It must be clearly mentioned in the technical bid in case the vendor is not willing to provide the console software else it shall be assumed that the console software shall be provided. COS / QOS shall be established by the vendor such that all users in the Institute are configured 50% of supplied bandwidth and the remaining bandwidth is dedicated to the application server holding the website. The vendor shall have to change this configuration as per the requirement of the Institute. Please confirm whether Backup Link (MPLS & ILL) to be terminated on same router of Primary Link. For Public network (Internet Leased Line) there is no point of implementing COS/QOS in the service provider network. All the requirment of bandwidth segregation & allocation can be done at CPE itself & on the MPLS VPN It should be two different routers. COS/QOS is required to be configured when in any of the spoke site the CPE( like Firewall) is not available and only Router is avaialable and the same will be managed by Vendor as per RFP. 3 Part 2:J The Institute has a disaster recovery site at Sify s data center in Ahroli, Mumbai. During disaster all operations shall be shifted from the Noida Office to the disaster recovery site. The vendor is binded to up grade the bandwidth within four hours of intimation. The active site will be established at Sector 62, Noida and Lodi Road, New Delhi will be the passive site. Please take active bandwidth of desired capacity or go for burstable bandwidth option at DR to avoid dependancy on service provider during disaster. DR location is Sify's site from where we will start working at the time disaster in the primary data center at Noida. In that case we may start working from the passive site i.e. ICSI HQ at Lodi Road, New Delhi and since the number of users in that site will increase, it may require bandwidth upgradation in ICSI HQ. Exact bandwidth requirement same to that of the Noida Site Part 3:g The managed services team at the backend must have the software in place to generate bursts to monitor bandwidths against each COS/QOS channel. The output reports of these tests shall be shared with the Institute on every Monday, on weekly basis a Bidder should be a Class A Network Service Provider and should submit the documented proof of ISP License for the same. Non submission of the appropriate documented proof will lead to technical disqualification of the bidder. Generating proxy burst traffic by the service provider in the customer private network defeats all the purpose of security. Request ICSI to do these testing within its own network by themselves. Please allow all licenses (UASL / UL / Class A) issued by DoT for providing internet services. Additionally you may ask for NLD license. a SLA is to be signed between the Service provide and ICSI b Recurring cost on annual basis. Please amend it to monthly / quarterly in arrears. Already answered in S.No Chapter : 5 Annual Charges asked for multiple bandwidth option. Please confirm what is the significance of future bandwidth option, whether CPE router to be designed as maximum bandwith option given. Also confirm whether these future bandwidth price would be considered for the L1 calculation or not, if yes then how? d Corrective Maintenance:Reconfigurations of the system (as and when new updates of software version are released) by the Service Provider as per RFP The fault should be in any case resolved in 2 (two) hours of recording of the same In case of default of any or all of the mentioned conditions a (Rupees Two Thousand only) per hour or part of hour for the delay period will be levied on the Service Provider. MTTR should be 4 hours. Additional penalty should be removed as anyway SLA related penalty exist in the RFP. The Institute may consider MTTR of 4 hours for the remaining sites.

4 18 34 Compensation against Network Non Performance. In case the service is continuously unavailable beyond 30 minutes for the central hub (ICSI Lodi Road and ICSI Noida sites) and 2 hours for the nodes, for any reasons, the bidder shall extend the period of service by one day for every 30 minutes of down time, However, the total downtime shall not extend 1(one) day/24 hours in a quarter otherwise ICSI reserves the right to review and terminate the services of the bidder. It would be the responsibility of vendor to ensure the desired uptime to avoid any penalties SCOPE OF WORK The Institute of Company Secretaries of India intends to hire MPLS VPN (for 16 sites) & Internet services (for 2 sites) for its offices called the ICSI Lodi Road New Delhi; ICSI Sector 62 Noida; ICSI NIRO Prasad Nagar, New Delhi; ICSI WIRO Nariman Point Mumbai; ICSI EIRO Ahiripukur Kolkata; ICSI SIRO Nungambakkam Chennai; ICSI CCGRT, CBD Belapur Navi Mumbai and other offices as per the detailed address given in the tender on end to end basis for a period of three(3) years. Services as per the Service Level Agreement will have to be started after completion of work within three weeks of the award of contract. Response time to be amended as 30 minutes and resolution time should be 4 hours We believe that Delivery, installation & commissioning will be completed within 90 days from the date of the purchase or work order. For seven office i.e. ICSI Noida, ICSI HQ, New Delhi, 4 Ros and CCGRT, MTTR will remain same. The Institute may consider MTTR of 4 hours for the remaining sites. Please refer to clause "36. 