2 OUTCOME OF THE SECOND MEETING OF HELCOM WORKSHOP OF THE HEADS OF DELEGATION AND THE BSAP REVIEW EXPERTS OF LOAD AND MONAS (HELCOM HOD MAI/CART WS 2/2013) INTRODUCTION 0.1 In accordance with the decision of HELCOM HOD 38/2012, the HELCOM Workshop of the Heads of Delegation and the BSAP review experts of LOAD and MONAS (HOD MAI/CART WS 2/2013) was held on Friday, on 26 April 2013, in Radisson Blu Fredensborg Hotel, Strandvejen 116, DK-3700 Rønne, Bornholm, back-to-back with the HELCOM MONAS 18/2013 Meeting, held on April On behalf of the Danish Nature Agency, the Workshop was opened by Ms. Lisbet Oelgaard. 0.3 The Workshop was chaired by Ms. Helle Pilsgaard, Chair of the Helsinki Commission. Agenda Item 1 Adoption of the Agenda Documents: 1/1, 1/1/Rev. 1.1 The Meeting adopted the agenda with an addition of new agenda item on the Ministerial Meeting (Agenda Item 6, document 1/2) as contained in document 1/1/Rev. Agenda Item 2 Setting the scene Documents: None 2.1 The Meeting took note of the presentation by the Secretariat on the background information on the revision of the BSAP nutrient reduction scheme, including the timeframe for finalizing the work, as well as common terminology used (Presentation 1). Agenda Item 3 Maximum Allowable Inputs (MAI) Documents: 3/1, 3/2, 3/3 3.1 The Meeting took note of the presentation by BNI (Presentation 2) on the MAI approach and the proposed MAI calculation based on the outcome of MONAS 18/2013 (document 3/3), draft scientific background report "Revision of the Maximum Allowable Inputs and Country Allocation Scheme of the HELCOM Baltic Sea Action Plan (document 3/1) and the popular summary report on the development of revised MAI and new CART (document 3/2). 3.2 The Meeting discussed how to best communicate the outcome of the revision of the nutrient reduction scheme and invited BNI, in cooperation with the Secretariat, to address the following issues: the message on the timeframe for the recovery of the Baltic Sea should be complemented with examples of improvements of the state of the marine environment on the local scale and in coastal waters to signal that there is a positive development towards Good Environmental Status justifying needed reductions (BNI) additional information on the inflows from the North Sea should be reflected in the background documentation (BNI) Page 2 of 9
3 a simplified and consolidated message on needed reductions have to be prepared for conveying to the ministers (Secretariat). The Meeting discussed the future direction of the work on modelling MAI after the 2013 Ministerial Meeting and pointed out to exploring possibilities for additional modeling needs for the Danish Straits and other coastal regions to better capture large gradients for ecological targets as well as better accommodate the targets for oxygen, also having Water Framework Directive in mind, and which can be tackled through cooperation among the countries concerned. 3.3 Taking into account the scientific background of the work for calculating MAI as well as discussion that took place during MONAS 18/2013 (cf. document 3/3), the Meeting considered the following MAI by BNI: Basin/ input in tons Total P Total N Kattegat 1,687 74,000 Danish Straits 1,601 65,472 Baltic Proper 7, ,000 Bothnian Sea 2,773 79,372* Bothnian Bay 2,675 52,100-57,622** Gulf of Riga 2,020 76,000-88,418** Gulf of Finland 3, ,500 *- figure has changed from MONAS 18/2013 after correction of an error in the used ecological target ** for both Bothnian Bay and Gulf of Riga lower range figures represent MAI where all four ecological targets are strictly met; higher range figures represent MAI with violation of environmental eutrophication target for N and with no N reduction needs compared with reference period inputs, based on ecological reasoning 3.4 The Meeting took note of the following comments by the Contracting Parties to the above solution to MAI: by Denmark and Sweden supporting in principle MAI and the continuation of work based on the presented figures; by Germany in principle supporting the solution; by Sweden and Finland supporting in principle the solution for MAI and regarding Bothnian Bay at this stage giving preference to higher MAI-option due to scientific reasoning (P-limitation in the Bay), however wishing to follow up on this bilaterally, and also regarding the Bothnian Sea further bilateral considerations will take place; by Latvia pointing to the MAI-N for the Gulf of Riga and that if the lower MAI is chosen, that would require further consideration and justification; by Poland and Lithuania requesting overall study reservation, as well as requesting BNI to provide additional information on the retention; by Russia that in principle they can agree with the proposed solution, however a study reservation is requested The Meeting noted that the outcome of the model calculation is subject to expert judgement. 