6 the site State and Local Characteristics State The State of Nebraska and the Nebraska Department of Economic Development have taken great strides to make Nebraska a top state in the Midwest for the data center market and technology related industry. Due to being a Public Power state, Nebraska has some of the lowest power costs in the nation, and, because of the Nebraska Advantage Program, Nebraska is home to some of the most competitive tax and incentive options in the nation. Local The Fremont Technology Park is a municipally-owned 80-acre shovel-ready site generally located at the southeast quadrant of North Yager Road and East 32nd Street within the City of Fremont, Dodge County, Nebraska. The site is data center ready and the City of Fremont is broker friendly. Fremont, Nebraska (population 26,397), is strategically located at the crossroads of major highway links to Omaha and Lincoln. It is 20 minutes west of the Omaha metro area (population 849,517) and 50 minutes north of Lincoln (population 258,357). Drive time to Omaha s Eppley Airfield is approximately 35 minutes. Fremont s Municipal Airport has a 5,500-foot long main runway and is capable of accommodating corporate jets. Electrical power, natural gas, water, and wastewater services are owned and operated by the City of Fremont. The rate structure, reliability, and service for each of these utilities rank among the best in the state and nation. The City Council in Fremont meets every two weeks with provisions for special meetings if necessary. This greatly expedites development within the city. Redundant fiber options from multiple carriers are available at the Fremont Technology Park. Currently, Great Plains, American Broadband, Time Warner, and CenturyLink all provide fiber service to the site and access to the Omaha Colocation Center and other major metropolitan fiber destinations. The 80-acre site s topography is generally flat to very gently sloping. The property is properly zoned. It has all necessary utility services extended to the site and is ready to accommodate building construction. 3

7 the site Fremont Higher Education Metropolitan Community College With campuses in Fremont, Omaha, and Blair, Nebraska, Metropolitan Community College has many work force enhancement offerings, including a Green Data Center Management Degree. Metropolitan Community College in Fremont, in collaboration with IBM, is the nation s first to offer a Green Data Center Management Degree through the IBM Academic Initiative. The courses give students the technical and business skills necessary to prepare them for careers designing and managing energy efficient data centers. Midland University emphasizes quality personal attention. With a 12:1 student to faculty ratio and over 52 student organizations, Midland provides opportunities for a close knit community of faculty, staff, students and alumni. 16 utilities Power Fremont has a municipally owned coal and/or natural gas-fueled generating plant capable of generating the electrical needs of the local customers as well as excess capacity without relying on the electric grid. Fremont has access to power from both Omaha Public Power District (OPPD) and Nebraska Public Power District (NPPD). In case of an outage at the plant, sufficient power can be imported from the grid to support the local electric loads. The site is fed with redundant 69kV subtransmission lines with an available capacity for the Technology Park of 20 MW. Fremont is committed to growing its capacity to meet customer needs. 19 utilities Telecom Currently, four carriers are capable of providing high bandwidth fiber connectivity to the Technology Park. The main Midwest fiber interconnect point is located in Nebraska in the Nebraska Colocation Center at 1623 Farnam Street in Omaha, Nebraska. This interconnect point is the main fiber intersection point between Denver and beyond to the west, Kansas City and beyond to the south, Chicago and beyond to the east, and Minneapolis and beyond to the north. 20 utilities Telecom The carriers that are at or adjacent to the Technology Park are: American Broadband American Broadband has a fiber hut placed in the southwest corner of the Technology Park that is ring fed with a 48-strand fiber optic cable that comes from the east and north of the site. American Broadband is planning on creating at least three diverse fiber routes into the Technology Park if necessary. The company is capable of providing 10 Gbps service to the site today and can expand that data rate if necessary. American Broadband is capable of providing Tier One interconnect in Omaha, Nebraska on diverse routes or, as differentiator, directly to several other major U.S. cities without intersecting through the colocation facility at 1623 Farnam in Omaha, Nebraska. Actual test results taken from the fiber hut at the site to the colocation facility at 1623 Farnam show zero packet loss and a minimum ping time of 5 milliseconds, an average ping time of 11 milliseconds, and a maximum ping time of 219 milliseconds. 