Authorize the Chief Executive Officer to award a 21 -month sole source firm fixed price contract to Affiliated Computer Services (ACS) for photo enforcement Operations, Maintenance, and Citation processing services for the Exposition Line for a firm fixed price of $877,800, effective October 1, 201 1, and; B. Authorize the Chief Executive Officer to execute Modification No. 4 to Contract No. SP035 with ACS to provide photo enforcement Operations, Maintenance, and Citation processing services for the Blue Line and Orange Line Phase 1 for a period of two (2) years, and add the Orange Line Phase 2 for a period of one (1) year for a firm fixed price of $2,692,800, increasing the Total Contract Value from $9,569,960 to $1 2,262,760. C. Authorize the Chief Executive Officer to execute Modification No. 5 to Contract No. SP037 with ACS to provide photo enforcement Operations, Maintenance, and Citation processing services for the Metro Gold Line Photo Enforcement Program for a period of eight (8) months for a firm fixed price of $475,200, effective November 1, ISSUE The Los Angeles Sheriff's Department (LASD) supports Metro's position to maintain the highest level of safety for our riders and the public at large, and to consolidate all current photo enforcement contracts with a simultaneous expiration date of June 30, This will allow staff to competitively bid the services for all Metro Lines as a single contract with an effective date of July 1, The benefit of such a consolidation will result in a consistent, unified, and integrated photo enforcement system. The benefits of a single contract are the following: Lower overall Operations and Maintenance (O&M) costs Utilization of existing infrastructure and equipment
2 Interchangeability of equipment among different bus and rail lines Operational efficiency by procuring and managing a single contract instead of several fragmented contracts with different expiration dates. (Currently the Blue and Orange Lines contract expires on June 30, 201 1, Gold Line contract expires on October 31, 201 4, and the Expo Line is expected to start October requiring a separate action.) Metro's safety program consists of three main components - Engineering, Education and Enforcement. The photo enforcement program is the backbone of Metro's enforcement measures. The program successfully started with enforcement of grade crossings on the Metro Blue Line. Based on the effectiveness in reducing unsafe motorist behavior and accidents, the program was expanded to the Orange Line Busway and the Gold Line Eastside extension. The program has now been incorporated into Metro's design criteria for all future fixed guideways. Attachment A provides a complete background and justification for extending and issuing the photo enforcement contracts. The extension of the current contracts will not only allow Metro to receive the maximum return from its 104 current and proposed photo enforcement cameras, but will help Metro achieve significant savings on capital expenditures until the proposed contracts' expiration date. Also, since the Exposition Line is scheduled to begin revenue operations later this year, and the Orange Line Phase 2 will go into operations next year, it is imperative to have the photo enforcement program in effect prior to start-up of these new lines to deter unsafe behavior by motorists well in advance of train and bus operations. This "early" enforcement will result in fewer traffic violations and accidents once revenue service begins FINANCIAL IMPACT The funding of $2,283,600 for this service is included in the FYI2 budget in cost center numbers and 031 1, Corporate Safety and Non Departmental Bus Operations, under , , , Blue, Gold, and Exposition Line Professional Services, and , System wide Operations & Administration respectively. In FYI 1 -to-date, $1,135,200 was expended on these line items. Since this is a multi-year contract, the cost center manager and Executive Officer will be accountable for budgeting the cost in future years. PHOTO ENFORCEMENT CONTRACT Page 2
3 Impact to Bus and Rail Operating and Capital Budget Operatina Budaet Impact Based on historical data, the photo enforcement 0 & M program at Metro has been cost neutral. Historically, the revenues received from citations (which are deposited in the Enterprise fund) offset the cost of maintaining the program. The current contractor provides Metro with a competitive pricing plan for ongoing operation and maintenance of the system after installation. For example, Metro currently pays $2,200 per month per camera for maintenance and citation processing. A survey by Metro staff of other Cities and the County who have photo enforcement programs with other vendors indicated that their monthly maintenance and citation processing costs ranged between $3,880 and $6,030 per month per camera. Although the technology used by the other vendors differs, the effectiveness of all programs is comparable. The source of funds for this action is