As an example, there is no fence around the pool, nor are the varying depths of the pool marked. Small children are accepted and welcome provided the guests understand and accept all consequences of the fact that the Bird of Paradise was neither designed nor furnished in a manner to ensure the safety of small children. All children should be accompanied and supervised by an adult at all times. There is written information in each suite as well as in the living room and kitchen desks regarding the following items dealing with safety and security: Pool Depths. 3 to 9. No Diving into Pools No Life Guard Safes in Each of the Four Suites Caution with Wet Tile Children Supervised at All Times Use of Security System Location of Fire Extinguishers Smoke Alarms in each Suite Caution with Heights as the Bird is Perched on the Side of a Hill. The Bird of Paradise, its owners, agents, employees and service providers cannot be held liable for any reason for any personal injuries or death or any loss or damage to personal effects.

4 Claims and Disputes Parties agree that this agreement is made in and is to be performed entirely within Anguilla, BWI and claims of any nature shall be resolved in the courts of Anguilla pursuant to Anguillian law.
