Tender No: KR/PD/J&K/HO/Tender/DDC/Tunnels T17 -T18/4/2012 dtd Query No. 1: General Information, Para No. g & h, Page - No. 11: Pre bid meeting has been scheduled on and bid submission on As it is practicable to finalize the international collaborations and identification of experts with international experience only after their doubts on RFP are clarified, it is requested that at least 4 weeks time should be given for bid submission after issue of clarification to points raised in pre bid meeting. KRCL Reply: No change in tender conditions. Query No. 2: Instructions to Tenderers, Clause 2, Para No 3, Page - No. 18: It is stated that Consultancy is invited with NATM including Rigid Support Design. Can the consultant suggest alternate support design considering high overburden. KRCL Reply: Please refer Sr.no. 4 of clause no & , Deliverables & Services (TOR), Page 41 & 44. The design consultant once appointed can make recommendations about the suitability of support systems for different geological strata. Query No. 3: Instructions to Tenderers, Para No 3.0 and sub para, Page - No. 18 Clause no. 1.0 and Sub Para TOR: Apart from civil design of tunnels, only design of drainage and fire detection and suppression system have been mentioned in scope of work and against the objective of deliverables. In this connection following may be confirmed / clarified (i) Please confirm that design of following items is not covered in the scope of work - 1 Reply to pre-bid queries Tunnel Consultancy T17-T18

2 a) Tunnel ventilation b) Tunnel illumination c) Tunnel power supply d) Signaling and telecom e) Control and monitoring system in the form of SCADA or any other form f) Track and OHE in the tunnel (ii) Please advise as to when the tentative designs of track, OHE, ventilation fans etc. will be supplied to DDC as these will have bearing on design of cross section of tunnels (iii) Please confirm that words all associated works in clause 3.10 of ITT do not include any of the items mentioned in (i) above, as these are not covered in the detailed scope of work in TOR and are also not covered in BOQ KRCL Reply: (i) Please refer 3 rd bullet of clause no. 1.0 (objective) of TOR, page 39. (ii) The standard dimensional requirement as per norms are available with the corporation. Any site specific requirement shall be catered during the execution of the work. (iii) The detailed design of items (a-f) given above is not in the scope of present tender. Also refer KRCL s reply at (i) above. Query No. 4: Instructions to Tenderers, Para no. 3.6, page 19: It states that the junction between T18 and T40/41 tunnels (convention method) along with other services to be designed. Please confirm the status of Tunnel T40/41. KRCL Reply: About 250m of tunnel excavation is balance in Tunnel T40/41 in the direction of P-2 (Northern Portal). Junction of T18 with T40/41 is from south side. Query No. 5: Instructions to Tenderers, Para no. 3.7, page 19: Please confirm that rehabilitation works are restricted to Tunnel supports and tunnel portals. KRCL Reply: Clause 3.7 shall be read alongwith clause full 3.0, page 18 and 19 and such relevant clauses in Deliverables & Services (TOR) Query No. 6: Instructions to Tenderers, Para no , & 5.2.6, page 19: To mention the overburden for tunnels or the length of soft strata in tunneling in the client s certificates is not the practice any where in the 2 Reply to pre-bid queries Tunnel Consultancy T17-T18

It is also not practicable for companies abroad to obtain revised client s certificates for old completed works as the clients do not feel the necessity of such certificates. The clauses may therefore be reviewed Query No. 7: Instructions to Tenderers, Para no , page 20: Please confirm that the meaning of this clause is that the lead partner should have done a similar work of 0.51x2000=1020 meters and any partner 0.2x2000= 400 meters, while all combined should have done 2000 meters tunnel. Query No. 8: Instructions to Tenderers, Para No 14 Page - No. 24, Para 25.1 of Special Conditions of Contract, Page 24: The period of contract 5 years, it is requested that payment of escalation may be incorporated in the RFP, as is being done for long term PMC tenders of other PSU s of Indian Railways, e.g. RVNL, DFCC etc. Query No. 9: Instructions to Tenderers, Para No 14.2, Page - No. 24: It has been stipulated that the rates should be quoted separately exclusive of taxes and inclusive of applicable taxes. Please confirm that the rate exclusive of taxes is to exclude only General Sales Tax as applicable. KRCL Reply: Refer financial bid (vol. II/II) note 1, page no. 5 and Sr. No. (3), (4), (5) & (6), Page 6. Please also refer clause 14.0 & 15.0 of Instructions to Tenderers, page Query No. 10: Instructions to Tenderers, Para No 16.1, Page - No. 25: It says that unit rates and the prices to be quoted in INR only. As the project required international inputs, and value of rupee with respect to other currencies fluctuating wildly, it is requested to allow quoting amount in Euros. Query No. 11: Instructions to Tenderers, Para No 18.3, Page - No. 26: As the earnest money is a substantial sum, they may also be permitted in the form of a Bank Guarantee, as is being permitted by other PSU s of MOR i.e. RVNL, DFCC etc. 3 Reply to pre-bid queries Tunnel Consultancy T17-T18

