In case, a go-ahead is given for delivery and if it is found that the site is not ready due to delay in completion of work from the Bank side, 90% payment will be released after 4 (four) Weeks from the date of delivery of material at that respective branch/location and on corresponding sign off from the Bank official on the Delivery Challan indicating very clearly that Site t Ready (SNR). Further, if the vendor is not intimated of site readiness by the Bank within 12 (twelve) Weeks of the delivery of equipments, then the balance 10% of the payment will be released. The Bidder should arrange engineer for installation of such equipment as and when branch site gets ready for installation. Modified/Revised clause Schedule for Receipt of Bids: Date - 30/11/2015 ; Time - 16:00 hours Schedule for Opening of Technical Bids : Date - 30/11/2015; Time - 16:30 hours The payment terms are modified as advance payment will be made on awarding the contract Payment will be released in following way % payment will be released after Delivery, Installation, acceptance of the hardware and submission of necessary documents like CAL, delivery challan, original invoices, installation report& acceptance certificate duly signed / sealed by authorized official of the Bank and road permit receipt (if any). Authorized Bank official s full name, his EIN no. and contact no. shall be mentioned by hand on the Delivery Challan& Installation Report (IR) in case seal is not available at the location % payment will be released after Bidder executes all the documents as mentioned in Para ( Signing of Contract ) & Para ( Performance Security in the form of Bank Guarantee ) The first statement "100% of payment will be made after Bidder satisfies conditions mentioned in & above" from this clause stands removed. 2 RFP Page Section / Clause/Para Existing clause 4 39 Clause 18 If the Successful Bidder fails to deliver any or all of the Systems and equipments mentioned in the Purchase order (PO) or install the same within the time period(s) specified in the Contract, Purchaser shall, without prejudice to its other rights and remedies under and in accordance with the Contract, deduct from the Contract price, as liquidated damages, a sum equivalent to 0.50% per week or part thereof of the contract price subject to maximum deduction of 10% (ten percent) of the total contract price. In case of undue delay beyond a period of 15 (fifteen) days unless otherwise waived by the Purchaser, Purchaser at its discretion may consider termination of the Contract Clause In case the Bidder fails to meet the above standards of maintenance, there will be a penalty of Rs.1,000/- (Rupees Five hundred only) per day, subject to a maximum of 10% of the System cost. The penalty amount would be deducted or adjusted against any amount payable or PBG Clause 10.1 The vendor will ensure that the stipulated Support and maintenance facilities on the hardware / software will be available for a minimum period of 5 years. The proposed product should not be under End of Sale for the next one year or till the end of warranty period, whichever is later and should not be under End of Support for the next 5 years.
