12 Features FCC Compliance Our service provides two different texting services and it s important to understand the difference. Transactional Text Messages Transactional Text Messages can be sent when a customer voluntary provides a mobile number. Mobile Marketing Messages The Federal Communications Commission ( FCC ) has introduced new rules under the Telephone Consumer Protection Act ( TCPA ) that go into effect on October 16, The TCPA makes it unlawful for a person to initiate a telephone call to a residential line and to wireless numbers for non-emergency purposes without the prior express written consent of the called party. The TCPA applies to both voice and short message service (SMS) text messages, if they are transmitted for marketing purposes. How is consent defined? The FCC has determined that written agreements obtained in compliance with the E-SIGN Act will satisfy the requirements of the rule, such as, for example, agreements obtained via text message, website form, and other valid forms (see FCC link for more info: Page 12

13 Features FCC Compliance To ensure complete compliance our service requires every customer to Opt-In by giving express written consent. Here is our Opt-In process 1. The customer is asked and authorizes text messages from the dealer and voluntary provides a mobile number. 2. The dealer employee then sends the customer a text message preferably while the customer is in front of them. Our texting platform will see the customer is not Opted In and sends a default text message. USA Motors Inc. Service Bob Jones Page 13

14 Features FCC Compliance 3. The customer must reply back with Yes before our texting platform will allow any text message to be sent to the customer. The customer has 72 hours to respond. If the customer does not respond the message is deleted in 72 hours and the customer is NOT Opted In. Please reply Yes to authorize text messages from USA Motors. 15 Features FCC Compliance 4. When the customers Yes reply is received a second confirmation text message is sent. The process is complete and the customer has given express written consent.
