The preliminary First Draft ballot results are as follows: 28 Members Eligible to Vote 5 Not Returned (A. Blum, M. Gaubert, V. Lovell, P. Saba and V. Valentine) In accordance with the NFPA Regulations Governing the Development of NFPA Standards, attached are reasons for negative votes for review so you may change your ballot if you wish. Abstentions and affirmative comments are also included. Ballots received from alternate members are not included unless the ballot from the principal member was not received. 3 Affirmative with Comment: J. Elvove: The definition, as revised by FR108, isn't clear, and really needs to be revised. M. Gencarelli: Proposed language is confusing. Recommend the following: "The floor area within the inside perimeter of walls that bound an occupancy or incidental use area with deductions for hallways, stairs, closets, thickness of interior walls, columns, or other non usable features. Gencarelli: I disagree, the construction of fire barriers inherently limits the transfer of smoke; other sections of this code imply this. Paragraph states "Where required by other chapters of this Code, every building shall be divided into compartments to limit the spread of fire and restrict the movement of smoke." and states 'Fire compartments shall be formed with fire barriers that comply with Section 8.3." Limiting the transfer of smoke is not equal to a smoke barrier. Furthermore, states opening protectives shall "... restrict the movement of smoke from one side of the fire barrier to the other." Elvove: In a related public input, the submitter proposed additional language for the annex to help clarify the revised definition of "exit" which should have been included in the first revision document. There should be a relationship established. The existing wording should remain following the new addition. Such as..." A reference plane upon which vertical measurements of a building are based and represents the average of the finished ground level adjoining the building within six feet at all exterior walls. Elvove: The Code has always been clear on which requirements prevail when requirements are stated in both the "core" (Ch 1 4, 6 10) and "occupancy" chapters (Ch 11 43) as currently stated in and as proposed in FR100 by modifying (1). However, the Code has been silent on which requirement should prevail when similar requirements appear in multiple core chapters (as proposed by new (2)) or multiple occupancy chapters (as proposed by new (3)), though the latter case is very rare. Hence, I understand the desire to provide additional clarification. I'm just not sure whether the term "specific" as used in (2) and (3) is the best adjective to describe which requirement should prevail where there are multiple applicable references (which aren't necessarily "conflicts"). Note: "specific" works for (1) since it's clear that the occupancy chapter requirements always govern. I respect the fact that there's a desire to avoid the term "more stringent" but when one looks at the two examples provided by FR101 which serves as annex material to , that term does seem to work.