21 utilities Telecom Great Plains Communications Great Plains has a ring fed 288-strand fiber optic cable and splice hand hole directly adjacent to the southwest corner of the Technology Park that comes from the west and south of the site. Great Plains is currently capable of providing up to 10 Gbps of bandwidth to the site and can expand if necessary. The company can provide connectivity to Tier One internet carriers in either Omaha, Nebraska (Cogent), or Norfolk, Nebraska (CenturyLink). Great Plains is willing to provide an Ethernet Service Level Agreement that states it can provide a monthly average latency of less than 40 ms, a monthly average packet loss of 0.1 percent and a monthly average Jitter of less than 10 ms (1-way), all to the colocation facility at 1623 Farnam in Omaha, Nebraska. A differentiator for Time Warner is that its fiber route travels southwest of Fremont to the Point-of Presence in Lincoln, Nebraska and the company can provide high bandwidth connectivity to other major U.S. cities from Lincoln, Nebraska without passing through the colocation facility at 1623 Farnam as most other carriers do. Time Warner s Service Level Agreement targets a latency of 50ms to its facility in Lincoln, with an end to end circuit availability of percent uptime and a packet loss of less than 0.1 percent. 23 utilities Water Fremont has virtually an unlimited water availability. The site has a redundant municipal water loop with 70 psi. The average water temperature is degrees Fahrenheit, which represents a significant savings in cooling costs. The water system and water treatment plant is owned and operated by the City of Fremont. Thirteen wells provide the source for the city s water system for a total capacity of 21.6 MGPD with an average daily use of 4.6 MGPD. Two 30-inch redundant water mains extend from the well field three miles east of Fremont to the water treatment plant at 607 South Luther Road. Nine wells operate in the well field and four wells within the city limits for a total of 13 redundant wells. The pressure for the water system in the city is provided by the pumps at the wells. There is 5,000,000 gallons of above-ground storage tank capacity existing directly adjacent to the water treatment plant. The water treatment plant has three redundant 400 hp pumps for refilling the water tank. Only three outage events have occurred since 1998, each with a duration of less than 10 minutes. Four diverse possible connection points exist for the water supply at the Technology Park, each within the perimeter of the site. The site has a 20-inch water main as the primary source for water to the Technology Park. 27 utilities Sanitary Sewer The sanitary sewer system and treatment plant is also owned and operated by the City of Fremont with a no strike contract. The collection piping system is a gravity flow system with one lift station. The lift station is equipped with redundant pumps. Multiple redundant connection points exist for sanitary sewer within the perimeter of the Technology Park. A 24-inch sewer pipe connects to the site. The City of Fremont average daily use is 4 MGPD and plant capacity is MGPD. The following information is from the City of Fremont municipal code book regarding the sewer rates in Fremont: An ordinance of the city of Fremont, Nebraska, amending rates, minimum charges, and surcharges for the use of the municipal sewerage system; repealing ordinance no and all other ordinances or parts of ordinances in conflict with this ordinance; providing when the rates, minimum charges, and surcharges are effective; and providing when this ordinance shall be in full force and effect. Be it ordained by the mayor and city council of the City of Fremont, Nebraska, that: Section I. 33 utilities Air-Side/Water-Side Economization Hours Estimate of Air-side Economizer Hours The Fremont region typically has approximately 7,000 annual air-side economizer hours. The average annual high temperature is 61.7 degrees Fahrenheit and average annual low temp is 38.3 degrees Fahrenheit. This potentially represents a significant savings in cooling costs due to the ability for free-air cooling in the Fremont region. 35 zoning and permitting The entire Fremont Technology Park is zoned as a Business Park. This district is designed to promote the development of planned business parks that accommodate corporate offices, research facilities, and structures, which can combine office, distribution, and limited industrial uses. They are characterized by extensive landscaping, abundant parking facilities, and good visual and pedestrian relationships among buildings. The City of Fremont has special and overlay districts, including Mixed Use District (MU), which allows minor modification to be made to the regulations of the base zoning district. The Mixed Use District requires developing a mixed use plan and a mixed use agreement. These agreements must be approved by the City Council. This mechanism allows for minor modification of the base zoning district regulations when appropriate to adapt to a special case scenario. Highways The Technology Park is located 1 mile east of state highway 77, a two-lane highway that runs north/south through Fremont. The site is located 1.5 miles west of state highway 275, a four-lane highway that runs north/south east of Fremont and onequarter mile north of state highway 30, which runs east/west through Fremont. Natural Gas An 18-inch gas transmission line runs east/west along the northern boundary of the site. Nuclear Power Plants The nearest nuclear power plant is the Fort Calhoun Station operated by the Omaha Public Power District. The plant is 25 miles east of the Technology Park. Military Installations The nearest military installation is the Offutt Air Force Base. The base is located 36 miles southeast of the Technology Park. 36

