Marg Mumbai Phone: pai@dae.gov.in No : MSG/COMP/03/HW/2K13/5939 May 7, Subject: Invitation of Quotation for placing a workorder for Annual Maintenance Contract of Desktop PC Rackmount PCs, Monitors, Printers, Laptop, KVM switches, Printer sharer etc. Last date for submission of bids: May 27, :00 PM Sealed tenders on printed letter heads are invited for entering into an Annual Maintenance Contract(AMC) on regular basis for Desktop PCs, Rack Mount Servers, KVM switches (Keyboard, Monitor and Mouse sharer) and Monitors etc. as mentioned in Annex-1 for the respective periods mentioned against each item and maintenance on Call Basis for printer/notebook PCs etc. mentioned in Annex-1. The total maintenance charges should be quoted separately, for the period mentioned against each item in Annex-1 & Annex-2. Charges quoted in any other format or partial /incomplete quotations will be summarily rejected. The contract will be effective for the period mentioned in the tender against each item. 2. Inspection and location of equipments: The equipment that are required to be maintained can be inspected by the Bidder between May 23 & May 24 (10.00 p.m. to 3.00 p.m.) with prior appointment with the undersigned on the above telephone numbers. Most of the equipments to be inspected/maintained are located at above address except few. The location of items which are not located at above address have been specifically indicated against item description in the respective Annexes. 3. Format for quotation and guidelines : The Bidder is required to quote separately for each item in the format given in Annex-1 and Annex-2 for the contract periods mentioned therein. The Bidder is required to adhere to all the terms & conditions listed in Annex-3 to this tender. The details of the terms and conditions for items covered by maintenance on Regular Basis and those under Call basis are given separately in Annex-3 and bidders should carefully go through them before preparing the bids. The Department of Atomic Energy reserves the right to reject any offer without assigning any reason thereof. 4. Qualification/Eligibilityto bid: The bidders shall fulfill following eligibility criteria:- 4.1 Only parties with a regular office in Mumbai manned by Computer Engineers are eligible. 1

3 a.) The party should have proof of having filed IT returns for the past 3 years. A copy of the same has to be produced on demand including for the assessment year b.) The party should have earned profits during the last 2 years. Final account statement in proof of the same has to be submitted on demand. c.) List of at least 3 engineers who would attend to calls along with their qualifications should be mentioned along with the bid in Annex Parties shall enclose details of parties with whom the bidder is having AMC for maintaining similar equipment including rack mount servers, notebook PCs and printers etc.. If demanded the bidder shall produce copies of the contract for verification. 4.3 Along with the quotation, the Bidder is also required to send a profile of the organization and a list of Clients for whom similar work has been undertaken. 5.0 Terms of Payment : 5.1 The payment towards AMC shall be made, on a quarterly basis as follows: Payment shall be made, in 8 installments on completion of each quarter of two Annual Contract period, taking into consideration any penalty (refer Para-3 in Annex-3) imposed on the party at the end of each quarter. Management Services Group, DAE shall issue a Certificate every quarter regarding quality of service rendered by the Contractor and penalty, if any, to be levied from the contractor as per the terms and conditions of the contract. 5.2 All penalties (Refer para 3 of Annex-3) due from the contractor at the end of the contract period shall be paid to the department in cash/cheque on expiry of the contract or the department may extend the period of the contract by a suitable period which would compensate (on a pro-rata basis at the same rates as applicable during the contract period) for the payment due from the contractor. 5.3 Payment for services rendered for equipment mentioned in Annex-2 that are maintained on call basis shall be made after satisfactory completion of the work. Amount payable for services rendered on call basis shall include call charges and cost of components replaced at actuals. The Contractor shall submit an invoice for the charges applicable, on a call-by-call basis. The invoice shall indicate the call charges and repair/material charges separately. The contractor should be able to prove, if required, that the cost of the material being charged is reasonable. 6. Earnest Money Deposit (EMD): The bidder has to enclose a draft of value equal to 2.5% of AMC charges quoted for a year drawn in favour of Pay & Accounts Officer, D.A.E. towards EMD. The draft will be returned to all unsuccessful bidders immediately after finalising the contract. For successful bidder for whom the contract is going to be awarded the draft will be returned after placement of work order and receipt of bank guaranty as in para 7 below. Quotations without EMD are liable to be rejected. 2

