2 Terms and Conditions of BCEL i-bank Service (For Personal/Retail User) Article 1: Scope Financial Inquiries 1.1. All users of BCEL i-bank are able to inquire financial information and create financial transactions of saving and current accounts, monitor fixed deposit and loan accounts, and acquire account statements 24/ For domestic fund transfer (DTF) via BCEL i-bank, the users can inquire the service 24/7; but the transaction will be processed in business hours as stated below: Transactions made on business days from the beginning of the day to 12:00 noon will be processed and sent to the destination bank at the end of a day. Transactions made on business days after 12:00 noon and on holidays will be processed on the next business day. Transactions made on the bank's monthly and quarterly account summary day must be created before 12:00 noon. Transactions made during the bank's annual account summary will not be processed. BCEL annual account summary will be informed publicity in advance For international account transfer (ITR) via BCEL i-bank, the users can inquire the service 24/7; but the transaction will be processed in business hours as stated below: Transactions made on business day before 1:00 PM to banks in Asia region will be processed and sent to the destination bank at the end of the day. Transactions made on business day after 1:00 PM or on holidays to banks in Asia will be processed on the next business day. Transactions made to banks outside Asia will depend on the connection between the bank and the destination bank The users can enter to BCEL i-bank globally through devices which have access to the Internet The users registered for SMS OTP will receive an OTP code within Lao P.D.R. only Transaction made in cut-off period may be denied or will be processed in the next working day. Article 2: Terms and Conditions The users agree to follow Terms and Conditions for using BCEL i-bank as follows: 2.1. The users shall support and fill all current information in the form along with signature(s) based on the account's specimen of signature and required documents. In case of permitting another person to register BCEL i-bank/m- Bank on your behalf, the users shall lawfully permit the representative person with a letter of authorization In case of joint signatures, the form must be signed by the related person in order to activate BCEL i-bank The users must change new password immediately after receiving a PIN from the bank and keep it securely along with a user ID and OTP device The users must strictly follow instructions, procedures, rules, and regulations of using BCEL i-bank In case of any suspicious account activity made via BCEL i-bank, the users must inform the bank immediately The users do agree and acknowledge for any changes of these terms and conditions, daily limit of making transactions, agreements, and service fees and charges conducted by the bank periodically Before creating a transaction, the users must ensure that there is a sufficient fund in a balance of an account to do the transaction and to deduct for service fees and charges with an accordance to regulations of BCEL The users acknowledge that creating domestic fund transfer and international account transfer via BCEL i-bank must be filled with accurate information of the destination account including a telephone number or an address in UPPERCASE letters For making bill payments via BCEL i-bank, the users must follow the instructions carefully by presenting a correct bill provider and details of the paying bill. In case of making a incorrect bill payment, the users must contact the bank immediately In case of modifying the users' transaction, the users must contact the bank with a request letter and details of the transaction The User shall enter the system via BCEL's website only by noticing for SSL Certificate shown as a lock with the full name of the Bank in green letters or background on the address bar of the browser when accessing to the BCEL i-bank webpage. 3 2.12. The User shall not enter or update any financial information, user ID, password, or OTP code to a scam such as phishing via a website, SMS, or online advertisements that does not come from BCEL main site; and shall inform the phishing message to the Bank via 1555 (BCEL e-banking Hotline), and send it to e- banking@bcel.com.la or bcelhqv@bcel.com.la. Article 3: Exceptions of Responsibilities of the Bank The bank will not responsible for any losses or damages resulting from following reasons: 3.1. Other person uses the users' user ID and Password to login to the system, with or without the permission of the users A transaction made on BCEL i-bank that is not correct or violates terms and conditions of the bank as well as the laws and regulations in Lao P.D.R Unexpected circumstances which delay or cause problems to the transaction such as: Computer system or telecommunication failure from the users, the bank, or the Internet providers. The bank's system malfunction such as cannot access to some functions, cannot see a transaction to check or authorize, etc. Natural disasters such as thunder, flood, etc. Incorrect destination account number Exposure of financial information to the third parties through BCEL i-bank without any consent or authority from the account owner In case the users find out that the destination account is incorrect after the transaction is complete, the users must contact with the destination with the information of the destination account holder provided by the bank When the bank's instructions, procedures, rules or regulations of BCEL i-bank have been violated by the users - which is resulted in a termination of using the service BCEL shall not be responsible to any damages resulting from the violation to Article 2.11 and Article 2.12 by entering or updating financial information to phishing channels that shall cause damages to the customer. Article 4: Fees and Charges 4.1. The users agree to pay for the use of service and other fees related to the service according to a rate conducted by the Bank by debiting main or others accounts which held at BCEL In case the users require to request for a new PIN, change an OTP token resulting from damages made by the users, apply for a new OTP token device, stop using BCEL i-bank before 6 months, or stop using BCEL i-bank with outstanding fees; the users do agree to pay a fee according to the rate conducted by the bank For the users who have outstanding fees of BCEL i-bank, the system will automatically debit fee after you have a sufficient amount of fund in the users' account Types of account to debit a fee must be saving or current account only. Article 5: Termination of using service The Bank reserves the right to stop providing the service to the users without any advanced notice as follows: 5.1. The bank is unable to debit monthly fees from the user The bank found out that Terms and Conditions or Agreements signed by the user with the bank was violated When the users enter an invalid password continuously for five times or do not log in to the system for 6 months, the system will temporary lock the users' ID automatically.