Prop. A 35%, and Prop. C 40 h, and will be obtained through Metro Blue, Orange, Gold, and Exposition Lines' Operating budgets. Capital Bud~et Impact Since Metro staff negotiated with the current contractor to provide all photo enforcement equipment (cabinets, flash units, cameras, poles) at no cost to Metro, the extension of the current contracts will have no potential capital expenditures. ALTERNATIVES CONSIDERED One possible alternative is to solicit a new contract for the Exposition, Blue, and Orange Lines. This alternative is not recommended because a transition to a new contractor would require Metro to undertake the following steps: Prepare and issue a new solicitation Possibly abandon the existing infrastructure Design, construct and test a brand new system Train all Metro and LASD personnel on new equipment and procedures Manage separate fragmented contracts Furthermore, urgent actions on the Metro Orange Line, and Gold Line Eastside Extension needed to be taken by staff in order to enhance safety, which precluded staff from soliciting a new contract at an earlier date. Another alternative is to discontinue the photo enforcement program, which will save approximately $3,036,000 per year for the existing operating photo enforcement system. This alternative is not recommended because the program has been effective in reducing accidents and unsafe driving behaviors. PHOTO ENFORCEMENT CONTRACT Page 3
4 Based on the LASD and Metro staff recommendations, once the Board approves the extension of current contracts for the Blue and Orange Lines (phase I), and issuance of new contracts for the Exposition Line and Orange Line phase 2, all with an expiration date of June 30, 201 3, staff will initiate an industry review and begin the process to competitively bid the services for all Metro Lines as a single contract with an effective date of July 1, ATTACHMENTS A. 6 The Los Angeles Sheriff's Department (LASD) recommends Metro consolidate all Photo Enforcement contracts under one single contract, and competitively bid the services for all Metro lines as a single contract with an effective date of July 1, The benefit of such a consolidation will result in a consistent, unified and integrated photo enforcement system, which is the best option to Metro and the LASD at this time, and will equate to: - Lower Operations and Maintenance (0 & M) costs - Utilization of existing infrastructure and equipment - Interchangeability of equipment among different lines - Operational efficiency by procuring and managing a single contract instead of several fragmented contracts with different expiration dates. In order to achieve the above goals and benefits, and to maintain the highest level of safety for our riders and the public at large, LASD also recommends extending the three (3) current 0 & M contracts (Blue, Orange, and Gold Lines), and issuing two (2) new contracts (Exposition, and Orange Line Extension) to the current contractor, Affiliated Computer Services (ACS) a Xerox Company, for a period ending June 30", BACKGROUND How The Photo Enforcement Svstem Works. The Photo Enforcement System consists of a camera, pole(s), a data collection device (and film depending on the type of system deployed), flash units and a detection system (such as in ground loops or radar). The loops are installed in the traffic lanes for which enforcement is desired. For example, if the intent is to capture violations for left turns, the loops are installed in the left turn lane. If the intent is to capture violations for straight through movements, the loops are installed in the lanes used for this movement. The camera, flash pole and other equipment is installed in the sidewalk opposite from the direction of motor vehicle movement. Underground conduits and wires connect the loops to the equipment on PHOTO ENFORCEMENT CONTRACT Page 6
7 the sidewalk. The majority of the cameras deployed for Metro are used to enforce left turn movements across rail crossings. (Blue and Gold Lines), but there are also a number of cameras deployed to enforce straight through movements against red traffic lights at Busway crossings on the Orange Line. A valid violation occurs when a vehicle enters the rail crossing or bus way, against the warninglsignal light or gate arms. The detection system calculates the speed of the vehicle and signals the camera to capture two photos, one when the vehicle activates the first loop, and a second photo as the vehicle proceeds past the second loop and is in the intersection. Then the contractor retrieves all the captured photos and processes them for review and citation processing. Each violation is reviewed in a three-step process before a citation is issued. This 3-step process verifies the vehicle front license plate and ownership against DMV records. The photos must also show a clear view of the driver in order to issue a valid citation. The 3rd step involves a final review and approval by a LASD deputy after which the citation is