4 7. SECURITY DEPOSIT/BANK GUARANTEE: On entering into AMC the vendor shall make a Security Deposit(SD) of 10% of the value of 2 years AMC. Alternatively the contractor shall furnish a Bank Guarantee towards security deposit of 10% of the 2 yrs AMC duly executed by any nationalised bank or scheduled bank as per the standard format. The bank guarantee/sd shall remain valid till the expiry of entire period of the contract (Maximum 2 years and 6 months ) and shall reach the purchaser within 15 days from the date of receipt of work-order. The bank guaranty/sd will be en-cashed for non-compliance of any of the terms and conditions of the work-order and for levying un-adjusted penalty, if required. 8. Termination : The Department reserves the right to terminate the contract by giving notice of one month without any financial obligation on its part. In the event of cancellation of the contract or non-servicing of equipment for one reason or the other, the payment for services actually carried out will be paid on a pro-rata basis. 9. Scope of Maintenance Coverage : i) For items covered under regular basis ( Annex-1) rates quoted for the Maintenance Contract shall include labour and parts for entire period. ii) The Maintenance shall cover breakdown calls for all items. In addition, Preventive Maintenance, such as cleaning of drive heads, keyboards and PCBs should be covered. iii) The Maintenance shall cover replacement/repair of Hard Disk Drives including head crash. iv) Problems that arise out of computer virus shall be rectified under the Contract. v) During preventive maintenance the server racks (5 nos.) in the main computer room shall be opened and cleaned to keep them dust free. A portion of Preventive maintenance, if needed, shall be performed beyond office hours to avoid disruption of network services. The vendor shall bring vacuum cleaner for carrying out preventive maintenance 10. The maintenance charges shall remain unchanged during the period of the contract and during the period of extension of the contract period, if any, arising due to penalty imposed on the contractor. Sealed envelope containing your quotation shall be superscribed with MSG/AMC/ and shall be sent to the undersigned in R.No 102 at the above address so as to reach by 3.00 p.m. on May 27, It may be noted that late quotations shall not be considered. 15 Annex-3 Page 1 of 4 TERMS & CONDITIONS OF THE CONTRACT FOR ITEMS COVERED UNDER MAINTENANCE CONTRACT ON A REGULAR BASIS. The Contractor shall agree to comply with the following terms and conditions to provide trouble free maintenance/repair/ replacement for items mentioned in Annex-1 which are to be maintained on a regular basis. 1. RESPONSE TIME: The engineer will attend the service call within 6 working hours (excluding holidays) after placement of a call. DAE's normal working hours are from 9.30 a.m. to 6.00 p.m. from Monday to Friday. 2. GUARANTEED REPAIR TIME: The fault will be rectified within 6 hours from the time of reporting of call, so as to make available a perfectly working PC, along with the peripherals, VDU, Floppy Drive etc. 3. PENALTY: In case of the guaranteed repair time not being met, the following penalty shall be leviable: 3.1 Beyond 6 hours and upto 24 working hours, the penalty leviable will be 2% of the value of the AMC for the PC in question. While calculating this penalty, a PC would be deemed to be down even if a peripheral attached to it, viz. floppy drive or hard disk, is down. 3.2 Beyond 24 working hours & upto 7 days, the penalty leviable will be 4%, with all other conditions remaining identical as at 3.1 above 3.3 Beyond 7 days the penalty will be calculated as follows with other conditions remaining identical as at 3.1 above. Number of Days Elapsed % Penalty Betwen 7 days to 14 days 8% Between 15 days to 1 month 10% Beyond 1 month 25% All the above penalty would be chargeable on the Quarterly AMC charges payable. 3.4 When required, special consumable items shall be procured by the Contractor with the written consent of the department and installed within the stipulated guaranteed repair time. DAE shall pay the Contractor the actual cost of the consumable on production of invoice. 1