49 incentives Local Economic Development Programs Local Option Municipal Economic Development Act The Nebraska Local Option Municipal Economic Development Act (LB 840, 1991) authorizes incorporated cities and villages to collect and appropriate local tax dollars (sales and/or property tax), if approved by the local voters, for economic development purposes. The City of Fremont invests local LB 840 funds to attract new industries and retain or expand existing businesses in Fremont. Funds are offered to businesses in the form of low or 0 percent interest loans and performance-based forgivable loans (grants), based on creating new jobs and investment in Fremont, Nebraska. Fremont Economic Enhancement Fund The Economic Enhancement Fund is established to encourage population growth, new industries, and investment in the community. The goal of the highly competitive incentives package is to bring Nebraska to the forefront in attracting data centers to ultimately create quality jobs, spur investment, and strengthen Nebraska s economy. Key enhancements to the Nebraska Advantage package offer a wide variety of benefits for large data center projects, including incentives for the following: 2006 Nebraska Advantage enhancment to includes wage credits rewarding higher paying jobs like those found in data centers, sales tax refunds on all project capital investment, and investment credits for qualifying businesses such as data centers 2010 Personal property tax exemption for computer equipment and peripherals used in data centers or Internet web portals added to Tier 2 and Tier Special LDC (Large Data Center) provisions added to Tier 2 allowing real property tax refunds sales and use tax 2012 Special provisions created allowing LDCs to realize personal property tax exemption from any January 1 following acquisition recognizing the need to invest heavily in computer equipment early in the ramp up period of employment 2012 Clarification of an existing law allowing publicly owned utilities to leverage excess electricity generated to negotiate lower rates for data centers These recent developments to Nebraska Advantage place a greater emphasis on capital investment, innovation, and job creation. Combined, the incentives make Nebraska the best location for large data centers when considering total cost of operation! 42

52 incentives Nebraska Advantage Details of 2012 Enhancements Created by LB 1118 LB 1118 creates an additional Tier 2 qualified project for large data centers. LB 1118 provides an additional benefit for large data center projects, in addition to the benefits currently available for other Tier 2 projects, for a 10-year personal property tax exemption for those projects. LB 1118 also allows a taxpayer to sign a single agreement for a Tier 2 large data center project and sequential Tier 5 project. Investment and Employment Requirements $200 million investment and 30 new employees at the large data center project A data center is defined as computers, supporting software equipment, and other organized assembly of hardware or software that is designed to centralize the storage, management, or dissemination of data and information; environmentally controlled structures or facilities or interrelated structures or facilities that provide the infrastructure for housing the equipment such as raised flooring, electricity supply, communication and data lines, Internet access, cooling, security, and fire suppression; and any building housing the foregoing. Benefits for Large Data Center Projects Sales and Use Taxes Refund A refund of all sales and use taxes paid on tangible personal property for use at the project from the date of acquisition through the entitlement period. Income Tax Credit A graduated income tax credit (three percent, four percent, five percent, six percent) based on the average wage of new employees. Investment Credit An investment credit of 10 percent of the investment made in the project. Personal Property Tax Exemption A personal property exemption for all personal property used at the project beginning any January 1 following acquisition and for the following nine years 43

53 incentives Nebraska Advantage Real Property Tax Refund After achieving the required levels of investment and employment, the taxpayer may use his or her credits to receive a cash payment from the state equal to all real property taxes paid between the year of acquisition through the carryover period. Credits may be carried over but not longer than 14 years after the application year. Sequential Tier 5 Project A sequential Tier 5 project must meet the investment requirement within four years after the expiration of the sales tax entitlement period of the preceding Tier 2 large data center project relating to direct sales tax refunds. A sequential Tier 5 project receives the sales tax and personal property tax benefits described earlier for a Tier 2 large data center project. Recapture All benefits are subject to recapture should a project fail to attain or maintain the required levels of investment and employment. Interest is due on recapture of the personal property tax exemption based on the date the tax would have become delinquent. 44
