7 Ellison, David From: Sent: To: Subject: Attachments: Martin, Jason Thursday, January 26, :03 AM Azar, Robert; Lykins, Jeff FW: Suboxone sign at 150 Lloyd image001.jpg; HDC approval Sign _Wed_Jan_11_2017_ _GMT+0000 _(Coordinated_Universal_Time).pdf I haven't responded to his inquiry form Jan 20th yet. Any guidance? My previous answer is pretty much still my answer. When they installed the temporary sign, they did not do so as they described in their application (the panels are reversed in order, minor). They also use a bright metal "L" bracket to secure the panels to the frame. Minor things that can eventually be addressed in my mind. From: Josh Eisen [mailto:josh@mountaincow.com] Sent: Thursday, January 26, :59 AM To: Martin, Jason Subject: FW: Suboxone sign at 150 Lloyd Hi Jason, Not sure if you received my previous , please see below. Thanks! Josh From: Josh Eisen [mailto:josh@mountaincow.com] Sent: Friday, January 20, :54 AM To: 'Martin, Jason' Subject: RE: Suboxone sign at 150 Lloyd Hi Jason, Can you please give me an update on the status of the sign? Is there a reason the temporary sign was approved when the style is so inappropriate for the historic district? I would definitely prefer it be removed until an appropriately styled sign can be constructed. Also, do you know yet if the permanent sign approval will be a staff decision or have a public hearing? Given how stylistically inappropriate the temporary sign was, I could probably get you signatures requesting a public hearing about the permanent sign if that helps, just let me know. Thanks! 8 Hi typically no. The whole freedom of speech thing comes into play. While they were here Bob Azar joined us and suggested that the wording they were using was "provocative" and that perhaps something else would be more appropriate. Their lawyer, Anthony Bucci, took it under advisement, so I'm hopeful that the permanent sign will be more in keeping with advertising for a typical doctor's office. J From: Josh Eisen [mailto:josh@mountaincow.com] Sent: Wednesday, January 11, :34 PM To: Martin, Jason Subject: RE: Suboxone sign at 150 Lloyd Hi Jason, Thank you for the update! Quick question, does anyone have jurisdiction over the content of the sign? For example, if it were filled with expletives? Josh From: Martin, Jason [mailto:jmartin@providenceri.gov] Sent: Wednesday, January 11, :23 PM To: 'Josh Eisen' Cc: Lykins, Jeff; Azar, Robert Subject: RE: Suboxone sign at 150 Lloyd Hi Josh 150 Lloyd was in late this morning to DIS and myself. They applied for the sign and some minor interior work with DIS. It's also my understanding that the issue surrounding the zoning variance and the sign was rectified, with the variance being properly recorded. They were given approval by myself to put a temporary sign within the zoning approved freestanding sign. It's really just the current sign modified to properly fit within the existing frame. They will be submitting a permanent sign design in the near future and will let you know when that happens. Best, Jason From: Josh Eisen [mailto:josh@mountaincow.com] Sent: Wednesday, January 11, :44 AM To: Martin, Jason Subject: RE: Suboxone sign at 150 Lloyd Hi Jason, Thanks so much for the heads up, I agree completely. 9 In this case, we would most likely not accept the existing sign (even as a temporary) as the style is inappropriate. Signs are typically approved by Staff but if I find the sign inappropriate I cannot say no, I have to refer to the full Commission. So it would depend on what was submitted. Best, J From: Josh Eisen [mailto:josh@mountaincow.com] Sent: Tuesday, January 10, :10 PM To: Martin, Jason Cc: Lykins, Jeff Subject: RE: Suboxone sign at 150 Lloyd Hi Jason, If the new owners respond to the sign violation with an application, would HDC approval of the new sign be a staff decision or would there be a public hearing? 13 Josh From: Stevens, Jennifer Sent: Tuesday, January 10, :27 PM To: 'Josh Eisen' Subject: Notes from Jan. 9 CHNA meeting Hello, Josh. Just left you a message. My notes from last night are below. Feel free to reply with feedback. I understand you connected with Jeff earlier today, as did I. An update that he just gave me, and one that I noted in my voic , is that the 1955 variance specifies two doctors offices, meaning that only two doctors can legally operate from the space. Best, Jen College Hill Neighborhood Association meeting notes Called by CHNA President Josh Eisen, Lippitt House, 199 Hope Street, Providence Jan. 9, 2016, 7pm Background: Large provocative sign posted outside property at corner of Lloyd and Thayer reading Suboxone