8 Value Unit Table for WebSphere Everyplace Server, Service Provider Offering Version 2.1 Value Units Per 50 Users WebSphere Everyplace WebSphere Wireless Synchron Server, Everyplace Gateway Manager Service Server, for for Usage Provider SP Base SP Base SP Base Level Number of Users Offering Offering Offering Offering 1 1 to 5, ,001 to 50, ,001 to 150, ,001 to 500, ,001 to 1,000, ,000,001 to 3,000, ,000,001 to 10,000, ,000,001 to 20,000, ,000,001 or more Contact your IBM representative or authorized Business Partner if you need assistance in determining the appropriate number of Value Units required for your environment. Determining Required Number of Value Units How to Calculate Required Value Units Result The following examples demonstrate the logic used to determine the required number of Value Units. These examples use the full Everyplace Server, Service Provider V2.1 requirements, but the same methodology applies to each of the options. Example 1: Assume that you want to start using Everyplace Server, Service Provider V2.1 with only a portion of your users, then at a later date, add the rest of your users. You may do this with two transactions. Part 1 Initial Transaction Assume you want to license only 1,234 of your users for the initial startup of using Everyplace Server, Service Provider V2.1. How to Calculate Required Value Units Result 1. Round up the number of users to the 1,250 users nearest 50 and identify the (Level 1) applicable Usage Level. 2. Divide the rounded-up number of 25 groups users by 50 to determine the number of 50 of 50-user groups. 3. Refer to Usage Level 1 (the applicable 642 Value level for this example) to determine Units per the required number of Value Units 50 users for each 50-user group. 4. Multiply the number of groups by 25 x 642 the number of Value Units required = 16,050 for each group. If the result is not a multiple of 16,050 five, round up to the nearest five. 5. Order the total number of required Order 16,050 Value Units. Value Units Part 2 Subsequent Transaction At a later date, you are now ready to add the remainder of your users, bringing your total number of users to 12,552. You have already acquired 16,050 Value Units in your initial transaction. 1. Round up the total number of users 12,600 users to the nearest 50 and identify (Level 2) the Usage Level. 2. Divide the number of users by groups of 50 users 3. Identify the number of Value Units 390 Value per 50 users in the Usage Level Units per that contains the total number 50 users of your users. (Level 2) 4. Multiply the total number of 252 x 390 groups of users by the Value = 98,280 Units in that one Usage Level. 5. Round up to the nearest five 98,280 Value Units. 6. Subtract the number of Value Units 98,280 acquired in your previous 16,050 transaction. = 82, Order the number of Value Units Order 82,230 required for this transaction. Value Units Example 2: If you start with 600 users, the required number of Value Units is 7,705. That is 600 divided by 50 = 12, then multiply 12 times 642 (Value Units per 50 Users in Usage Level 1). This equals 7,704 which is then rounded up to 7,705. You should order 7,705 Value Units to license your 600 users. If, at a later date, you wish to increase your total number of users to 6,000, the total required Value Units is 46,800. That is 6,000 divided by 50 = 120, then multiply 120 by 390 (Value Units per 50 Users in Usage Level 2) for a total of 46,800 Value Units required to license your total 6,000 users. However, since you have already acquired 7,705 Value Points in your initial transaction, you need to order only 39,095 Value Units in this transaction to bring your total of Value Units purchased to 46,800. If you decide to start with 6,000 users (Usage Level 2), you should order 52,080 Value Units (120 x 390 = 46,800). You always use the Usage Level that represents the total number of users at that time in your environment

Everyplace Server, Service Provider V2.1 pricing and software subscription is structured differently than either of the Version 1.1 editions. To ensure that each WebSphere Everyplace Suite Version 1.1 customer who purchased software subscription receives the correct upgrade entitlements for Everyplace Server, Service Provider V2.1, each eligible customer will be contacted by IBM to review and evaluate their specific situation. The terms of the customer s Version 1.1 subscription options will determine the specific Version 2.1 upgrades to which the customer is entitled. Within approximately two weeks after this announcement, your IBM Pervasive Computing Division representative will contact you to discuss the new product and evaluate your eligibility for upgrades and licensing. If you are using Version 1.1 but did not purchase a software subscription option, you may contact your IBM representative to discuss the most appropriate Version 2.1 options for you. Terms and Conditions Licensing: IBM International Program License Agreement (IPLA). Proofs of Entitlement are required for all authorized use. License Information (LI) Form Number: The LI is provided in the program software. Limited Warranty: Yes Program Services: Basic Program Services are provided as part of the IBM basic software license agreement as described in the IPLA/LI of the product. 