4 The Phase-out in Germany (1) 1998 Accession to power of antinuclear red-green Government (Social Democratic Party, Green Party) Agreement between Government and utilities and subsequently Phase-out amendment to the Nuclear Act Ban of new build Limitation of lifetime of existing plants: allotment of an amount of electricity to be produced by each plant (in GWh) calculated on an operating lifetime of 32 years electricity allotments can be transferred under certain circumstances 7 The Phase-out in Germany (2) Situation Accession to power of a new Government supported by a grand coalition (pro-nuclear Christian Democratic Party, anti-nuclear Social Democratic Party). Coalition Agreement: The Parties cannot agree on the nuclear issue, therefore everything is left as it is; Nuclear Act with Phase-out amendment stays valid. Applications for transfers of production rights from newer to older NPPs denied by federal regulator 8 4

8 Nuclear safety and licensing is a national issue sovereign national authorities licensing procedures according to national law national nuclear safety standards No EU directive (only radiation protection), no EU authority IAEA standards are not mandatory 15 But: urgent need for convergence and harmonization Nuclear has become an international business: small number of vendors marketing their designs worldwide multinational utilities, joint ventures, liberalized markets components manufactured all around the world 16 8
9 Harmonisation is the key to success Vision: Licensing of standardised designs according to harmonized safety requirements This would offer many benefits: for safety for regulators for industry 17 Tendencies towards convergence and harmonization in Europe and worldwide (1) Safety standards WENRA: safety reference levels to be implemented in national regulations by 2010 EU: failed with Nuclear Package; now: bottom-up approach : High-Level Group, encouragement of Member States to proceed with harmonisation MDEP (Multinational Design Evaluation Program) 18 9
10 Tendencies towards convergence and harmonization in Europe and worldwide (2) Regulatory framework, licensing procedures Example UK: here, a regulatory framework existed, but it had to be thoroughly revisited to enable new build. IAEA (Standards, IRRS missions ) CNS Convention on Nuclear Safety EU initiatives (ENEF) MDEP: international cooperation in design review US regulatory system and licensing process as a 19 What must a modern licensing procedure look like from an investor s viewpoint? (1) At the outset: firm commitment to the use of nuclear power and to the project of building new NPPs Example UK: White Paper of the UK Government with a Statement of Need Example Finland: Decision in Principle taken by Government and endorsed by Parliament The political question should we build new NPPs must be resolved before licensing begins and must be kept out of the licensing procedure
11 What must a modern licensing procedure look like from an investor s viewpoint? (2) Licensing procedure: in order to reduce the regulatory risk, the licensing decisions must be taken by one authority (or a team of authorities) predictable stable timely ( streamlined ) in line with international character of new build. 21 Future Developments in licensing of new NPPs in Europe Harmonisation of safety standards for new NPPs: EU, WENRA Joint design reviews Joint inspections of vendors and component manufacturers Streamlined national licensing procedures 22 11
12 Focusing on international harmonisation and modern developments of safety standards of licensing procedures of design reviews is the best way to get a national new nuclear build program started
