1 RZ Staff Analysis May 21, 2012 Rezoning Petition RZ Museum of the Waxhaws EXPLANATION OF THE REQUEST Petition RZ is a request by the Town of Waxhaw Planning & Community Development Department, on behalf of the Town of Waxhaw Board of Commissioners, for a rezoning / map amendment to rezone the properties located in the Town of Waxhaw and owned by the Museum of the Waxhaws (tax parcels A, B and C) located off Waxhaw Highway/NC-75 from R3 Single Family Residential to OIS Office, Institutional and Specialty. LOCATION AND CURRENT LAND USE The properties are located off Waxhaw Highway/NC-75, with one property (8215) housing the Museum of the Waxhaws. There are also several accessory structures and an outdoor amphitheater located on the properties. Condition and land use of the surrounding properties. The adjoining properties are: To the north A single family dwelling zoned R4 Single Family Residential and vacant land zoned Union County R10 and B4. To the east Single family dwellings zoned R4 Single Family Residential in the Hermitage Place neighborhood. To the south Waxhaw Elementary School zoned R2 Single Family Residential. To the west Single family dwellings zoned R3 Single Family Residential COMPREHENSIVE PLAN & FUTURE LAND USE MAP The Future Land Use Map contained in the 2030 Comprehensive Plan identifies the subject site as Medium-Density Residential. Chapter 4 of the Comprehensive Plan goes on to state the following information regarding Medium-Density Residential : These areas include existing and future areas for development of more dense residential neighborhoods that provide a diversity of housing types and housing options. Areas include single family detached units, mobile homes, townhouses, duplexes, condominiums, apartments, senior housing, and other multi family dwelling units, depending upon the character of existing neighborhoods. Housing densities should range from 3 8 dwelling units per acre. Other types of uses that may occur are schools, parks, and some neighborhood commercial uses, such as coffee shops and small corner grocery stores. PLANNING STAFF ANALYSIS The properties in this request were annexed into the Town in At that time, the Town of Waxhaw did not have its own zoning and relied on Union County zoning to govern the development of properties within the Town. In 1990 the Museum of the Waxhaws was constructed under the County s zoning regulations and conformed with the zoning (B2) in place at the time. The next year, 1

2 RZ Staff Analysis May 21, , the Town of Waxhaw developed a zoning ordinance and zoned all the properties within its jurisdiction. The properties in this rezoning request were zoned R3 Single Family Residential at that time and have been operating under legal nonconforming status ever since. The OIS Office, Institutional and Specialty Zoning District does meet the intent of the 2030 Comprehensive Plan and Future Land Use Map in that it does allow for single-family residential uses. If single-family residences were constructed in the OIS Zoning District, they would be required to have a minimum lot size of 5,000 square feet. According to that requirement, the density would equal dwelling units per acre, slightly higher than the range provided for in the 2030 Comprehensive Plan. Additionally, the 2030 Comprehensive Plan calls for other uses in the Medium-Density Residential designation such as schools, parks and some neighborhood commercial uses. 3 RZ Staff Analysis May 21, 2012 Many of these uses would likely be classified as institutional, recreational or neighborhood commercial as envisioned by the 2030 Comprehensive Plan. The UDO does provide additional oversight in Section by requiring any retail establishment that wishes to exceed 5,000 square feet to obtain a conditional use permit or be approved through conditional zoning, thus preventing a large retail establishment from constructing in this zoning district without the Board s review and approval. PLANNING RECOMMENDATION Planning Staff recommends approval of RZ Rezoning this property would make the existing Museum of the Waxhaws facility more conforming to today s zoning requirements and allow them the opportunity to expand their outdoor exhibits. Statement of Consistency and Reasonableness The proposed zoning of these parcels is consistent with the future planning goals of the Town of Waxhaw and the proposed zoning of this property appears to be reasonable at this time. All establishments developed under the C-1 classification should be scaled to meet the convenience shopping needs of the immediate area and should not be scaled to detract from the C-4 Zoning District. The OIS, Office, Institutional and Specialty District provides for the office and institutional use of land developed in various densities and the adaptive reuse of larger housing stock into specialty shops serving adjacent neighborhoods and business districts. The R-3, Single-family Residential District provides for the residential use of land developed in a medium density pattern. The principle structure of the R-3 Zoning District is the Single-family Detached Dwelling. Minimum lot size is 20,000 square feet. The RM-1, Multi-family Residential District provides for the residential use of land developed in a medium to high-density pattern. The availability of land zoned for RM-1 purposes is to encourage development at higher densities utilizing Cluster Development techniques, Condominium ownership arrangement, Garden Court Dwellings and conventional Two-family and Multi-family arrangements. The C-2, Highway Commercial District provides for the commercial use of land developed for ease of access, visibility and convenience to arterial and collector streets and thier surrounding land uses. Commercial development should be compatible with highway activity and enhance the quality of service available to traveler, commuter and nearby resident alike. The I-1, Light Industrial and Service District provides for the industrial and service related use of land developed around a general theme of manufacturing, fabricating, processing and servicing at a a moderate scale. Industrial and service development should be of compatible nature to surrounding activities including residential, commercial, institutional and governmental. The R-3 PRD, Single-family Planned Residential Development District provides similar land use patterns as the R-3 Single-family Residential District with more flexibility. The principal structure of the R-3 PRD District is a Single-family Detached or Attached Dwelling. The C-3, General Commercial District provides for the commercial use of land developed as an agglomeration of business activity sufficiently separated from residential Zoning Districts by either transitional Zoning Districts such as C-1, C-2 and/or OIS; or, by sufficient buffering and screening measures. Commercial development should be compatible with arterial and collector street systems and accessibility. The R-1, Single-family Residential District provides for the residential use of land developed in a very low-density pattern. The principal structure of the R-1 Zoning District is the Single-family Detached Dwelling. Minimum lot size is 100,000 square feet. The R-4, Single-family Residential District provides for the residential use of land developed in a highdensity pattern. The principle structure of the R-4 Zoning District is the Single-family Detached Dwelling. Minimum lot size is 12,000 square feet. The RM-2, Multi-family Residential District provides for the residential use of land developed in a highdensity pattern. The availability of land zoned for RM-2 purposes is to encourage development at a high density using Cluster Development techniques, Condominium ownership arrangements, Garden Court Dwellings, Zero Lot Line arrangements and conventional Two-family and Multi-family Dwelling arrangements. The C-4, Central Business District encourages land uses which are characteristic of main streets and pedestrian districts and that are solely intended for application in the central core of the Town. This district will allow a mixture of complementary land use types, which may include housing, retail, offices, commercial services, and civic uses. The R-2, Single-family Residential District provides for the residential use of land developed in a low-density pattern. The principle structure of the R-2 Zoning District is the Singlefamily Detached Dwelling. Minimum lot size is 40,000 square feet. The R-4 PRD, Single-family Planned Residential Development District provides similar land use patterns as the R-4 Single-family Residential District with more flexibility. The principle structure of the R-4 PRD District is a Single-family Detached or Attached Dwelling. The split zoned R-3 Single-family District and OIS, Office, Institutional and Specialty District provides the opportunity to co-locate housing and services on large tracts of land. The MH-1 Manufactured Home Overlay District provides for the principal use of land developed in harmony with the primary or underlying zoning district regulations however, permitting the substitution of manufactured homes as a principal use type provided the specific design and/or installation regulations appearing in Section 6.1 of the Unified Development Ordinance are met.!!!! The conditional use district ensures that uses would be compatible with surrounding development and in keeping with the purposes of the general zoning district in which they are located and would meet other criteria set forth in Section 14 of the Unified Development Ordinance.