16 Annex-3 Page 2 of If any of the equipment i.e. PC units or the peripherals, cannot be repaired within a reasonable time period, the Contractor shall provide temporary replacement for the same. However, this replacement will not exceed a period of one month; the original equipment should be re-installed within this period. 3.6 The contract will cover replacement of hard disk head crash at no extra cost. 3.7 A common register will be maintained to monitor the delays. Bidder's maintenance personnel should check and initial the same on attending the job without fail. 4. OVERALL AVAILABILITY The overall availability of all PCs and monitors (Listed in page 1 to 8 of Annex-1) under the guaranteed repair time shall be 95%. This will be computed every three months, using the following formula and shall pertain to each PC and all the peripherals attached it. Working hours during which a PC and all peripherals units were operational X 100 Total working hours of DAE for the quarter Time taken for repairing and testing will be included in down time. In the event of 95% availability not being maintained, a penalty of 1% of the value of Annual Maintenance Contract for the system in question will be leviable for every 1% shortfall in the availability. This penalty will be in addition to any other penalty mentioned in this contract. 5. PREVENTIVE MAINTENANCE 5.1 Preventive Maintenance will be carried out on the first Monday following the end of each quarter. If the day happens to be a holiday, it will be carried out on the next working day. PCs will be made available in turn for Preventive Maintenance, which should be completed within a maximum period of three working days from the starting date. 5.2 All floppy drives heads, should be cleaned during the above Preventive Maintenance. All the ICs and internal parts should be serviced and cleaned, and ensured that they are dust free. 5.3 All mechanical parts should be serviced during Preventive Maintenance. 5.4 A penalty of 5% of the value of the yearly cost of AMC would be charged on each occasion preventive maintenance is not undertaken as per the above schedule. 5.5 Cleaning of racks : During preventive maintenance the server racks (5 nos.) in the main computer room shall be opened and cleaned to keep them dust free. A portion of the preventive maintenance, if needed, shall be performed beyond office hours to avoid disruption of network services. The vendor shall bring vacuum cleaner for carrying out preventive maintenance 2

MAINTENANCE CHARGES AND BASIS FOR CALCULATING PENALTY The item wise maintenance charges quoted for the PCs and its peripherals, mentioned against each item in Annex-1 (full periods maintenance charges) will be the basis for calculating penalties. 7. SCOPE AND GENERAL TERMS: 7.1 For items covered under regular basis Rates quoted for the Maintenance Contract composes labour and parts for entire period. 7.2 The Maintenance shall cover breakdown calls for all items. In addition, Preventive Maintenance, such as cleaning of drive heads, keyboards and PCBs should be covered. 7.3 The Maintenance shall cover replacement/repair of Hard Disk Drives including head crash. 7.4 Problems that arise out of computer virus shall be rectified under the Contract. 8. UPGRADATION OF PC UNITS AND ATTACHMENT OF ADDITIONAL PERIPHERALS. The Department of Atomic Energy reserves the right to upgrade the PCs and attach new peripherals to the existing system by parties other than the party who has actually undertaken the AMC. However, such changes, if any will be done with the knowledge of the party carrying out the AMC. After upgrading the PCs/Peripherals, the upgraded PC/items will be excluded from the AMC as they would be covered by warranty and amount payable will be accordingly reduced. A letter to this effect will be given to the party and the party should take this into account while claiming AMC charges in the subsequent quarters. 9. DATA RESTORATION FROM HARD DISK In case the hard disk is to be formatted as result of some repairs carried out by the contractor he will be responsible for backup and restoration of data. 10. BANK Guarantee : Vendor shall supply bank guarantee as per BANK GUARANTEE clause in the main Work Order. 11. POLICE VERIFICATION CERTIFICATE : The vendor shall produce police verification certificate of the visiting engineer. As per DAE s policy no outsider is permitted to offer services in its premises without proper Police Verification Certificate. 3

18 Annex-3 Page 4 of 4 TERMS AND CONDITIONS FOR MAINTENANCE OF EQUIPMENT ON CALL BASIS A. The AMC on call basis will be valid for a period of two years starting from to B. The scope of AMC on call basis is limited only to items mentioned in Annex-2 i.e. items to be maintained on Call Basis only. It shall include diagnosing and rectification of faults. C. The engineer shall attend the service call within 2 working hours (excluding holidays) after placement of a call by the Management Services Group. The calls would be attended during normal working hours of the Department of Atomic Energy, which are 9.30 a.m. to 6 p.m. from Monday to Friday. The charges applicable on call basis will be as mentioned against each item in of Annex-2. D. The Contractor is expected to resolve the maintenance complaint within 2 hours of his reaching Anushakti Bhavan. Minor problems will be solved on sight at no extra service/repair charges. If major repairs are necessary to be carried out, the additional repair/material charges will be payable at actuals. The contractor shall submit an invoice for the charges applicable, on a call-by-call basis. The payment shall become payable on issue of certificate by MSG after satisfactory completion of the job. E. A separate register will be maintained in DAE regarding the time when a call was made, time taken to rectify the fault and details thereof. This register should be signed by the engineer when a call is being attended and after the fault is rectified. 4