4 Query No. 12: Instructions to Tenderers, Para No , Page - No. 27: It may be confirmed that where tender is proposed to be submitted on behalf of a consortium, tender form can be in the name of the lead member. Refer Clause of Instructions to Tenderers, Page 27. Query No. 13: Instructions to Tenderers, Para No , Page - No. 28, para , page 32, para 36.4 page 36 i. As per Cl 36.4, Agreement between firms bidding as JV or as a consortium has to be registered with registrar of companies. It is submitted that such a registration can be done only if a new company is formed by the partners with resolution of their Board of Directors, new constitution and new Board of Directors etc. This is a time consuming process due to which for consultancy contracts, even Rly Board Tenders allow consortiums to work without a registering a JV company with Registrar of companies. Formation of such a new JV company with two foreign companies is even more difficult. This clause may therefore please be reconsidered. ii. Without a company registered as a new company, the account in the name of that JV can not be opened and a bank guarantee can not be obtained. The performance guarantee may therefore be permitted to be submitted by Lead partner on behalf of consortium/jv Query No. 14: Instructions to Tenderers, Para No , Page - No. 31, para 36.4, page 36. What papers are required to be submitted in case of a consortium, other than consortium agreement, may please be indicated. Refer Clause 22 and clause 25 of Instructions to Tenderers, on page 27 and page 29. Query No. 15: Instructions to Tenderers, point 8 of clause 1: Objective, Page - No. 39. 5 KRCL Reply: Training on tunnel monitoring using construction stage data and instrumentation data during service life period for the personnel of KRCL, is expected from the consultant. Query No. 16: Instructions to Tenderers, General information Please let us know if any hydrological study has been carried out or if KRCL KRCL Reply: Geological and Geotechnical investigations have been carried out and the available data will be shared with the consultant. Hydrological information to the extent available in the above reports may be made use of. After appointment of Consultant any specific study if required may be brought out. Query No. 17: Instructions to Tenderers, Point 2 (e), Page 41. Please advice the scope of work covered under advising solutions to tackle geological and techno commercial issues during the course of work and during the defect liability period. And what is covered under techno commercial issues. Query No. 18: Instructions to Tenderers, Note of point 4, Page 41. We are unable to understand the methodology involved in calculation of per meter length of the tunnel between its portals and between portals and Junctions. KRCL Reply: Please refer Note 1 below Annexure B1, page 4 of financial Bid Vol-II/II. Query No. 19: Instructions to Tenderers, General information. Please advice if Power supply is a part of the scope of work. Also, if there is requirement to define the control room/scada/telecontrol for the tunnel. KRCL Reply: No, the power supply design for Railway operation in Tunnel during its service life is not in scope of present tender. 6 Query No. 21: TOR, clause 2.3, page 45. (i) Please advise the status of instrumentation contract and as to when the relevant Data will be made available (ii) Please confirm that Consultant will have no role in installation during construction of monitoring instruments (extensometer, inclinometers, convergence anchors, etc.) to be provided by an external company or a contractor, as the item is not covered by either the scope of work or the BOQ. (iii) Please advice, if the design team should be made available during the tunnel construction for review and modification of the details/plans for all stages of the works whenever required. KRCL Reply: (i) The relevant data of instrumentation shall be provided to the consultant during the execution of the contract. (ii) Supply and installation of instrumentation will be done by a separate agency. However, the design consultant shall advice on installation of instruments and monitoring of data. (iii) Please refer clause no. 13 of Deliverables and services page no. 53. Query No. 22: TOR, clause 2.3.1, page 45. It may be confirmed that disaster management during service refers to emergency escape requirements for long tunnels mentioned in ITT Para 3.0 only. It may also be confirmed that DDC is not required to prepare Disaster management plan during service but is required only to take that under consideration for designing the tunnel cross section. KRCL Reply: Disaster management plan shall be applicable during the construction (For example please refer page No. 42, item 4 f& g for tunnel no. 17 & similar such items for tunnel T18). Disaster management plans for service will include the rescue passages and spaces to be designed for the tunnels under scope of present tender. Query No. 23: TOR, clause 2.3.