Available Spring 2017 Owner is Richard Dion of Oxford Investments. Lawyer is Anthony Bucci Jr. Building was purchased for $1.6 million, though is believed to be valued at half that. Director of Inspections and Standards Jeff Lykins has notified the owner to apply to the Historic District Commission for signage approval. An appeal to prevent the Ivy Spa from opening at the same location ten or twelve years ago failed and has no bearing on this. An as of right use variance was issued in 1955 allowing the use of two residences and two doctor s offices. State (BHDDH) has oversite over doctor s offices, not city. Use as a doctor s office allows distribution of samples, but is believed to not allow wide distribution of Suboxone. Abandonment: Neighbors say it has been abandoned over a year, which would violate it s nonconformity use status Neighbors question who has the burden of proof regarding abandonment and what paper trail there may be Jeff says the City has been lenient on abandonment issues in light of the economic downturn Neighbors believe that abandonment, enlargement of the sign, and nature of use are grounds to prevent its opening *Following this meeting, Jeff confirmed that the building variance (an as of right use issued in 1955) means this is not a nonconforming use, so the abandonment consideration does not apply. Permits: Neighbor says a work permit for renovations is posted on the door Neighbors question the process to challenge the variance Assumption is that the state, rather than the city, will have a paper trail proving use as a doctor s office 17
14 If they get a permit, the process to appeal it is to apply to the Building/Zoning Appeal Board. (Permits aren t noticed. Variances are.) Neighbors question if a court of law issue an injunction. Neighbors discussed raising funds to hire attorneys. Jeff said that following the issuing of a violation (for the sign), the business has 30 days to comply, then faces court. The city can place a lien on the property. Community Reactions: Councilman Zurier thinks procedures should be created for citizens to demonstrate abandonment Senator Goldin is willing to consider helpful legislation Nick from the Fox Point Neighborhood Association said the Suboxone clinic on Wickenden Street did not bring fears into reality. The biggest drawback is scattered cigarette butts. A Dr. from Butler Hospital said a Suboxone clinic brings fewer risks compared to a Methadone clinic. Patients are looking to end addiction, not use Suboxone for recreational purposes. Brown U. s Kate Silberman stands ready to join CHNA in opposition to the clinic. Representatives from Wheeler, Moses Brown, and Hope High School won t take a position at this point but will stay in the loop. Neighbor says that the R 1 zoning s intent was to strengthen the neighborhood and this use will weaken the character of the neighborhood. Josh points out that the building has only four parking spaces. Neighbor suggests that business owners get away with breaking rules then asking for forgiveness, and asks what the city is doing to change this culture. A CHNA board member says the Thayer Street Merchants Association is concerned. Kate Nagel of GoLocalProv says the owners of this building and the Wickenden clinic have criminal backgrounds. 18

Abandonment: Neighbors say it has been abandoned over a year, which would violate it's nonconformity use status Neighbors question who has the burden of proof regarding abandonment and what paper trail there may be Jeff says the City has been lenient on abandonment issues in light of the economic downturn Neighbors believe that abandonment, enlargement of the sign, and nature of use are grounds to prevent its opening *Following this meeting, Jeff confirmed that the building variance (an "as of right" use issued in 1955) means this is not a nonconforming use, so the abandonment consideration does not apply. Permits: 31
26 Neighbor says a work permit for renovations is posted on the door Neighbors question the process to challenge the variance Assumption is that the state, rather than the city, will have a paper trail proving use as a doctor's office If they get a permit, the process to appeal it is to apply to the Building/Zoning Appeal Board. (Permits aren't noticed. Brown U.'s Kate Silberman stands ready to join CHNA in opposition to the clinic. Representatives from Wheeler, Moses Brown, and Hope High School won't take a position at this point but will stay in the loop. Neighbor says that the R 1 zoning's intent was to strengthen the neighborhood and this use will weaken the character of the neighborhood.
