1 October 12, 2017 Project No Via David Yelton Deputy Building Official Department of Community Development - City of Beverly Hills 455 North Rexford Drive Beverly Hills, CA Re: April 24 to July 7, 2017 Dust Monitoring and Site Work Observations, Lots 12 and 13, Beverly Hills, California Dear Mr. Yelton: Lindmark Engineering (LE) is pleased to submit this report which documents the observations and dust monitoring for the additional maintenance work performed at Lots 12 and 13, south of North Santa Monica Boulevard (NSMB) and between Alden Drive and Doheny Drive, Beverly Hills (site). The site is depicted on Figures 1 through 3, Appendix A. The site consists of two vacant lots 12 and 13 which comprise the five parcels ; ; and , including the island property adjacent to and just west of Doheny Drive. The site majority owner is the Beverly Hills Land Company (BHLC), which was responsible for trimming all existing hedges, shrubs and plants, and cutting weeds at the site and abutting City of Beverly Hills (City) right of way. The BHLC completed maintenance work at the site on December 14, 2016, described by the City as Phase I, and LE prepared a report summarizing the observations and monitoring results performed, dated January 18, 2017 (Phase I report). Additional maintenance work was performed by the BHLC in February 2017, arsenic sampling was performed only on February 7, and LE conducted daily weather monitoring, and dust monitoring during landscaping maintenance activities. The additional observations and monitoring results were presented in a report, dated March 6, Additional maintenance activities were monitored by LE from March 23 through April 3, 2017, and presented in our report, dated April 28, The scope of work for the Phase I and additional maintenance work included fence repair and replacement, which had the potential to generate dust during the repair activities. No soil removal was conducted during the activities. Previous assessments at the site have found arsenic concentrations in soil above normal background for California soils with a maximum concentration of 996 milligrams per kilogram (mg/kg). Given the known site conditions and potential for dust generation, LE conducted dust monitoring at the site, on behalf of the City, including analytical testing for total arsenic in air. LE s Phase I report found that during site maintenance activities arsenic in dust was not detected in any project samples. The report also found the daily time-weighted average of total dust concentrations recorded during site work did not exceed a difference of 50 micrograms per cubic meter (μg/m 3 ) between upwind and downwind monitoring stations. This report summarizes the additional maintenance work performed on Lots 12 and 13, and on the island, by the BHLC between April 24 and July 7, The scope of the additional maintenance work was to: trim the grass and weeds within the interior of Lots 12 and 13, within 2 feet of NSMB at Lot Townsgate Road, Suite 330, Westlake Village, California T F

2 David Yelton October 12, 2017 and 13, trim the weeds along the fence line against Civic Center Drive at Lot 13, and trim the grass and weeds around the outer perimeter of the island. Maintenance work also including trimming the shooters and branches around the stumps in advance of stump removal activities. The additional maintenance involved similar work activities as performed during the Phase I maintenance. Arsenic sampling, dust monitoring, and weather monitoring was conducted daily during landscaping maintenance activities, and arsenic samples were analyzed as described in this report. SITE WORK OBSERVATIONS LE observed the site maintenance activities by the BHLC between April 24 and July 7, 2017 (see Table 1 for specific work dates). Site work was generally performed along the fence line adjacent to NSMB, along the fence line adjacent to Civic Center Drive, and on the island. A list of work dates and the approximate location of work performed each day is summarized on Table 1, Appendix B. A detailed description of work performed each day is summarized on the daily field reports, included as Appendix C. Landscaping maintenance work was performed by BHLC s contractor Westchester Landscape. Site work generally consisted of clipping, cutting, and sawing bushes, branches, and shrubs. Workers also performed weed whacking and hand clipping of weeds and grass. DUST MONITORING AND ARSENIC SAMPLING ACTIVITIES The community action level for total dust concentrations, based on South Coast Air Quality Management District (AQMD) regulations, is a difference of 50 μg/m 3 between upwind and downwind monitoring stations. Each day where landscaping maintenance was performed, monitoring