5 21 18 h h) All H/W such as Routers, MUX etc for all the locations shall be provided by the vendor under the Opex model and the cost of the same must be built in the annual cost of the services. The routers for all the locations should be latest model of CISCO CPE routers supporting both the MPLS and Internet Network connectivity requirement of the Institute. The service provider will provide managed services (ENOC services) on the network and onsite support for these hardware s as well g Any equipment like radio mast etc shall be on lease to ICSI for the duration of the contract and only, roof top access, space for pole / mast, UPS power and equipment earthing at each location for delivery of MPLS, internet connectivity on RF would be provided by the ICSI. Clearance from local authorities for installation of Radio Mast shall be the responsibility of the vendor. Please confirm, if bidder has to provide separate router for terminating Internet & MPLS Links at ICSI Noida & ICSI Delhi site. Also if Primary Secondary MPLS & Internet Links shall be terminated on same router. We believe that Space, UPS, Power and Earthing shall be provided by ICSI at all sites. It should be two different routers. This is clearly mentioned in the clause a A Dedicated link (unlimited data transfer rate) at the location ICSI Lodhi Road, New Delhi and Sector 62, Noida Office with 1:1 sharing. Bandwidth Management can be done on ICSI's existing UTM Box k COS / QOS shall be required for 3 (three) application servers and EPABX. The console software / portal of the vendor should be configured by the vendor to measure each QOS separately Hardware Firewall/UTM: Presently 4 (four) UTM Firewalls Please confirm the Scope of Work related to Firewall/ with redundancy are available at 2 locations (Delhi & Noida) UTM box for ISP or it will be under ICSI's Scope. 2 UTMs at each location. The UTM Firewall is providing additional functionality of IPS, bandwidth management, HTTP Proxy, web and content filtering, and reporting. ICSI is using Cyberoam CR 100ia firewall/utm at ICSI HQ Lodi Road, New Delhi site and Fortinet 240 D firewall/utm at ICSI NOIDA Site (HUB site) as on date. Page 5 of 12 COS/QOS is required to be configured when in any of the spoke site the CPE( like Firewall) is not available and only Router is avaialable and the same will be managed by Vendor as per RFP. Firewal maintenance is under ICSI scope and for any kind of configurations in the firewall for the purpose of network implementation and mainteance, ISP has to work hand to hand with the Firewall maintenance firm of the ICSI.

The output reports of these tests shall be shared with the Institute on every Monday, on weekly basis b Services to be provided over Owned Infrastructure. Please elaborate the clause, need more clarity on owned infrastructure d Owned Fiber MPLS / Internet Network Backbone Strength Please change this clause to "Bidder must have Fiber backbone strength for their MPLS / Internet Network" e Demand Based bandwidth We request you to modify the clause, usually ISP provide bandwidth on demand for internet Services and not for MPLS. Network connectivity in all the sites should be completely on the own infrastructure of the firm without association with any other firm for all primary links. Both ILL and MPLS bandwidth needs to be upgraded as per the requirement of the Institute as and when required g MPLS network integration for mobile users ( CDMA 1X and HSD/ 3G network) i Single window for Voice (Fixed Line + Mobile), Video and data services Please elaborate SoW for ISP and also confirm what documentary proof ISP shall provide against this clause. We request you to remove Fixed line + Mobile from this clause as CoS on MPLS caters only to Voice, Video and Data services. Connecting MPLS/ LL to Fixed line / Mobile/ Public network is prohibited and is illegal in India as per TRAI and DoT norms. Firm's MPLS network in all the sites should be capable to integrate itself with all mobile devices for providing network services to the mobile users. If any requirement as per RFP is prohibited as per government norms, the bidder has to produce the proof for the same and also provide and implement solution to resolve the requirement at no additional cost j SLA Network Availability > 99.9% (5 marks) < 99.9% > 99.5% (4 marks) < 99.5% (3 marks) 99.9% Uptime can be achieved on dual last mile and not on single last mile. We request you to change this clause. On single last mile maximum 99.5% uptime SLA can be committed by all Service providers COS / QOS for VOIP / Video Conferencing services between 7 offices of the Institute where fiber is expected should be implemented as a part of the current order. Please confirm the Scope of Work related to Video Conferencing services between 7 offices of the Institute. Also confirm VC End Point availibility, make & model at all 7 Location. Request amendment as it can be in favour of single OEM, also service provider's can provide there own NMS of Proactive CPE monitoring b) Leased components