M Task Order 2 with the City of Des Moines for the Federal Way Link Extension MEETING: DATE: TYPE OF ACTION: STAFF CONTACT: Capital Committee 03/08/2018 Final Action Ahmad Fazel, DECM Executive Director Dan Abernathy, Executive Project Director Federal Way Link Extension Soraya Lowry, HCT Development Manager PROPOSED ACTION Authorizes the chief executive officer to increase Task Order 2 under the City Services Agreement between the City of Des Moines and Sound Transit for the Federal Way Link Extension in the amount of $236,700, with a 10% contingency of $23,670, for a total not to exceed amount of $385,370 for Task Order 2 and $566,870 for the City Services Agreement. KEY FEATURES SUMMARY The proposed action increases funding for services to be provided by the City of Des Moines for the Federal Way Link Extension during the Request for Proposals (RFP) finalization and the selection phase for the design-build contractor. This amendment will include: o Participating in the design-build contractor selection process as requested by Sound Transit. o o Completing a mutually agreeable staffing plan to support the project schedule. An option to fill key functions/positions needed for design review and permitting after notice to proceed is given to the design-build contractor to support the project schedule. This amendment revises the schedule for Task Order 2 through notice to proceed to the design-build contractor, currently anticipated for August Sound Transit will manage each task order under the agreement separately. Costs authorized under this action are for city staff and city consultant time. Staff will return to the Board, currently anticipated for Q3 of 2019, for approval of additional task orders relating to permitting and construction services to be provided by the City. BACKGROUND The Federal Way Link Extension adds approximately 7.8 miles of light rail from the Angle Lake light rail station at South 200th Street in the City of SeaTac to the Federal Way City Center area in Federal Way. The extension generally parallels State Route 99 (SR 99) and Interstate 5 (I-5), with stations at Kent/Des Moines, S 272nd Star Lake park and ride and the Federal Way Transit Center. New parking structures will be constructed at each of the three stations. Notice to proceed for the design-build contract is anticipated in 2019 and the project is planned to open for service in The Federal Way Link Final Environmental Impact Statement was issued on November 18, 2016 pursuant to the State Environmental Policy Act (SEPA) and National Environmental Policy Act (NEPA), completing the SEPA process. The Sound Transit Board selected the project route, profile, and stations on January 26, The Federal Transit Administration issued a Record of Decision on March 6, 2017 and the Federal Highway Administration issued a Record of Decision on March 9, 2017, completing the NEPA process.

2 In May 2017, the Capital Committee authorized 1) an umbrella City Services Agreement with the City of Des Moines to support expedited design, design review, permitting and construction services for the Federal Way Link Extension and 2) Task Order 1 for the Design-Build Request for Proposals Preparation Phase. The original Task Order 2 was authorized under the Executive Director s authority in the amount of $125,000. FISCAL INFORMATION This action is within the authorized project allocation to date and sufficient funds remain after approval of this action to fund the anticipated remaining work in the third party phase as contained in the current cost estimates. The authorized project allocation to date for the Federal Way Link Extension is $412,625,000. Within that amount, $1,488,000 has been set aside in the City of Des Moines budget line item in the third party phase. The proposed action would commit an additional $260,370 to this line item, leaving a remaining uncommitted balance of $921,130. 3 SMALL BUSINESS/DBE PARTICIPATION AND APPRENTICESHIP UTILIZATION Not applicable for this action. PUBLIC INVOLVEMENT Throughout the development of the Federal Way Link Expansion, Sound Transit has conducted extensive public involvement including mailings, community open houses, presentations and meetings with individuals and neighborhood groups. TIME CONSTRAINTS Delaying Task Order 2 could impact the City s availability to work with Sound Transit on the various RFP Finalization and Design-Build Selection activities defined in the task order. PRIOR BOARD/COMMITTEE ACTIONS Motion No. M : Authorized the chief executive officer to execute (1) a City Services Agreement with the City of Des Moines for expedited design, design review, permitting and construction services for the Federal Way Link Extension and (2) Task Order 1, for the design-build Request for Proposal preparation phase, in the amount of $165,000, and a 10% contingency of $16,500, for a total authorized amount not to exceed $181,500.