11 Usage Restriction: Yes Everyplace Server, Service Provider V2.1 includes some other IBM programs that have unique terms and conditions, in addition to the terms and conditions of the IPLA. These unique terms and conditions are in the LI that are provided with the Program. Program-unique Terms The IBM WebSphere Everyplace Server, Service Provider Offering (the Program or WES ) consists of several components. Program components may be used only within the Program environment. In addition, any client function elements or code included with components of the Program may be used only in conjunction with such component of the Program, subject to any additional restrictions below. The Program is priced with IBM Value Units, which are used to determine the required number of Program licenses, are Program specific, and cannot be transferred to another IBM product. The required number of Program licenses is based on the number of users authorized to access the Program environment. For customers using the Program in connection with providing hosting/asp services to third party end user customers, as an additional prerequisite to such use of the Program, you must also agree to the Application Solution Provider Addendum to the IBM Lotus International Passport Advantage Agreement (the Addendum ). If you are not a Lotus Passport customer, such additional terms will be provided to you in a Supplement to this License Information Document. By using the Program, you agree to be bound by the additional terms of the Supplement. The Program may contain cryptography which is subject to special export licensing requirements of the U.S. Department of Commerce or other countries. Refer to the Program documentation or consult your IBM representative for details on the available level of encryption. Some of the components of the Program are provided in source code form. Notwithstanding anything to the contrary in the IBM International Program License Agreement ( Agreement ), Program Services are only provided for the unmodified, binary code versions of these components included in Program packaging, and not for the source code for these components or for any modifications of such components you may create. IBM is providing this source code on an AS IS BASIS, WITHOUT WARRANTY OF ANY KIND (EITHER EXPRESS OR IMPLIED) INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF NON-INFRINGEMENT. In addition to the terms above, certain components of the Program have Program-unique terms which are identified below, and which apply to the referenced component of the Program. For WebSphere Edge Server This component of the Program includes Cyber Patrol software components provided by SurfControl. These components require lists generated by SurfControl to function properly. The Program includes a version of these lists; however, the lists included in the packaging for the Program will be outdated by the time you receive them and are provided by IBM on an AS-IS basis without program services and without warranty of any kind. The packaging for the Program may include a trial subscription to receive updated versions of these lists directly from SurfControl. Unless the packaging for the Program provides notice to the contrary, you must activate this trial subscription directly with SurfControl and obtain updated versions of the list directly from SurfControl. IBM does not provide any warranties or program services for lists obtained from SurfControl. For MQSeries Everyplace Mobile device platform use authorizations (which are recorded on Proof of Entitlement documents) licenses are required to use the MQSeries Everyplace device program (other than for purposes of internal code development and testing) on certain client platforms. These licenses do not entitle the user: 1. To use the MQSeries Everyplace Bridge; or 2. To run on certain server platforms, such as Microsoft Windows 2000 Server, specified in published lists available via the Web site listed below. Refer to for further details. For WebSphere Transcoding Publisher WebSphere Transcoding Publisher consists of, but is not limited to, a functional framework ( Framework ), transcoders, device profiles, development toolkit, documentation, and installation and administrative capability. WebSphere Transcoding Publisher contains JavaBeans, (each referred to below as Components ) that, subject to the Agreement, may be used by you in other products within your enterprise. Notwithstanding any other terms in the Agreement, your license to use WebSphere Transcoding Publisher is conditioned on you not using WebSphere Transcoding Publisher to access, process, distribute or manipulate (collectively, Filter ) any materials unless you have the right ( Rights ) to Filter such materials using WebSphere Transcoding Publisher because you (i) own the materials or (ii) have acquired sufficient rights to so Filter the materials. You also represent and warrant that if you do Filter any materials using WebSphere Transcoding Publisher, you have the Rights to so Filter the materials. Transcoders created by you or another third party (each referred to below as Your Transcoders ) can also, subject to the Agreement, be used with the Framework. Subject to the Agreement and all terms and conditions in this section, IBM grants you the rights to reproduce Components and include the unmodified Components in your products ( Your Products ). Subject to the Agreement and all terms and conditions in this section, IBM grants you the rights to use Your Transcoders with the Framework. IBM DOES NOT PROVIDE ANY WARRANTY FOR YOUR PRODUCTS OR YOUR TRANSCODERS. IBM S WARRANTY OBLIGATIONS WITH RESPECT TO THE COMPONENTS AND THE FRAMEWORK ARE LIMITED TO THOSE SET FORTH UNDER LIMITED WARRANTY IN THE AGREEMENT. YOU, AND NOT IBM, ARE RESPONSIBLE FOR THE OVERALL RESULTS ACHIEVED BY YOUR PRODUCTS AND YOUR TRANSCODERS