cost, if any would be paid on annual ARC to paid in quarterly advance or arrears basis and calculation would be done on Three (3) years basis e. The bidder should be a profit making firm in the immediate past 3 financial years. The bidder should submit the documentary proof for the same f. The bidder should have network presence at pan India level in terms of terrestrial and wireless network and should have major market share of Data solution like MPLS, ILL etc in India. Bidder should occupy one of the first Ten (10) positions in terms of market share of Data solution like MPLS, ILL etc in India. Necessary documentary proof should be submitted for the same The vendor shall provide 60 static IP addresses (15 at ICSI Lodhi Road, 40 at ICSI Noida, and 5 at any other locations to be determined by the Institute), which should be built in the annual cost. request deletion of clause What Documentary proof need to be submitted for compliance Request to provide IP justification for each site. The vendor must ensure SMS Alerts to specific mobile numbers as provided by the ICSI. The mobile numbers will be configured on vendor s system within 7 days of SLA sign off between ICSI and vendor. What is the COS mix expected Need Clarification COS/QOS may be implemented as per requirement. SMS alert service needs to be configured for proactive monitoring of the network failure ICSI may procure internet links and point to point link from other service provider to develop redundancy at the central hubs. The service provider shall be responsible for any configuration changes or management of devices Aviation Lamp to be placed on the top of the mast (if radio link quoted), it includes electric cable, sockets, switches etc required for the fitting of the same from electric supply from server room. We will not manage or allow any other service provider links to be installed in the CPE which is provided by us Need Clarification For backup links which will be provided through third party service provider, the complete responsibility of the succesful monitoring will remain with the bidder. For the installation of RF link wherever provided as per RFP, every thing will be supplied by the vendor under OPEX model and the electric supply for implementation will be povided by the Institute's office. 9 44 Indemnity The quotationers hereby covenants and agrees to indemnify and shall at all times keep indemnified the ICSI against any loss or damage that the ICSI may sustain as a result of the failure or neglect of the quotationers to faithfully carry out its obligations under this agreement and further to pay for all losses, damages, costs, charges and expenses which the ICSI may incur or suffer and to indemnify and keep indemnified the ICSI in all respects. Any indemnity clause without a Total Liability Limit is unacceptable. We have indemnity clause but there is no clause to limit our liability, ANY damage should be replaced by DIRECT damage, Failure should be replaced by Failure amounting to material breach... and neglect should be replaced by gross negligence COS / QOS for VOIP and Video Conferencing services to be implemented on MPLS network connectivity between ICSI Lodhi Road, Noida, all Regional Offices in the four metros and CCGRT office at Mumbai of ICSI must be implemented along with the installation of Fiber connectivity as a part of the job order. Logical channels is also to be implemented for the website running from Noida Office such that the traffic pertaining to the application server is not only isolated from other internet traffic for the Noida Office but also measurable Liquidated Damages If the Tenderer fails to deliver any or all of the goods or complete the installation/ commissioning within the period specified in the purchase/work order, ICSI, shall without prejudice to its other remedies, deduct as liquidated damage 1.0(one) percent of the price of the delayed goods for every week of delay or part thereof. 10 A few goods/materials may be selected or ordered or procured on complimentary basis/subsidized basis/discounted rates from any manufacturers or firms by the ICSI at its sole discretion and the ICSI reserves the right of making the payment directly for such goods or materials. In such a situation the market value of the goods/materials so procured would be deducted from the value of Tender. Whether the goods are ordered by the Tenderer or ICSI, the Tenderer shall at his own cost, fix the same if called upon to do so and the Tenderer shall also receive and sign for such goods and be responsible for their safe custody from the date of their delivery till the date of their incorporation in the works. need clarification Under OPEX model, this clause may not be used Termination of the Contract. Independent gateways would be used for all the locations and if one link goes down then all Internet traffic routed to available gateways c Internet bandwidth should support secured Site to Site IP VPN and it can be used as backup link for both the offices. Degraded backup bandwidth can be accepted for a minimum of 2 MBPS. In such cases, the penalty for the first two hours of the primary link going down may be condoned on the written request of the service provider.
