14 Alternative Water Supply (continued) Municipal Drinking Water Supply Agreement Agreement between DuPont and each interested eligible homeowner that specifies DuPont s commitment for supplying a municipal drinking water supply to each home Framework of proposed water agreement Many residents near the Former Barksdale Works want a municipal water supply DuPont is willing to pay for installation of the water pipeline The City of Washburn is interested in providing the water DuPont is willing to pay for the water for as long as the current owners own their homes Agreement is contingent on federal, state, and municipal approval of all agreements, designs, and permit applications that are necessary for construction and operation of the proposed municipal water extension Agreement also contingent on 7 conditions September 10, 2003 Former DuPont Barksdale Works Project Update 14
15 Alternative Water Supply (continued) Municipal Drinking Water Supply Agreement Condition 1 DuPont will provide at its cost all construction, labor and materials necessary to connect the current primary living space at the PROPERTY to a municipal drinking water supply, which will include a flow meter to measure water use. OWNER(s) will provide final approval of the course that any piping or equipment will take across the PROPERTY. September 10, 2003 Former DuPont Barksdale Works Project Update 15
16 Alternative Water Supply (continued) Municipal Drinking Water Supply Agreement Condition 2 DuPont will provide at its cost all labor and materials necessary to restore any damage to improvements (i.e., buildings, sidewalks, or other permanent or temporary structures) or landscaping on the PROPERTY that result from the connection of the primary living space to the municipal drinking water supply. Restoration shall consist of returning all damaged improvements or landscaping on the PROPERTY to as near as possible the condition existing on the date that construction activities begin. In the case of grass that is damaged as part of the construction work, reseeding of the damaged area is acceptable. September 10, 2003 Former DuPont Barksdale Works Project Update 16
17 Alternative Water Supply (continued) Municipal Drinking Water Supply Agreement Condition 3 DuPont will pay for an average of 300 gallons of water per day for use at the PROPERTY and pay for maintenance of all equipment up to the point-of-entry into the current primary living space on the PROPERTY. The average daily volume of water used at the PROPERTY will be calculated every three months and based on readings obtained from a flow meter installed on the PROPERTY. OWNER(s) will pay all costs for municipal drinking water supplied to the PROPERTY in excess of 300 gallons per day. OWNER(s) can make future requests to increase the average daily allowance of water that will be paid by DuPont, should domestic needs (excluding water that will be used as an energy source) at the PROPERTY warrant additional supply. 18 Alternative Water Supply (continued) Municipal Drinking Water Supply Agreement Condition 3 (continued) Payment by DuPont for the average daily allowance of municipal drinking water specified above will end upon transfer of PROPERTY title as a result of sale, transfer or upon death of OWNER(s). At such time, the new owner will receive and pay water bills from the Washburn utility to reflect its costs under its traditional methodology. If, however, the transfer of PROPERTY is made directly from OWNER(s) to OWNER(s) children, whether by sale, transfer or inheritance, DuPont will receive and pay water bills in accordance with the above methodology for ten (10) years from the date of transfer or until OWNER(s) children transfer the property, whichever is earlier. 19 Alternative Water Supply (continued) Municipal Drinking Water Supply Agreement Condition 4 DuPont will provide all labor and materials at its cost to plug and abandon the existing drinking water well, once municipal drinking water is supplied to the PROPERTY. Upon abandonment or conversion of the drinking water well, OWNER(s) will make no attempt to obtain groundwater from beneath the PROPERTY for any purpose without written permission from DuPont. 20 Alternative Water Supply (continued) Municipal Drinking Water Supply Agreement Condition 5 DuPont will provide all labor and materials at its cost to remove any existing carbon filtration system that was originally installed at DuPont s expense. 21 Alternative Water Supply (continued) Municipal Drinking Water Supply Agreement Condition 6 DuPont and its contractors may have access to the PROPERTY during normal business hours (Monday through Friday between 8:00 a.m. and 5:00 p.m. Central Time) to perform the construction, restoration and drinking water well work listed in CONDITIONS 1, 2, 4, and 5. Access to the PROPERTY for the work described in CONDITIONS 1, 2, 4, and 5 is granted until such time that DuPont or its designated representative(s) has completed all work described. Access to the PROPERTY to obtain flow meter readings is granted for as long as the PROPERTY is in possession of OWNER(s). September 10, 2003 Former DuPont Barksdale Works Project Update 21