mailed to the motorist. As part of the mailing process, a certificate of mailing is obtained with each notice to appear, certifying the citation was mailed on said date. The motorist has 2 options, either pay the citation or contest it. If the citation is contested, the registered owner or driver can review the citation information and photos by the calling the contractor on the 800 number listed on the citation, and making an appointment to review this information. If the motorist still believes that it is not a valid citation, helshe can appear before a judge to dispute the citation. A LASD deputy represents Metro in this proceeding before the judge. The judge issues a final ruling after hearing both parties. Operation and Maintenance Costs, Capital Savinqs It is important to note that based on historical data, the photo enforcement 0 & M program at Metro has been cost neutral. Historically, the revenues received from citations (which are deposited in the Enterprise fund) offset the cost of maintaining the program. The current consultant provides Metro with what we believe to be the most competitive pricing plan in the market place for ongoing operation and maintenance of the system after installation. A survey by Metro staff of other Cities and the County who have photo enforcement programs with other vendors indicated that their monthly maintenance and citation processing costs ranged between $3,880 and $6,030 per month per camera. Although the technology used by the other vendors differs, the effectiveness of all programs is comparable. Furthermore, Metro negotiated with the current contractor to provide all photo enforcement equipment (cabinets, flash units, cameras, poles) at no cost to Metro. This capital investment by the contractor yields substantial savings to Metro. The photo enforcement program has proven to be effective in deterring unsafe behavior by motorists, and Metro can not afford a lapse in coverage since it may result in an increased probability of accidents and injuries to riders, pedestrians, or motorists. The LASD is extremely pleased with the current photo enforcement program, and is concerned about the following issues if we change the contractor at this stage: Interruption of the photo enforcement program lncrease in unsafe driving habits lncrease in litigation cost to Metro when defending legal action lncrease in system cost without added value Retiring existing functional Metro-owned cameras In addition, the LASD believes that Metro should take full advantage of the technology and infrastructure investments with the current photo enforcement contractor. A new contract could potentially result in requiring the use of camera equipment that would be incompatible with Metro's existing infrastructure. Therefore, significant capital design and construction costs already expended by Metro and the Exposition Authority with the current contractor to design and build the current system on the Blue, Orange, Gold, and future lines (Exposition, and Orange Line Extension) would not be utilized and would have to be unnecessarily duplicated. The photo enforcement program is a key component of Metro's safety enhancement measures that would be seriously compromised unless we are permitted to maintain the current program without lapse. The photo enforcement program reduces Metro's tort exposure by mitigating train-vehicle, and bus-vehicle accidents that occur at transit corridor crossings. Because Metro has existing contracts for monthly 0 & M services on the Blue, PHOTO ENFORCEMENT CONTRACT Page 8
9 Orange, and Gold lines, and the fact that the current contractor has designed and initiated construction on the Exposition line, a transition to a new contractor would require Metro to: Prepare and issue a new solicitation Possibly abandon the existing infrastructure Design, construct and test a brand new system Train all Metro and LASD personnel on new equipment and procedures Manage separate fragmented contracts We understand that the Board prefers Metro competitively bid such contracts. However, since the Exposition Line is scheduled to begin revenue operations later this year, it is imperative that the photo enforcement program be in effect prior to start-up to deter unsafe behavior by motorists well in advance of train operations. This "early" enforcement will result in fewer traffic violations and accidents once revenue service begins. In March 2010, FCIIFLUOWParsons, a joint venture working on behalf of the Exposition Authority, awarded a construction services subcontract, # , to ACS to complete the construction and installation of photo enforcement cameras along the Exposition Light Rail Corridor (which has already begun). 17 Procurement performed a non-competitive procurement with ACS in compliance with Metro's policies and procedures in order to continue the services with ACS which will ensure continued savings for Metro that may not be available through a competitive procurement process at this time.