(2), page 45. It has been stipulated that DDC is to design complete safety system of the tunnel. This may please be elaborated as to if- Safety system is to be prepared only for construction period to safeguard workers and surroundings Safety system is to be prepared for Service period what elements are to be designed Safety of operation, signaling, safety of maintenance system or only safety against fire as is detailed in scope of work. 6 Reply to pre-bid queries Tunnel Consultancy T17-T18

7 KRCL Reply: Safety system of the tunnel will include safety requirements during construction period. This system will also include the safety requirements during service period by design and provision of safety passages and spaces. The instrumentation requirements during service life of tunnel shall also be laid down by the consultant appointed through this tender. Please refer to chapter Deliverables and services, Page No. 38 onwards. Query No. 24: TOR clause & , page 40 & 43: Please confirm that construction bid documents are to be prepared only for the civil portion of the tunnel and excluding all E&M systems. KRCL Reply: Construction bid documents will be for Civil portion of the tunnel which will include the passages and spaces for other systems like Electrical and Mechanical etc. Query No.25: Clause no , TOR, page 47: Geologists are to interpret the geology of the area and their interpretation of geology is not dependent on method of tunneling, especially outside India. Please reconsider requirement for credentials of Chief Geologist as well as Geologist- Of having experience of NATM Of experience of NATM outside India KRCL Reply: Tender conditions apply. Query No.26: Clause no , TOR, page 47-48: It may be clarified as to who will carry out Day to day site supervision of work in tunnels, Day to day quality checks, Measurements for payments Certification for payment to construction contractor etc. Please confirm that above day to day functions will be carried out by KRCL personnel KRCL Reply: The day to day site supervision of work in tunnel will be carried out by KRCL. As per the work requirement and at regular intervals, site visits and advice of the consultant will be necessary. 8 Query No.27: Clause no , TOR, page 48: The period for which the Consultant s Personnel will be on leave shall not be charged on the bill and the bill must be accompanied with the attendance record for the period. Please confirm, if the above leaves also includes 30 current leaves given to the employee in the year by the consultant. Query No.28: Clause no & 2.4.9, TOR, page 48-49: Please confirm that after setting up framework for QA, inspection and testing, DDC will have no responsibility for day to day check on them. KRCL Reply: According to Clause No , page no. 49, consultant shall prepare and submit quality audit reports at regular intervals. Query No.29: Clause no. 4.1 (d), TOR, page 49: (i) As Geotech field work is not in scope of consultant, the provision in this Para may please be clarified (ii) Since geotechnical survey is to be proposed by consultant (paid and approved by KRCL) and this can be time consuming, please confirm that related delays shall not be responsibility of the consultant. KRCL Reply: (i) The Geo-technical work shall be arranged by KRCL. Please refer (b) of (A) of sr. 1 of clause no , TOR, Page 40. (ii) It is felt that every endeavor will be made to make best use of available data, site surveys and experience. Any specific Geotechnical survey if necessary and approved by KRCL will be organized in expeditious manner. Query No.30: Clause no. 5.1, TOR, page 50: It may be confirmed that the consultant will supplement Data out of available documents and will not be required to carry out any field surveys for the purpose. KRCL Reply: The consultant shall study and review the existing data available with KRCL. Please also refer sr. no. 1 of clause no & of TOR. 8 Reply to pre-bid queries Tunnel Consultancy T17-T18