stations for total dust in air were generally positioned upwind and downwind of the work area, located along the northern or southern fence line of Lots 12 and 13 and the island using MIE Model 1000 personal dust monitors. The monitoring station located on the north fence line was generally upwind of the work area when wind directions were coming from the north, west, or southwest, and the monitoring station located on the south fence line was generally upwind of the work area when wind directions were coming from the south, southeast, and east. LE monitored the on-site weather station and the dust monitoring instruments approximately every 15 minutes during site work. The stations were generally adjusted to follow the site workers and current wind conditions. Note, only one dust monitor was used for both upwind and downwind locations on July 3, 6, and 7, The field monitoring logs are included as Appendix D, which indicate total dust concentrations at each monitoring station, wind speed and direction, and site work observations. Each day the concentration of arsenic in dust was sampled during work hours using air sampling pumps attached to 37 mm MCE filter cartridges. With the exception of samples collected on June 2 and 14, the cartridges were submitted to a State-certified laboratory for analysis using NIOSH Method 7300M. Arsenic was sampled at the same locations where upwind and downwind monitoring stations were positioned. Beginning on May 12, 2017, arsenic samples were only collected at the downwind monitoring station. The laboratory analytical results for arsenic in air are included as Appendix E. The sample chain of custody forms are also included and document the sample identification number, sample location, sampling time and date. SUMMARY OF DUST MONITORING FINDINGS The daily time-weighted average of total dust concentrations recorded during site work did not exceed a difference of 50 μg/m 3 between upwind and downwind monitoring stations on any of the work days. 3 David Yelton October 12, 2017 Refer to the field monitoring logs, included in Appendix D, for each work day to determine which monitoring station was representative of the downwind sampling position. Small amounts of dust were observed on occasion. Note, no field monitoring log is available for April 26, 2017, however the daily field report did not indicate the activities produced excessive dust. On May 24 and 25, 2017, while collecting leaf cuttings in the eastern portion of Lot 12, LE observed a small amount of dust above the cuttings as they were loaded into the stake bed truck. LE recommended to cover the stake bed with a tarp, load the cuttings slower, and toward the back of the stake bed. LE observed some dust while workers removed weeds with powered tools at Lot 13 on June 6, LE immediately stopped work and workers misted the area with water. Similarly on June 9, LE observed some dust during weed whacking, however the dust may have been plant-derived and not soil dust, furthermore the dust readings did not indicate an increase in dust from upwind to downwind monitoring stations. After applying more water to the area, the visible dust was reduced to a very minimal amount. Observations of visible dust are documents on the daily field reports, included as Appendix C. Note, no daily field report is available for June 8, Samples of arsenic in air collected on these dates did not detect arsenic at or above their respective reporting limits. SUMMARY OF ARSENIC SAMPLING FINDINGS Based on the volume of air sampled during each work day, arsenic in air was not detected at or above the reporting limits ranging between µg/m 3 (equivalent to mg/m 3 ) and 1.5 µg/m 3 (equivalent to mg/m 3 ). The reporting limit is the lowest concentration that can be reported by the laboratory given the operational time of the pumps. CONCLUSIONS Based on the available data, concentrations did not exceed the site action level at the fence line. Furthermore, the time-weighted average of total dust concentrations between upwind and downwind monitoring stations was below the community action level of 50 μg/m 3. Based on LE s observations of site work activities, and our monitoring and analytical data, LE concludes the activities did not pose an environmental concern to the community during this project, however a water truck should be available at all times for dust suppression, since activities not involving power tools may still generate dust if the soil is sufficiently dry (eg. vehicle traffic, digging, and raking). RECOMMENDATIONS LE recommends to continue collecting downwind air samples for total arsenic in dust, however we recommend only analyzing the sample in the event dust is observed in the work area.
