Plan. The project would have no significant effect on the environment. B. The Conditional Use Permit for a new telecommunications facility (monopole) at an existing school bus yard on approximately 8 acres in the Light Industrial zone within the Natomas Gateway Corporate Center Planned Unit Development (M-1S-PUD) is approved subject to the following Findings of Fact and Conditions of Approval: 1. The Conditional Use Permit for a new telecommunications facility (monopole) at an existing school bus yard on approximately 8 acres in the Light Industrial zone within the Natomas Gateway Corporate Center Planned Unit Development (M-1S-PUD) is hereby approved subject to the following conditions of approval: PLANNING: B1. Applicant shall obtain all necessary building and/or encroachment permits prior to commencing construction. B2. The project shall be constructed in substantial conformance to the approved plans as shown on the attached exhibits and as conditioned to revise. Any modification to the project shall be subject to review and approval by Planning staff (and may require additional entitlements) prior to the issuance of building permits. B3. The applicant shall obtain all necessary federal telecommunications permits prior to commencing construction. 17

18 FIRE: POLICE: B4. The size and location of the monopole, antennas, radio repeater units, all associated equipment, fence, and access road shall conform to the plans submitted. B5. The applicant shall use non-reflective paint (dull matte gray) and materials to match the monopole at the point of attachment and /or immediately surrounding materials and connection points on all sides and on all equipment, cables, connections, panels and any other appurtenance. B6. Should the operation of this telecommunications facility be discontinued, the applicant(s) shall be responsible for the removal of the telecommunications facility and of all equipment, including, but not limited to the: antennas, related equipment and cabinets, cable(s) and conduit, concrete pad(s), foundation, telephone and power lines to the facility, access gates, and fencing materials, within six (6) months of the cessation of facility operations. B7. Fencing / screening shall be provided around the equipment lease area to secure the facility. All uses shall be conducted wholly within a completely enclosed building or within an area enclosed on all street visible sides by a solid fence or wall at least six feet in height, per the requirements of the M- 1S zone (Section of the Sacramento City Code). B8. Any additional antennas, dishes, or radio repeater units may require additional review, application, and/or approval by Planning [a total of twelve panels and twenty-one RRHS are approved at an AGL of 54-0 and 62-0 ]. B9. The applicant shall inspect the site at least once a quarter to ensure the site is maintained. The applicant shall make repairs to any fence or equipment damage discovered from the quarterly (or more frequent) inspections. B10. Provide approved Knox padlock for the proposed 12 wide access gate. B11. Any exterior lighting shall be white light using LED lamps with full cutoff fixtures to limit glare and light trespass. Color temperature shall be between 2700K and 4100K. B12. Broken or damaged exterior lighting shall be repaired or replaced within 48 hours of being noted. 18

19 B13. The applicant is responsible for reasonably controlling the conduct of persons on the site and shall immediately disperse loiterers when discovered or notified of their presence. B14. Any graffiti painted or marked upon the premises or on any adjacent area under the control of the applicant shall be removed or painted over with matching paint within 72 hours of discovery or notification of vandalism. B15. The operator shall be responsible for the removal of all litter from the site. B16. Applicant shall install a Knox Box for police access to the exterior areas of the property after hours. C. The Site Plan and Design Review with deviations for height for a new 65-foot high telecommunications facility (monopole) in the M-1S-PUD zone is hereby approved subject to the following conditions of approval: C1. Applicant shall obtain all necessary building and/or encroachment permits prior to commencing construction. C2. The project shall be constructed in substantial conformance to the approved plans as shown on the attached exhibits and as conditioned to revise. Any modification to the project shall be subject to review and approval by Planning / Design Review staff (and may require additional entitlements) prior to the issuance of building permits. C3. The fencing, gates, and monopole shall be maintained in a graffiti free and in sound structural condition for the duration of the operation of the facility. Removal of graffiti and/or repair of damage to the monopole or fencing are the responsibility of the telecommunications carrier. C4. All cables associated with the telecommunications facility shall run inside the monopole and/or inside conduit and shall not be visible on the outside of the monopole nor on the ground. C5. The overall height of the monopole shall not exceed 65 feet AGL. The proposed antennas shall be mounted at 54 and 62 rad center and shall not extend above the height of the monopole (65 ). C6. All other notes and drawings on the final plans as submitted by the applicant are deemed conditions of approval. Except as conditioned, any work that differs from the final set of plans in this approval shall be subject to review and approval prior to issuance of a building permit or any work being undertaken. C7. Associated telecommunications equipment shall be located within the existing lease area as indicated on the plans. All telecommunications 19

20 related equipment and/or storage shall be completely screened from street views. All screening materials shall be reviewed and approved by Design Review staff prior to issuance of building permits. 20
