In order to avoid cognitive capture, discussions were held with DFMAS staff, the NevadaWorks director, and our National Office, we ve determined that NevadaWorks RFP solicitation generally complies with 2 CFR Section Methods of procurement to be followed, especially section (d)(1) that states Requests for proposals must be publicized and identify all evaluation factors and their relative importance. Any response to publicized requests for proposals must be considered to the maximum extent practical; Emphasis on the last sentence. Therefore I recommend the State accept NevadaWorks RFP solicitation as meeting the requirements of this section. However, I would strongly recommend that future competitive procurement solicitations provide funding availability information as part of the solicitation and where appropriate, be part of the evaluative criteria. On the contrary, our RFP allowed agencies to make a proposal with no ceiling for funding and clearly request a budget and budget narrative. The following Q & A triggered a question. 1. Can a Local Board issue a Request for Proposal (RFP) or Invitation for Bid (IFB) that does not include any funding? No. A local workforce development board (WDB) (or State WDB, in the case of single-area states) cannot issue a request for proposal (RFP) or invitation for bid (IFB) that includes no funding, or only includes nominal funding. An RFP or IFB with no funding or nominal funding will restrict competition and will result in either no responses or a limited number of responses from entities already receiving Title I funds. Such an RFP or IFB would violate the prohibition on noncompetitive pricing practices under 2 CFR (a) and 29 CFR 97.36(c)(1)(iii). I have attached the Northern Board s RFP. It does not state no funding or nominal funding. On page 10 it states to supply a Budget Narrative and Detail. Does this meet the requirements of 2 CFR (a) and 29 CFR 97.36(c)(1)(iii)?