3.5 The Meeting requested the Contracting Parties having study reservations as above to clarify them to the Secretariat as soon as possible and no later than by 7 May The Meeting recognized that if major new approaches to MAI requiring substantial work from BNI and new rounds of consultations between the Contracting Parties are put forward, it will make it difficult to finalise the revision process by October Page 3 of 9
4 3.6 The Meeting expressed the need to start national consultations on CART based on the agreed revised MAI as soon as possible, and therefore, it being of outmost importance to have a common understanding on MAI already during this workshop. 3.7 Having this in regard, the Meeting invited BNI to continue the work using the presented MAI (cf. table in 3.3) with the view to prepare fine-tuned MAI and the proposal for CART prior HOD 41/2013. Agenda Item 4 Country-Allocated Reduction Targets (CART) Documents: 4/1 4.1 The Meeting took note of the presentation by the LOAD Chair guiding step-bystep on how CART are derived, including the allocation principles used (Presentation 3, as well as document 3/1, 3/2) and in general supported the presented approach. The LOAD Chair explained why direct comparison of 2007 BSAP and new CART is not possible. 4.2 The Meeting was pleased to note the positive trends in reducing both nitrogen and phosphorous to the Baltic Sea as shown in the presentation with the flow-normalized waterborne inputs of nitrogen and phosphorous, and normalized contribution of nitrogen atmospheric deposition for the period of 1995 compared to The Meeting took note of the presentation by BNI of the calculated CART per sub-basin and per country based on the MAI as in the table above, utilizing higher MAI for Gulf of Riga and Bothnian Bay (higher range from the table), as well as accommodating the request by Poland from MONAS 18/2013 regarding updating retention information (Presentation 4). The presentation included information on how transboundary inputs (waterborne and airborne) have been dealt with. 4.4 The Meeting took note that with the latest MAI iterations, there is no need for an alternative scenario for allocation of nitrogen depositions from the HELCOM countries and the same allocation principles apply. 4.5 The Meeting took note of the view by Germany to single out the reduction needs for air N deposition from non-contracting Parties as well as from shipping, being justified with the available policies to address emissions, such as the Gothenburg Protocol, NOx Emission Control Area for the Baltic under MARPOL Annex VI, and Article 10 of MSFD. 4.6 The Meeting noted that while no reduction targets can be set by HELCOM for non-helcom countries, the needed reduction can be quantified to these countries as well as shipping. The Meeting further noted that reduction expectations for riverine transboundary N/P load cannot be calculated with a good certainty (retention issue), while better data are available from EMEP for N deposition. 4.7 The Meeting took note that with the use of the BNI tool it is possible from technical point of view to address in different ways the riverine transboundary N/P and transboundary N deposition. 4.8 The Meeting found it important to include transboundary loads and the related reduction needs in the revised nutrient reduction scheme in such a way that they are displayed and could be followed up and invited BNI in cooperation with the LOAD Chair and the Secretariat to present how this could be addressed in a good way for the consideration by HELCOM HOD 41/ Further, the Meeting welcomed the offer by the LOAD Chair to investigate possible sharing of transboundary riverine load between HELCOM countries, noting the challenge of following up on the transboundary load reductions both upstream and downstream The Meeting took note of the explanation that the present CART have been finetuned comparing to the previous draft figures, e.g. due to the adaptation of methodology, Page 4 of 9
