Are there emerging target markets, technologies, or, conversely, abandoned technologies you can identify? What about potentially weak IP? How can I understand a company s patent filing trends with respect to time, jurisdiction, and technologies? Derwent Innovation makes it easy to locate a complete patent portfolio for an organization. Our patent data includes comprehensive assignee information in a standardized, curated format. A single click ensures your results include all members of the patent families owned by an organization. Powerful analytic tools in Derwent Innovation, such as ThemeScape maps, make it easy to examine the complete portfolio, identify abandoned technology, and isolate problem patents. Derwent Data Analyzer (DDA) helps you perform exceptionally detailed review of the portfolio. Automated tools in DDA generate a comprehensive Company Report, an Excel document with in-depth analysis based on Person, Organization, Country, Year, and Technology. Locate the patent portfolio of interest Determine which portfolio you want to analyze, then use multiple assignee fields to ensure comprehensive results. You need to use multiple fields, as assignee data may be misleading, incomplete, or contain errors. Add all family members to your search and group applications with related grants Patent families track the same invention filed with different authorities. Derwent Innovation makes it easy to ensure your results include these related records even if a search did not find them. Authorities also often publish multiple records for the same patent, such as an initial application and the granted patent. Derwent Innovation can group those related records in your results so that you review a single entry for each set of related documents published by an authority.

Select Retrieve DWPI Family or Retrieve INPAODC Family Group related records by application number 1. Click the icon and select Display & Sort Options 2. Click Collapse by and select Application Number 3. Click Preferred Document and select Most Recent 4. Click OK Tip: In your Display & Sort Options, make sure you select the DWPI Title field so that it displays on your Result Set. DWPI Title provides a concise summary of the invention rewritten in standardized English. Identify potential problem patents Discover patents with potential administrative challenges under the America Invents Act Challenged patents could negatively impact the patent portfolio. Identify such patents with a legal status search. 1. From your results, scroll up to the search form 2. In the Preview/edit query box, use the AND operator to add the INPADOC Legal Status Code (LSC) field 3. Search for documents with Post Grant Review (PGR), Inter Partes Review (IPR), and Covered Business Methods (CBM) Example: LSC=(PGR or IPR or CBM) Tip: You must enclose your original assignee search in parentheses and add any additional search terms connected by AND outside the parentheses. 3 Gain Critical Intelligence in a Patent Portfolio 3 Uncover litigation associated with the portfolio 1. In the Preview/edit query box, use the AND operator to add the Litigation (LTG) field 2. Use the following entry to find documents that contain any litigation data LTG=(^ ^) The caret and quotation mark symbols search for the presence of data in the Litigation field. Tip: You can also search for the company of interest as a either a Plaintiff or Defendant as well. Replace LTG with PF or DF to identify a company listed as either a Plaintiff or Defendant, respectively. Review detailed legal status information 1. Scan the DWPI Titles in your results list to quickly identify patents of interest 2. Click the hyperlinked patent number to open the record view 3. Click Full View in the top right corner and navigate to Legal Status section 4. Review INPADOC Legal Status, Litigation, EPO Oppositions, etc., events associated with the patent This example shows Inter Partes review (IPR) filed with the PTAB. The US Litigation section provides a Filing Date, Plaintiffs, Defendants, Jurisdiction (Court), and a Docket Number. Tip: When evaluating portfolios for mergers and acquisitions, click Get Family Legal Status for particularly critical inventions to see summaries of Legal Status events for each member of the INPADOC family.

4 Gain Critical Intelligence in a Patent Portfolio 4 Identify patents of interest Focus on key patents Chart filters on your Results Dashboard provide instant visual analysis of your portfolio of interest. Select items from the charts and click Filter Results to focus your research on those items. Several key filters aid your research: Grants/Apps: Quickly identify protected inventions or look at pending technology Estimated Expiration Year: Examine inventions that will expire soon Estimated Remaining Life: Evaluate which patents have significant remaining terms Dead/Alive: Toggle between dead/expired IP vs. protected IP Count of Citing References-Patent: Quickly identify the most highly cited patents Priority Year: Identify new inventions in the portfolio Tip: Use the Results Dashboard filters in combination. For example, select the last five publication years, Grants, and Dead status to identify recent patents or technology that the company abandoned. Create a ThemeScape map for the portfolio ThemeScape is a visual text mining application that helps uncover similarities and differences in a large data set. 1. Click Reset to return to your comprehensive portfolio 2. Click Analyze, ThemeScape 3. Enter a Name and click Save Note: By default, ThemeScape analyzes English titles and abstracts and DWPI titles and abstracts to give you the best analysis.

5 Gain Critical Intelligence in a Patent Portfolio 5 Explore the patent portfolio with ThemeScape ThemeScape automatically creates groups that allow you to immediately analyze the portfolio Estimated Expiration Year (shown in red) shows records that expire this year; you can also identify inventions that expire in the next 5, 10, or 20 years Conversely, you may want to identify patents that expired within the last 5 years Dead/Alive reveals patents from the portfolio that are or are not in force Explore the map with other automatic groups to further analyze the map, including top jurisdictions, publication year, and top IPC subclasses Derwent Data Analyzer allows detailed portfolio exploration Export the portfolio in Derwent Data Analyzer format 1. Return to the comprehensive Assignee/Applicant search results and click Export 2. Click Format and select Derwent Data Analyzer 3. Optionally change the File name 4. Optionally deselect Compress as ZIP and click Create 5. Wait for the export to finish on the Order Status screen, then click Download now 6. Locate and open the downloaded file The file DDA export uses a PDTF extension. This file automatically opens DDA will starts the import process. The import creates two files: a publication-based file and a family-based file. The file you use depends on the purpose of your evaluation. For example, you may want to review the portfolio at the invention level and use the family file. Or, you may want to review global priority information and use the publication-based file.