12 For WebSphere Application Server, Advanced Edition WebSphere Application Server (WAS) consists of the following software components: Application Server, Admin Client, IBM HTTP Server, Distributed Debugger, SecureWay Directory, and DB2 Universal Database (UDB). ADMIN CLIENT, DISTRIBUTED DEBUGGER COMPONENTS: Notwithstanding anything in the Agreement to the contrary, you are authorized to install and use an unlimited number of copies of the Admin Client and Distributed Debugger components of WAS on any of your machines. ADDITIONAL RESTRICTED USE COPIES: In addition to the rights and licenses granted to you under the Agreement, you may install and use additional copies of WAS under the terms and conditions of the license agreements installed with WAS in the DEVLIC directory. Among other things, these license agreements limit your use of such additional copies of WAS to use for internal evaluation and for the development, demonstration and testing of applications which use WAS, and not for the deployment or execution of any such applications, which requires the acquisition of a full authorization to WAS. THIRD PARTY CODE: WAS contains certain third party code which is provided to you under terms and conditions which are different from the Agreement, or which requires IBM to provide you with certain notices and/or information. IBM WILL IDENTIFY ANY SUCH THIRD PARTY CODE IN THE README FILE ASSOCIATED WITH WAS, OR IN A FILE OR FILES REFERENCED IN THE WAS README FILE AND SHALL INCLUDE ANY ASSOCIATED TERMS AND CONDITIONS, NOTICES AND OTHER RELATED INFORMATION THEREIN. By using or not uninstalling such third party code after the initial installation of such third party code (thereby giving you access to all such terms and conditions, notices and information), you acknowledge and agree to all such terms and conditions, notices and information, including those provided only in the English language. IBM HTTP SERVER AND THE APACHE HTTP SERVER: The IBM HTTP Server component of WAS includes software developed by The Apache Group for use in the Apache HTTP Server project see= cap= txt=. In addition, WAS is accompanied by source code for the Apache HTTP Server. The portions of the IBM HTTP Server which are based on software developed by The Apache Group and the source code for the Apache HTTP Server are Copyright The Apache Group. All rights reserved. Your use of the source code for the Apache HTTP Server accompanying the Program is subject to the terms and conditions of the license from The Apache Group, which is reproduced in the ReadMe file associated with WAS or in a file or files referenced by the WAS ReadMe file, and not the Agreement. In particular, IBM is providing the source code for the Apache HTTP Server on an AS IS BASIS, WITHOUT WARRANTY OF ANY KIND (EITHER EXPRESS OR IMPLIED) INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF NON-INFRINGEMENT. You may not disclose the results of any benchmark test of IBM HTTP Server to any third party without IBM s prior written approval. Notwithstanding anything to the contrary in the Agreement, you are authorized to install and use an unlimited number of copies of the IBM HTTP Server component of WAS on any of your machines, provided that only one such copy of IBM HTTP Server will be subject to the representations and warranties of the Agreement and will be eligible for Program Services. For DB2 UDB, Enterprise Edition The Program includes portions of DB2 UDB. You are authorized to install and use one copy of these components only in association with your licensed use of the Program for the storage and management of data used and generated by the Program, and not for other data management purposes. For example, this license does not include inbound connections to the database from other applications for queries or report generation. You are authorized to install and use these components only with and on the same machine as the Program. For Sametime Everyplace Only end users with a valid Sametime license are permitted to access Sametime Everyplace. In addition, you must acquire one Sametime Everyplace license for every user who accesses Sametime Everyplace. You may install Sametime Everyplace on as many servers as necessary to support the users. Your acquisition of Sametime Everyplace entitles you to one copy of the Domino Server and one copy of the Domino Everyplace SMS Server. You may not make any copies of the Domino Everyplace SMS Server and you may install one copy of the Domino Server on every server on which you install a copy of Sametime Everyplace; provided however, that you may use the Domino Everyplace SMS copy and the Domino Server copies for the sole and exclusive purpose of providing users access to Sametime Everyplace. For Tivoli SecureWay Policy Director WES includes components of Tivoli SecureWay Policy Director. You are entitled to install, from the media provided with WES, up to your authorized use, Tivoli SecureWay Policy Director components required to directly support WES. For use of Tivoli SecureWay Policy Director components other than in direct support of your authorized use of WES, you must acquire a full use authorization for Tivoli SecureWay Policy Director. Tivoli SecureWay Policy Director contains several server components and a client component. The DCE components included with this Program can only be used to access Tivoli SecureWay Policy Director Server Components. You may only use the DB2 UDB component of the Tivoli SecureWay Policy Director in direct support of your authorized use of Tivoli SecureWay Policy Director. You understand and agree that Tivoli SecureWay Policy Director contains software from RSA Data Security, Inc. ( RSA Code ). You may not modify or directly access the RSA Code or its functions, except through the function calls of the Program, which may not be modified. In addition, Tivoli SecureWay Policy Director contains Standard Template Library software ( STL Software ) from Silicon Graphics Computer Systems, Inc. ( SG STL Software ) and Hewlett-Packard Company ( HP STL Software ). SG STL Software is copyright Silicon Computer Systems, Inc. and HP STL Software is copyright 1994 Hewlett-Packard Company. STL Software may be found on the Web at and other places. Permission to use, copy, modify, distribute and sell the SG STL Software and HP STL Software and their documentation for any purpose is hereby granted without fee, provided that the above copyright notice appears in all copies and that both that copyright notice and this permission notice appear in supporting documentation.