5 eliminating the incorrect figures in PLC data, including deposition matrixes, and invited the Contracting Parties to be in contact with Mr. Bo Gustafsson, BNI, to clarify any questions The Meeting took note that the ex ante principle is not applied in the revision of CART The Meeting noted that the new term of Nutrient Input Ceilings has been introduced to reflect the maximum allowed inputs by the countries, making it possible to easier follow up on the progress based on PLC data and indicating that for those countries with no reduction target for specific sub-basin(s), the ceilings should not be exceeded The Meeting took note of the indication by Poland that the current concentration of P at the river mouth of Vistula is 0.15 mg/l, and for meeting CART concentration, it would need to be lowered to mg/l, and which Poland considers would be close to background concentration The Meeting took note of the estimation that it is approximately equally challenging for all the countries to reduce P according to CART The Meeting discussed the relevance of the information on the background loads when considering the CART and invited the LOAD Chair to reflect on availability of the data on background loads with the use of PLC for further discussions The Meeting took note in general of the first round of indications by the Contracting Parties of where the challenges could be in finding a common solution to the CART The Meeting welcomed the information that the figures on trends in nutrient reduction for all countries will be prepared by the LOAD Chair and submitted to HELCOM HOD 41/ The Meeting invited BNI to continue the work on fine-tuning CART to be presented at HELCOM HOD 41/2013 and invited the Contracting Parties to be in contact with the Chair and the Secretariat to facilitate the solution finding for the HOD meeting. The Meeting requested material for HELCOM HOD 41/2013 to be made available in advance of the meeting for the good preparation of the discussion (with an aim to submit it preferably three weeks in advance pending clarification of study reservation as well as possible complication of the work stemming from the comments received cf. paragraph 3.6) The Meeting took note of the information on the alternative allocation principle - per capita, to CART (document 4/1). The Meeting noted the implications of these approaches as well as difficulties, including technical, to apply them in a meaningful way for all the countries. The Meeting took note that Poland wishes to still keep the alternative calculation for reference at the HOD 41/2013 meeting, while the remaining countries do not consider it possible to develop the alternative approaches into a viable option, especially taken the given time-framework. The Meeting noted that BNI is not available to work with the alternative approaches The Meeting took note of the presentation by EMEP on the effect of implementation of the Gothenburg Protocol on nitrogen deposition to the Baltic Sea (Presentation 5) and appreciated the presentation, which provides useful insight into expected N deposition reduction. Agenda Item 5 Outlook for future work and conclusions Documents: None 5.1 The Meeting expressed appreciation to Mr. Bo Gustafsson, BNI Sweden, and Mr. Lars Svendsen, LOAD Chair, for their dedication and hard work to progress on the revision of the nutrient reduction scheme. 6 5.2 The Meeting requested the LOAD Chair and the Secretariat to develop further the popular version of the background report on the revision MAI and CART, along with the updating of the scientific background report by BNI. Agenda Item 6 Copenhagen Ministerial Meeting Documents: 1/2, 6/1 6.1 The Meeting considered the proposal from the Baltic Development Forum to stage a back-to-back conference to the HELCOM Ministerial Meeting in Copenhagen and recognized the possibility offered to the Ministers to reach out to business community and communicate their visions and the outcome of the Ministerial Meeting. The Meeting collected feedback from the Heads of Delegations present at the meeting on the proposal such as the scope of the back-to-back conference to be wider and not only focusing on shipping but equally on other fields covered by the Baltic Sea Action Plan, and the preference to start with HELCOM Ministerial Meeting first. 6.2 The Meeting adopted the draft outcome of the meeting (document 6/1), which will be finalized in consultation with the Chair and circulated to the Contacting Parties and Observers.
