6 Legislation and Safety Guidelines NSW WINDOW SAFETY LEGISLATION AUSTRALIAN BUILDING CODE Building type All Strata Schemes in NSW Includes new and existing buildings. New buildings only Australia-wide Window type All windows in all rooms where the lowest level of the window is less than 1.7m above the floor and the internal floor below the window is 2m or more above the outside surface beneath. Non-Bedroom Windows where the lowest level of the window is less than 1.7m above the floor and the internal floor below the window is 4m or more above the outside surface beneath. Restricted opening distance 125mm 125mm Does the window need to be permanently restricted? Restrictor requirements where the barrier (wall) below the window is greater than 865mm and there are no climbable elements present Windows do not have to be permanently restricted. 7 Australian Window Safety Legislation FAQ If the lowest level of an openable window is less than 1.7m above the floor and the floor is more than 2m above the outside ground, a safety device must be installed. Safety devices are required all windows in all rooms of existing and new strata schemes that meet the above height specifications. Owners corporations have until 13 March 2018 to comply with the legislation. Windows may be opened to their full extent where it is safe to do so. Windows do not have to be permanently restricted however if a window safety device is capable of being removed or unlocked it must have a child resistant mechanism.