9 Query No.31: Clause no. 13.0, TOR, page 53, Item 3 of Annexure B2 (BOQ): (i) Reasi/Sangaldan have been prescribed as location for Project office. It is requested that Project office may be allowed to be located in Delhi during the Design period. (ii) It has been advised that Site services should be divided in two groups two operate from Reasi and Sangaldan. However as per TOR as also BOQ, only one group of Key Experts and one group of support staff are proposed to be paid for by KRCL. This discrepancy may please be clarified. Query No.32: Clause no. 8.1, Special Conditions of Contract, page 63-64: As consultant is not required to carry out day to day construction supervision, construction supervision during DLP may please be reconsidered. Query No.33: Clause no. 15.2, Special Conditions of Contract, Page 65: In case of suspension/closure of contract due to emergencies / Force Majeure, please clarify as to how the mobilization/demobilization costs of expat staff will be paid. KRCL Reply: In case of Force Majeure, general conditions of contract s clause no. 17 will be applicable read along with clause no of Special Conditions of contract, page no. 65. Please note the provisions of Clause no. 36 of General conditions of contract also. Query No.34: Clause no. 26.1, Special Conditions of Contract, Page 69: 25% variation may be made applicable to the variation in quantities but not time, as with inflation, the rates do not remain valid during the extra time, unless the contract has an escalation clause. It is not practicable for DDC to take into account escalation for an unknown period. KRCL Reply: Variation up to 25% in quantity will be dealt in terms of clause no. 26 of Special conditions of contract, page no 69. 10 Query No.35: Clause no. 32.1, Special Conditions of Contract, Page 71: The arbitration clause is unlike the Arbitration clause provided in International contracts of Rly Board or of other PSU s like DMRC, RVNL, IRCON etc. KRCL is in effect appointing by itself 2.5 out of 3 arbitrators, while giving only 0.5 choice to the DDC. This may please be reviewed. This being an International consultancy contract, minimum level specified for arbitrators may be upgraded. Query No.36: Appendix 17, Page : Please confirm that no geological mapping for tunnels and portals is to be carried out by the consultant. Also, please advice as to what geological mapping works have been done by KRCL. KRCL Reply: The geological mapping data are available with KRCL and same will be shared with consultant. After appointment of Consultant any specific study if required may be brought out. Query No.37: Financial Bid Annexure- B2, Vol-II: (i) Eligibility criteria for items 1(b), 2(a) and 2(b) are such that only expat personnel will qualify. However basic rates specified are not in correspondence with the requirements. Quoting of rate as % above schedule will result in skew in the rates. These may please be reviewed. (ii) From the total cost given for Item 5, it is presumed that no technical field staff is to be provided by DDC, as the value given may be just the estimate for office accommodation, office expenditure, watch and ward, logistics including transport, communication etc. This may please be confirmed. KRCL Reply: (i) Tender conditions shall apply. (ii) The manpower for site supervision is considered in item no. 1(a), 1(b), 2(a) and 2(b) of Annexure B2. 11 Query No.38: General: Problem of insurgency and security in this area may not be conducive to working of DC unfettered. No mention has been made in the RFP of the security proposed to be provided for DDC personnel working or visiting the area. Please clarify. KRCL Reply: The General Security arrangements are provided by Government in the Project area. As per need Government is reviewing these arrangements from time to time. Query No.39: General information: Please confirm that consultants already shortlisted by KRCL vide letter no. KR/PD/J&K/DDC/EOI/2 dated 22/02/10 on similar eligibility criteria are not required to submit their technical credentials again with this bid. KRCL Reply: All the bidders including earlier shortlisted consultants are required to submit their all credentials, certificates and documents etc as stated in the present tender. Query No.40: General information: Please confirm that evacuation and ventilation modeling is not included in the scope of this consultancy. KRCL Reply: Please refer to Reply to Query no. 3 & 22. Query No.41: General information: Please confirm if aerial survey data is available and will be made available to the consultant. KRCL Reply: Digital Elevation Model of Project Area is available. Same can be shared with the appointed Consultant. Query No.42: General:.. X is a 100% owned subsidiary of.. X, one of the group companies of X... X operates through various group companies provide engineering services in various fields. In such an event, we request the Client to kindly confirm whether.. X can claim the technical and the financial capability of.. X Group with an undertaking provided by.. X Group that in case the project is awarded to.. X, all necessary support (technical & financial) will be provided to ensure the timely completion of the project.