6 Gain Critical Intelligence in a Patent Portfolio 6 Review Patent Vital Signs for nuanced evaluations of patent health The Patent Vital Signs (PVS) report provides a granular look at a portfolio. For each grant and application, the report indicates whether that document is likely expired or has positive, negative, or neutral INPADOC Legal Status information. 1. Click the Analyze tab on the ribbon 2. Click the Patent Vital Signs button Double click any column to view that information at the top of the list (sort). For example, you may want to sort on Grant-probably active with negative LLS to identify potentially weak IP. These records may be patents that have a negative legal status event but have not yet been classified as dead. Create a Bubble Chart Bubble Charts visualize matrices to help you easily understand relationships between data. 1. Click the Report tab on the ribbon 2. Click the Bubble Chart button 3. Select the data you would like to examine and how you would like to represent that data on the chart 4. Click Run Tips for successful bubble charts Groups help you focus your analysis on key sections of the data rather than on entire lists, which may contain hundreds of items. For example, you may want to focus on IPC codes associated with a technologies that correspond to specific business units in your organization. Or, you may want to review records from a set of country codes that correspond to a target market region. Create a group 1. Open the field with the data you want grouped 2. Select the items you want included in the group (top 10, specific classification codes, countries, etc.) 3. Right click and select Add Selection to Group 4. Provide a Name for the group Tip: Derwent Data Analyzer also provides extensive tools to help you automatically group your data. Refer to the DDA help file for details.

7 Gain Critical Intelligence in a Patent Portfolio 7 Uncover hidden relationships in the bubble chart Bubble charts help you understand relationships between different data points. A common portfolio analysis (shown left) reveals if a company has brand new priority year filings from year to year, or simply files many foreign equivalents. Other analyses include Assignee x Country (Basic, Priority, or Publication) Note: You may want to use the Family file for this type of analysis. Identify Inventor teams within a portfolio The Cluster Map provides a visual representation of an autocorrelation matrix. The tool takes a list (e.g., Inventors) and compares that list to itself. This reveals links between items in the list, e.g., research and development teams within a company. 1. Open the Inventor (Cleaned) field in a list 2. Click the Refine tab on the ribbon, click List Cleanup, select Person Names.fuz, and click Use 3. Click Accept to accept the groups from the algorithm 4. Select a set of inventors (e.g., top 20) 5. Click the Report tab, then click Cluster Map Colored bars represent the different inventors. Blue circles with numbers represent patents. The interconnecting lines show which inventors work with one another. Review the map to discover frequent collaborators (line thickness) and prolific inventor (size of the blue circle). You can also identify inventors that span technologies (inventors who work with on multiple teams).

8 Gain Critical Intelligence in a Patent Portfolio 8 Identify highly cited patents Derwent Patent Citation Index compiles citation data for the entire DWPI family, which provides a more complete, invention-level view of citation information. Groups help you segment patents in the portfolio based on highly accurate citation counts. 1. Open the Count of Citing Patents DPCI field 2. Select all records with citations in a specific range, e.g., 1 to 9 forward citations 3. Right click, select Add Selection to Group, and give the group a name 4. Create groups for other citation ranges 5. Click the Refine tab on the ribbon 6. Click Create Field From, Group Names This creates a new field: Count of Citing Patents DPCI Group Names. Use the items in this list to create a quick bar, line, or pie chart that visualizes the relative size of each forward citations group. You can quickly identify your most cited patents. Discover top citing companies for the portfolio Detail windows help you discover additional information about items in a list. For example, you can see which companies are citing patents in the portfolio. 1. Click View on the ribbon and click Detail Windows 2. Select the Citing Patents Details DPCI: Assignee field 3. Select a forward citation group to reveal citing assignee information for that segment 4. Select another forward citation group to update the Detail Window with information about that group

9 Gain Critical Intelligence in a Patent Portfolio 9 Create a Company Report and Define Data Categories Create Company Reports from a family-based file that has undergone DDA cleanup. 1. Click Report on the Ribbon 2. Click Company Report 3. DDA verifies that the data is cleaned and, if not, cleans the data 4. Choose fields to analyze for the five fields required by the Company Report: Person: Typically inventors Organization: Assignee Country: Priority country to indicate the likely location of the innovative activity. Year: Priority Year Earliest to define when the innovative activity began Technology: DWPI manual codes compare the technology in each assignees portfolio Note: You can use any classification system, IPC, CPC, or other. 5. Click OK Note that the report may take several minutes to generate, depending on the size of the portfolio. Company Report provides in-depth analysis The report opens in Microsoft Excel. The Overview sheet summarizes the patent portfolio. The Summary section shows the number records, range of years, and when you generated the report. The Coverage section provides details about the data analyzed in the report, such as whether you used priority or publication country. Use the links on the left to jump to specific details about the portfolio, or navigate sheet by sheet.

10 Gain Critical Intelligence in a Patent Portfolio 10 Individual charts explain the analysis and prompt further exploration A gray box in the upper right corner of each sheet explains the information in that sheet and provides prompts for further exploration. Key questions included: What are the company s top technologies? Are there trends in over time, jurisdiction, and technologies? Who are the key inventors and their collaborators? The chart to the left shows the number of records by Priority Year broken down by Priority Country. Top priority jurisdictions include the US and PCT, which may be expect. But, the chart reveals that Germany was a top jurisdiction previously, but disappeared from the data in most recent years.
